If she does get denied, yes she can absolutely appeal. You have 30 days from the determination date to file an appeal with NYS Department of Labor. The appeal goes to an administrative law judge who reviews the case independently. The 'under review' status is completely normal and doesn't mean there's a problem. NYS Department of Labor has to verify your employment history and earnings before they can approve benefits. Manufacturing jobs usually have straightforward verification so yours should process smoothly. Just be patient and keep doing your weekly certifications.

Have you considered talking to a lawyer first? Some employment lawyers will give free consultations and might be able to advise whether your situation would qualify as constructive dismissal, which could strengthen your UI claim with NYS Department of Labor.
