If you're having trouble getting through to NYS Department of Labor to check on your claim status, I found this service called Claimyr that actually got me connected to an agent when I couldn't get through on my own. The whole system is so backwards! Why should there be a waiting week when people need money immediately after losing their job? And don't get me started on how they side with employers on attendance issues even when people have legitimate reasons for missing work.
Good luck with that... the NYS Department of Labor is notorious for denying quit claims even when people have legitimate reasons. I know someone who quit due to sexual harassment with documented proof and still had to go through appeals. The system is rigged against workers.
Make sure you understand what 'good cause' means legally. It's not just about the work environment being unpleasant - it has to be something that would compel a reasonable person to quit. Document everything chronologically and be prepared to explain why you couldn't resolve the situation through other means like talking to HR or your supervisor's manager.
I did try going to HR twice but they basically told me it was a personality conflict and to work it out. Should I mention that in my claim?
Before considering legal action, make sure you're keeping detailed records of every interaction with NYS Department of Labor. Save all emails, take screenshots of your online account, write down dates and times of phone calls and what was discussed. If they're truly violating due process or their own regulations systematically, this documentation will be crucial. Also check if your state has an unemployment insurance ombudsman or inspector general who handles complaints about the department's operations.
definitely file even if ur not sure!! i got fired for being late too many times and still got unemployment. the employer has to prove it was misconduct and most of them dont bother fighting it unless its something really bad
