Can I file a new NY unemployment claim after benefits end or do I need to reopen?

My NY unemployment benefits just ran out last week after getting the full 26 weeks. My job search isn't going well and I'm still unemployed. Can I just file a new claim right away or is there some waiting period? Or am I supposed to "reopen" my existing claim somehow? The website is confusing me because it keeps talking about "filing a new claim" vs "reopening" and I don't understand the difference. Anyone know what I'm supposed to do in this situation?

It depends on your specific situation. If your benefit year has ended (it's been 52 weeks since you initially filed), then you can file a new claim. If you're still within your benefit year but exhausted your 26 weeks, you might not be eligible for a new claim unless you've worked and earned enough wages since filing your original claim.\n\nLog into your NY.gov account and check your benefit year end date. That will tell you if you can file a new claim yet.

Thanks for responding! Where exactly do I find the benefit year end date in my account? I've been clicking around but can't seem to find it anywhere.

I went through this exact nightmare in january!! So the answer is NO you cant file a new claim until ur benefit year is over (which is 12 months from when u first filed). But heres what i learned the hard way - u NEED to call them because the website will let u THINK ur filing a new claim but really ur just wasting ur time and then weeks later ull get a letter saying u got $0!!!!\n\nI ended up using this service called Claimyr (claimyr.com) to get through to an agent because I was going INSANE trying to call myself. They have this system that calls for you and then connects you when it reaches an agent. Saved me like 4 hours of redial hell! Check out their demo video if ur curious: https://youtu.be/Rdqa1gKtxuE

Omg I'm so glad you mentioned this because I was about to try filing online tonight! Is that service expensive? I'm already broke which is why I need the unemployment help...

It's worth every penny when you're desperate to talk to someone! Way cheaper than losing weeks of benefits because of confusion. They only charge if they successfully connect you with an agent. Basically saved my sanity.

To find your benefit year end date: Log into your NY.gov account > My Online Services > Unemployment Services > View Payment History. At the top of that page, you should see your claim information including the Benefit Year Ending (BYE) date.\n\nIf your BYE date hasn't passed yet and you've used all 26 weeks, you unfortunately cannot file a new claim until that date arrives. However, you should check if you might qualify for any extended benefits programs that are currently available in New York.

I found it! My benefit year end date is still 4 months away. Are there any extended benefits right now? I thought those were only during COVID?

the system is RIGGED!!!! they make it confusing ON PURPOSE so people give up trying. i had to call 47 TIMES before i got anyone on the phone last month. and then they told me i had to wait for my benefit year to end even though i worked a temp job after filing!!! MAKES NO SENSE

The system does have limitations that can be frustrating, but there is logic behind it. If you worked a temp job after filing your original claim, you might qualify for a new claim IF you earned enough wages during that employment (usually need to earn at least 10x your weekly benefit rate in covered employment). Did the agent check if your temp job earnings were sufficient to establish a new claim?

went thru this 2 months ago. if ur benefits ran out but ur still in ur benefit year u cant file new claim. gotta wait till benefit year ends. sux but thats how it works

Everyone here is giving you the right information but missing one important point - if you worked at ALL during your benefit year (after you filed your original claim) AND earned enough wages (typically 10x your weekly benefit rate), you MAY be able to file a new claim even before your benefit year ends. This is called a

That's really helpful, thank you! I did work a part-time job for about 2 months during my claim period. I'm going to try to call them tomorrow to see if that qualifies me. If I can't get through I might try that Claimyr service someone mentioned above.

Here's the official information from NYSDOL:\n\n1. If your benefit year has NOT ended (it's been less than 52 weeks since you filed):\n - AND you used all 26 weeks of benefits\n - AND you haven't worked since filing\n → You cannot file a new claim until your benefit year ends\n\n2. If your benefit year has NOT ended:\n - BUT you worked since filing your original claim\n - AND earned at least 10x your weekly benefit rate in covered employment\n → You MAY be eligible for a new claim (must call to verify)\n\n3. If your benefit year HAS ended (it's been more than 52 weeks):\n → You can file a new claim if you meet eligibility requirements\n\nAs others mentioned, the NY unemployment system can be confusing. For case #2, you almost always need to speak with an agent directly.

This is SO helpful, thank you! Based on this, I think I'm in case #2 since I did work for a while during my benefit year. I'm definitely going to call tomorrow. Fingers crossed I can actually get through to someone!

UPDATE: I finally got through to someone! I used that Claimyr service someone mentioned above and it worked great. The agent confirmed that I CAN file a new claim because I earned enough at my part-time job during my benefit year. She helped me file it over the phone. Just wanted to update in case anyone else has the same question in the future. Thanks everyone for your help!

That's great news! Thanks for coming back to update us. It's actually quite rare to qualify for a new claim within the same benefit year, so you're one of the lucky ones. Make sure you keep certifying weekly and continue your job search activities.
