Can you apply for unemployment if you resign from your job in New York?

I've been dealing with a toxic work environment at my current job for months now. My supervisor has been making unreasonable demands and the workplace has become hostile. I'm seriously considering resigning but I'm worried about being able to collect unemployment benefits. Does anyone know if you can apply for unemployment if you resign in New York? I heard there might be exceptions for certain situations but I'm not sure what qualifies. Any advice would be really helpful.

Generally speaking, if you voluntarily quit your job, you won't be eligible for unemployment benefits in New York. However, there are some exceptions under NYS Department of Labor rules. You can potentially qualify if you resigned for 'good cause' which includes things like unsafe working conditions, harassment, significant changes to your job duties or pay, or domestic violence situations. You'd need to document everything and be prepared to prove your case during the adjudication process.

Thanks for the info! What kind of documentation would I need to prove harassment or hostile work environment? I have some emails but not sure if that's enough.

I actually went through this exact situation last year. I resigned due to my boss creating an impossible work environment and was initially denied benefits. The key is filing your claim immediately after resigning and being very detailed about why you quit when you file. During my phone interview with NYS Department of Labor, I had to explain everything that happened and provide dates. It took about 6 weeks for adjudication but I eventually got approved. Keep copies of any emails, witness statements if possible, and document specific incidents with dates.

6 weeks for adjudication?? That's crazy long. I'm going through something similar right now and it's been 3 weeks already with no update.

Yeah it was frustrating but worth it in the end. Make sure you keep filing your weekly claims even while it's under review or you'll lose those weeks.

If you're having trouble getting through to NYS Department of Labor to check on your claim status or explain your resignation situation, I had good luck using a service called Claimyr. They help you get connected to actual agents instead of waiting on hold forever. Check out claimyr.com - they have a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Really helped me when I was stuck in adjudication limbo.

Is that one of those services that charges you? I'm already tight on money which is why I need the unemployment in the first place.

They do charge but honestly it was worth it for me to actually talk to someone instead of calling 50+ times a day and getting nowhere. But I understand the money concern.

You can definitely appeal! You have 30 days from the denial notice to file an appeal. Make sure you gather all your documentation about why you quit and be prepared to present your case at a hearing.

The whole system is so unfair. They make it nearly impossible to prove 'good cause' unless you have perfect documentation. Most people don't think to document harassment when it's happening because they're just trying to survive the situation.

This is exactly my concern. I have some evidence but wish I had started documenting everything from the beginning.
