Can I file new NY unemployment claim with 96 effective days still remaining?

I lost my job recently and I'm wondering if it's possible to file for a new unemployment claim in NY. My previous claim still shows 96 effective days remaining in the system. I don't currently have a job and need to start receiving benefits again. Do I reopen my old claim or need to file a completely new one? Anyone dealt with this situation before? The website isn't very clear about it.

u dont file a new claim if u still have days left. u just certify again to reactivate ur old claim. login and hit the certify button.

Really? It's that simple? When I try to certify it asks for employer info from the past week but I haven't worked since my last job ended. What do I put there?

You need to reopen your existing claim, not file a new one. Since you still have 96 effective days remaining on your benefit year, you should be able to resume collecting. Here's what to do: 1. Log into your NY.gov account 2. Select 'Unemployment Services' 3. Choose 'Claim Weekly Benefits' (this reopens your claim) 4. Answer all questions honestly - if you haven't worked, indicate that 5. Continue certifying each week Make sure your benefit year hasn't expired though. Even with days remaining, if your benefit year ended, you would need to file a new claim. Your benefit year is typically 52 weeks from when you first filed.

Thank you! This is really helpful. I'll try reopening it right now. Do you know if there's any waiting period when you reopen a claim? My benefit year should still be active since I first filed about 7 months ago.

What if the system doesn't let you certify??? I tried doing this exact thing last month and the website kept giving me errors!!! Will they backdate the payments if the system isn't working? I'm so worried this is going to happen to me again when I try to reactivate my claim next week. 😰

If you're getting system errors, you need to call NYSDOL directly. Sometimes the online system has glitches that only a representative can fix on their end. Document the errors you're seeing (screenshots help) and note the dates you tried to certify. They can backdate payments if it was a system error preventing you from certifying.

When I had trouble filing last year I used a service called Claimyr that got me through to an agent in about 20 minutes instead of spending all day calling. Their website is claimyr.com and they have a video showing how it works: https://youtu.be/Rdqa1gKtxuE Totally worth it for me because I needed to talk to someone to fix my account after being locked out for too many login attempts.

OMG thank you!! I'm going to try this! Did they actually answer your questions or just tell you to check the website like they always do to me??

They actually fixed my issue. The agent I got was really helpful and unlocked my account right away. Just make sure you have all your info ready when they connect you.

The NYSDOL system is SUCH A MESS right now!!! I've been trying to reactivate my claim for 3 weeks and keep getting kicked out of the system. One agent told me to file a new claim, another said DON'T file a new claim. WHICH IS IT??!! They're literally giving contradicting information and then penalizing US when we follow their advice!!!

That's frustrating, but the correct answer depends on whether your benefit year has expired. If your benefit year is still active AND you have remaining effective days, you reopen/reactivate your existing claim. If your benefit year has expired (even with days remaining), you file a new claim. The confusion usually happens because agents don't always check both pieces of information before advising you.

To clarify some misconceptions I'm seeing in this thread: 1. With 96 effective days remaining, you would REOPEN your claim (not file new) IF your benefit year hasn't expired 2. The benefit year lasts 52 weeks from initial filing, regardless of how many effective days you have left 3. If you try to certify and get an error message saying "no claim established" that means you need to reopen your claim first 4. To reopen: Log in > Click on "Unemployment Services" > Select "File A Claim" > The system will recognize you have an existing claim and walk you through reopening it 5. There is typically a 1-week waiting period when you reopen a claim, but you should still certify for that week If the online system won't let you complete these steps, then yes, you'll need to speak with an agent directly.

Thank you for these detailed steps! I was able to reopen my claim following your instructions. The system did recognize my existing claim just like you said. Really appreciate the clear explanation.

I lost my job back in January and had to go through this whole thing too. I still had like 54 days left on my claim and I just went in and certified like normal and it worked fine. Got my money that week. But my sister had problems doing the same thing so I think it depends on your specific situation idk

One more important thing to note: make sure you're eligible for the remaining benefits. If you worked since your last unemployment period, they'll review if you earned enough to qualify. Also, you need to keep meeting the requirements - actively looking for work and documenting at least 3 work search activities per week. Document everything in case they request it later.

I've been keeping a spreadsheet of all my job applications just in case. Do I need to upload that somewhere or just keep it for my records?

Just keep it for your records. NYSDOL conducts random audits where they may request your work search records. You don't upload them regularly unless specifically asked. But having that spreadsheet ready will save you a lot of stress if you're selected for an audit.

btw make sure u answer NO when it asks if u returned to work. i messed up and hit yes once thinking it meant ever and it completely stopped my payments. took 3 weeks to fix.

Update: I successfully reopened my claim! For anyone with the same question - if you still have effective days left within your benefit year, you don't file a new claim. You just go through the normal certification process and it reactivates automatically. Thanks everyone for your help!

Nice! How long did it take for your payment to show up after reopening?

Congrats on getting it sorted out! Just wanted to add for anyone else reading this - if you're reopening a claim, expect there might be a delay in your first payment while they verify your eligibility again. Mine took about 10 days to process when I reopened last year, but after that first payment it went back to the normal schedule.
