Being too slow at work is definitely performance, not misconduct. NYS Department of Labor distinguishes between the two. Misconduct has to be willful or deliberate - like refusing to follow direct orders or violating company policy on purpose. Poor performance, even if it leads to termination, usually doesn't disqualify you from benefits. Just document everything your supervisor says and does in case you need it for your claim.
ugh the whole unemployment system is such a mess. they make you jump through so many hoops and then half the time the website doesnt even work. good luck dealing with all that bureaucracy if you do get fired

Look I went through something similar with a former employee. You can report suspected fraud online through the NYS Department of Labor website or call their fraud hotline. They take it seriously but the investigation process is confidential. You'll never know what happened with the case unless they ask you for more information as a witness. Just make sure you have actual evidence and not just suspicions.
The job search requirement is important too - you need to make at least 3 job contacts per week and keep a log. NYS Department of Labor can ask for your job search records at any time so make sure you're documenting everything properly.

Unemployment is taxable for both federal and New York state income taxes. The dependent allowance is also taxable income. The only exception was 2020 when the first $10,200 of unemployment was tax-free federally due to the pandemic, but that was a one-time thing.
