Can I get ny unemployment if fired for refusing vaccine mandate?

Just got terminated from my healthcare job of 4 years because I refused to get the COVID vaccine. They gave me until October 15th to comply or leave, and I chose not to get it. My supervisor said it was being marked as "failure to meet job requirements" not as a voluntary resignation. Does anyone know if I qualify for unemployment benefits in New York? I'm not sure if this counts as misconduct or if I have any chance of getting benefits. I really need some income while I look for a new job that doesn't have vaccine requirements. Has anyone else gone through something similar with ny unemployment?

Unfortunately, in New York, if you don't comply with an employer mandate that's legal (which the vaccine requirement is for healthcare), it's considered misconduct and you'll probably be denied benefits. My cousin works in HR and said unemployment typically sides with employers on this issue. You can always apply, but prepare for a fight if you appeal.

Thanks for the honest answer. I was afraid of that. Do you know if appeals ever work in these situations?

0 coins

Appeals are tough for vaccine refusals. You'd need to prove either medical exemption that was ignored or that the policy was applied unfairly just to you.

This is BS tho because nobody should be FORCED to get a vaccine just to keep their job. The system is so messed up 😡

The law is pretty clear on this. Healthcare facilities can require vaccines. It's been that way for decades with other vaccines too.

After struggling with NY unemployment for weeks and getting nowhere on the phone, I found this service called Claimyr that got me through to an actual person at unemployment. They stayed on hold for me and then called when they got someone. Talking to a real agent got my issue resolved in one call! It was the best money I've spent during this whole ordeal. Check out their video: https://youtu.be/Rdqa1gKtxuE

Does this actually work? I've been trying to get through for 3 weeks now with no luck 😫

Yeah it worked for me! I was skeptical at first but after trying to call for days myself I was desperate. They called me when they got an agent and I just talked directly to unemployment. Saved me hours of stress.

another day, another company promising to fix the unfixable unemployment system lol... did they actually help?

They did! I was surprised too. Not saying it fixes the whole system but it got me to an actual person who helped solve my issue. claimyr.com if you wanna try it.

I'm in the exact same situation but at a hospital. I applied for unemployment anyway and got denied, but I'm appealing. My argument is that the mandate changed AFTER I was hired so it wasn't the original condition of employment. Will update when I hear back.

Good luck with your appeal! Let us know how it goes, I'm curios if that argument works.

Will do! Hearing is scheduled for next week. I'm nervous but hoping they see my side of things.

This is a really complex situation with NY unemployment right now. I've been researching this extensively as I work in legal services. Here's what you need to know: NYSDOL is generally ruling that vaccine refusals without approved exemptions count as misconduct, which disqualifies you from benefits. However, there are some key factors that could help your case: - If you requested a religious or medical exemption that was denied without proper consideration - If the employer didn't properly communicate the policy or deadline - If other employees were treated differently under the same policy - If the termination paperwork doesn't specifically cite misconduct or insubordination Your best approach is to apply anyway, and if denied, immediately request a hearing. Document EVERYTHING - emails about the policy, your communications with HR, etc. If you're struggling to reach someone at unemployment (which is likely), I've had clients use claimyr.com to get through to an actual representative. Much better than waiting hours on hold. Hope this helps!

IANAL but you're screwed dude. NY is an at-will state and healthcare has ALWAYS required various vaccines. This is no different. My wife works at a big hospital in Buffalo and they've required flu shots for years.

0 coins

Yeah but flu vaccines have been around way longer. This felt different to me.

Doesn't matter legally tho. The courts have upheld vaccine mandates repeatedly. I get why u feel that way but unemployment isn't gonna care about the difference.

I actually won my appeal for almost this exact situation! Apply and then when denied (which you probably will be initially) request a hearing ASAP. What helped me was showing that the policy was implemented with only 2 weeks notice and I had documented medical concerns (not a full exemption). The judge ruled it wasn't misconduct since I wasn't given reasonable time to comply.

That's encouraging! Did you have a lawyer for your hearing?

0 coins

No lawyer, just brought all my documentation and stayed calm while explaining my reasoning. The hearing officers are actually pretty fair in my experience.

0 coins

How long did your appeal process take from start to finish? I'm in week 6 of waiting 😫

0 coins

About 8 weeks total from initial denial to getting approved after the hearing. It's slow but worth fighting!

0 coins

totally off topic but has anyone else noticed that the ny unemployment website is down EVERY SINGLE NIGHT from like 12-7am? So annoying when I'm up late trying to certify 🙄

0 coins

omg yes!!! I work night shift and it's impossible to do anything on the site during my breaks 🤬

0 coins

They do system maintenance at night. It literally says this on their website lol

Doesnt matter why you got fired. Apply anyway. Always apply. Worst they can say is no and then you appeal. Don't leave money on the table cause you think you might not qualify.

This happened to my brother and he got denied UI but then got a job at a place with no vax requirement making more $ than before. There's places hiring that don't care about vax status, especially outside healthcare. Maybe try warehouses or remote work?

0 coins

That's what I'm looking into now. Just wanted some income during the job search. What type of warehouse did your brother find?

0 coins

He's at some amazon fulfillment center now. Not glamorous but decent pay and they were desperate for workers.

I couldn't get through to NY unemployment for DAYS about my similar situation. Phones always busy, website kept crashing. Finally found this service called Claimyr that got me connected to an agent. Worth every penny to finally get answers about my claim! claimyr.com saved my sanity for real.

wait hold up - does this actually work or is it just the usual BS? been burned by 'services' before...

0 coins

It worked for me! They basically just wait on hold so you don't have to, then call you when they get a real person. Saved me hours of frustration.

0 coins

Don't listen to people saying you have no chance. My wife got UI after being fired for no vax, but it took 3 appeals and 4 months. The key was that she had requested a medical exemption that they denied without proper review. Document EVERYTHING.

0 coins

why don't u just get the shot lol

0 coins

Personal choice. Not here to debate vaccines, just asking about unemployment benefits.

0 coins

OP asked a legit question about benefits not for medical advice 🤦‍♂️

0 coins

fair enough, jus saying would've been easier than dealing with unemployment lmao

0 coins

FYI the law specifically states that willful violation of employer's rules is misconduct. Mandates that comply with state guidelines = valid rules. Sorry but you're probably not gonna qualify. Apply anyway but prepare for worst case.

0 coins

Nobody seems to be mentioning this, but your chances might depend on WHEN you were fired. The NY state healthcare worker mandate officially went into effect Sept 27, 2021. If your employer fired you before the official mandate, you might have a better case.

0 coins

That's interesting. They gave me until Oct 15th to comply, then terminated me on the 16th when I didn't.

0 coins

Ah, then you're likely dealing with the official mandate situation which makes it harder. But still worth applying!

0 coins

Yo anyone else's payments randomly stop for "verification" recently? I swear NY unemployment is finding any excuse to not pay people these days 😤

0 coins

YES!!! Going on 3 weeks with no payment and can't get anyone on the phone!

0 coins

Try using claimyr.com - it's the only way I could actually reach someone to fix my verification issue.
