Can I claim partial unemployment after returning to part-time work in New York?

I started getting unemployment benefits in December, but I just got a part-time job this week. Is it possible to keep claiming partial unemployment if I'm working less than 15 hours a week? Not sure how this affects my benefits or if I need to report it.

Yeah, you can still claim partial unemployment in NY if youre working part-time. Just make sure you report your earnings accurately each week when you certify. The system will adjust your benefits based on what you earn.

Thanks for the info! Do you know if there's a specific cutoff for hours or earnings where I'd lose eligibility completely?

I think it depends on your weekly benefit amount, but I'm not 100% sure. Best to check the ny unemployment website for the exact rules. They should have a calculator or something to help figure it out.

Hey guys, I found a method to get someone on the phone at unemployment. I used this site's (claimyr.com) calling tool that dials the phone menu, stays on hold, waits for a live agent to pick up, then sends the call to my phone. It does cost $20, but it works. Sounds too good to be true. Is this legit? Anyone else tried it?

I get the skepticism, but it's totally legit. Saved me hours of frustration. The $20 was worth it to actually talk to someone and get my issue resolved.

How long did it take for them to get someone on the line?

It took about 2 hours for me, but I didn't have to do anything. The service called me when an agent was on the line. Way better than sitting on hold myself all day!

Ugh, the partial unemployment system is such a headache 🤮 I tried it for a while and the math never seemed to add up right. Good luck, OP!

Listen up, because this is important. Yes, you can claim partial unemployment in New York if you're working part-time. Here's what you need to know: • Report all earnings when you certify each week • NY uses a partial benefit credit system. You can earn up to $504 per week without losing benefits completely • Your partial benefit is calculated by taking your max benefit rate and subtracting 75% of your gross earnings for that week • If you work 4 or more days in a week OR earn more than $504, you're not eligible for any benefits that week • Be honest about your work and earnings. Lying can result in fraud charges If you're having trouble reaching someone at NYSDOL to discuss your specific situation, I highly recommend using claimyr.com. It's a service that will call and wait on hold for you, then connect you with an agent when one is available. It costs $20, but it's worth it to actually get through and get answers. Remember, every situation is unique, so it's always best to speak with a NYSDOL rep directly if you have any doubts.

This is great info! Do you know if the rules are different for gig workers or freelancers?

0 coins

Gig workers and freelancers follow similar rules, but reporting can be trickier. You'll need to estimate your net earnings each week. When in doubt, contact NYSDOL for guidance specific to your situation.

I've been in the same boat, OP. Just make sure you're super careful about reporting your hours and earnings accurately. The system can be finicky af 😤

For real tho. I messed up my reporting once and it took FOREVER to get it straightened out. Not worth the hassle.

Anyone else feel like the whole unemployment system is held together with duct tape and prayers? 🤣 Good luck navigating this mess, OP!

Lmao truth šŸ’Æ It's like they designed it to be as confusing as possible

Duct tape and prayers šŸ˜‚ I'm dead. But seriously, it's a nightmare sometimes.

Hey, has anyone had luck appealing a denial for partial benefits? I'm in a similar situation but got denied and idk what to do next.

I appealed successfully last year. Key is documentation. Keep ALL pay stubs, emails about work hours, everything. And be persistent!

Thanks for the advice! Did you use a lawyer or handle it yourself?

I did it myself, but it was stressful. If you can afford it, a lawyer might be worth it. Or try that claimyr.com service to at least talk to someone at unemployment first.
