Can I get ny unemployment after being laid off from new job? Previously exhausted benefits

I collected unemployment from August till January for my full 26 weeks. Then I was lucky enough to find a job in March, but the company had budget cuts and I got laid off last week after only working there for about a month. Does anyone know if I qualify to receive more unemployment benefits now? Not sure if I need to open a new claim or if my previous one can be reopened somehow. The timing really sucks because I just signed a new apartment lease thinking I had stable income again.

Yes u do qualify! This happened to me last year. Since you worked again after your benefits ended, you can file a new claim. Just make sure you have the pay stubs from that short job to show your earnings. The amount might be different based on what you earned at the new place.

I think you need to have earned at least 10x your weekly benefit rate from the previous claim. So if you were getting $400/week before, you need to have earned at least $4000 at the new job.

In NY you need to work and earn enough in a calendar quarter to establish a new benefit year. Its based on ur base period which is the first 4 of the last 5 completed calendar quarters before filing. Check out the NYSDOL website, they have a calculator that might help u figure out if u qualify.

Same thing happened to my brother and he had to wait until his benefit year expired (which is 12 months from when u first filed). After that he could file a new claim. The system is so broken it makes no sense.

You might qualify for partial benefits depending on how many days you worked total in the last year. Def file a new claim asap and let them determine eligibility rather than trying to figure it out yourself. The worst they can say is no.

For me it took about 2 weeks to get approved, but that was after I talked to an agent who fixed some issues with my claim. Without that intervention it could have taken much longer.

Try calling right when they open at 8am. That's how I finally got through after trying for days.

youll most likely have to file a new claim BUT u might not be eligible if u didn't work enough calendar quarters. NY has some BS rules about this.

Make sure to file a new claim within 7 days of losing your job! This is super important because benefits aren't retroactive to when you lost work, only to when you file!

I'd start with filing online and selecting "reopen an existing claim" first. If that doesn't work then try filing a new claim. The system might automatically direct you anyway depending on your situation.
