When will I receive child support from my ex's tax refund offset in Massachusetts?

I'm trying to figure out the timeline for receiving child support payments from my child's father's tax refund in Massachusetts. His tax refund was intercepted by the IRS for past due child support about 3 weeks ago. Anyone know how long it typically takes for that money to get processed and sent to me? The child support office gave me a vague answer about "processing time" but nothing specific. Has anyone else gone through this process recently?

When tax refunds are offset for child support, there's a specific process that happens. First, the IRS takes the refund from the non-custodial parent. Then they send it to the state child support agency (DOR in Massachusetts). The state agency processes it and applies it to the case before sending it to you. In Massachusetts, this typically takes 4-8 weeks after the offset occurs. Some factors that can affect timing: - If he filed jointly with a current spouse, there might be an "injured spouse claim" that delays things - The state has to verify the debt is still valid - They process thousands of these offsets during tax season You should be able to call the MA DOR Child Support Division at 800-332-2733 to get a more specific update on your case. Ask them specifically about the "tax intercept payment status" for your case.

thank you so much! this is super helpful. I'll definitely give them a call and use those exact words. nobody at the office told me it could take up to 8 weeks 😩

I went through this last year and it took exactly 6 weeks for the money to hit my account after the refund was taken. felt like forever tbh

Just want to add - if he files an injured spouse claim it can add MONTHS to the process. My ex did this and it took almost 5 months to get resolved.

I was in the same situation trying to track my ex's offset. The state websites were useless and the phone agents kept giving me different answers. I finally used taxr.ai to understand exactly what was happening with the offset and the timeline. It showed me the exact codes on his transcript that meant the money was sent to MA DOR and when I could expect it. Made the whole process way less stressful since I could see exactly what was happening instead of waiting in the dark. https://taxr.ai

Sounds interesting. How exactly does it work? Does it just read your transcript or does it do more?

It's amazing! It basically reads all the IRS codes and explains everything in plain english. It showed me exactly which code meant the offset was processed, which code showed when it went to the state, and gave me a timeline based on MA processing times. Saved me like 6 hours of research and worry. Best tool I've found for dealing with any IRS stuff!

I get the skepticism but honestly this is nothing like those scammy tax tools. It actually delivers what it promises. I was literally about to have a breakdown trying to understand all the tax jargon and this just made everything crystal clear. Worth every penny considering I was about to pay a tax pro $200+ for the same info!

After weeks of getting nowhere with the MA child support office, I used a service called Claimyr (claimyr.com) to actually get a real person on the phone at the IRS. Got through in like 20 minutes when I'd been trying for days on my own. The agent confirmed the exact date the funds were sent to Massachusetts and I was able to use that info to push my caseworker to process it faster. Honestly it was the breakthrough I needed to get answers about my offset payment.

wait is this for real? i've been calling the irs for DAYS and keep getting disconnected

100% real. It basically holds your place in line and calls you when an agent is about to pick up. Talking to the actual IRS gave me the proof I needed to show my caseworker that the money was already sent to the state. Worth it to finally get straight answers instead of the runaround from everyone.

does this actually work tho? seems sketchy that we have to pay just to talk to our own government 🤦‍♀️

I had the same thought at first! But after trying for 2 weeks to get through on my own and getting nowhere, it was the best money I've spent this year. The IRS agent gave me info that my caseworker couldn't (or wouldn't) provide, which helped me track down my money faster.

Just to add - I used Claimyr for a different tax issue last month and it worked exactly as advertised. Got through to an agent in about 30 mins vs the 3+ hours I spent trying on my own before giving up.

I'm in MA too and went through this last year. It took exactly 40 days from when his refund was taken until I got the payment. The child support enforcement office is usually pretty backed up during tax season because they're processing so many of these offsets. If you have a MyDOR account online you can sometimes see when it's been received by the state even before they notify you.

Nobody ever tells you this, but there's actually a difference in timing depending on whether it was a STATE tax refund offset or FEDERAL tax refund offset. Federal typically takes longer because it has to go from IRS → US Treasury → State DOR → You. If it's a state refund offset it's faster because it skips those first steps. Do you know which one it was?

It was his federal refund that got taken. I had no idea there was a difference in the process! That explains why the timeline seems so long compared to what my friend experienced last year (probably was state refund for her).

Yep that's exactly it! For federal refund offsets I've seen it take 6-10 weeks in MA. State refunds are usually more like 3-4 weeks. The system is incredibly inefficient 🤦‍♂️

This process is so frustratingly slow! My ex owed over $15k in back support and when they finally took his tax refund it sat in limbo for almost 2 months. The MA DOR website kept showing "processing" forever. I finally got it but only after calling repeatedly. The squeaky wheel gets the grease with these government agencies.

This is the truth! I called every single week and I swear they processed mine faster just to get me to stop calling lol 😂

ughhh this is what I was afraid of. Did you just call the main child support number or is there a specific department that handles the tax intercepts?

I called the main DOR child support line but kept asking to speak to someone who specifically handles tax offsets. Don't let them give you the generic "it's processing" answer - ask for specific dates and next steps. If they say they don't know, ask to speak with a supervisor.

Quick tip: the delays are often worse if it was an amended return or if he filed late. Those tend to take longer to process even before the offset happens. Also tax season (feb-april) has wayyyy longer waits than offsets that happen later in the year.

Is there a way to track it? My caseworker literally told me "just wait for the check" which was zero help. I need to budget and plan!

You can check the MA DOR Child Support portal if you have an account set up. Sometimes it will show pending payments before they're sent to you. But honestly in my experience the portal isn't updated very frequently.

I used taxr.ai to see exactly when my ex's refund was taken and when it was sent to my state. Gave me way more visibility than the state website did. https://taxr.ai

pro-tip: if you recieve any government benefits like SNAP or TANF, some or all of the tax refund might go to the state first to reimburse them for benefits they gave you when the other parent wasn't paying support. just something to be aware of.

Oh good to know! I'm not on benefits now but I did receive them briefly last year. I'll ask about this when I call.

Anyone dealing with this needs to be aware that sometimes the non-custodial parent will file an "injured spouse" claim if they filed jointly with a new spouse. This can delay the process by MONTHS or even result in the money being returned to them. Hopefully this isn't your situation but just a heads up that it can happen.

From what I know, he filed single. So at least I don't have to worry about that!

I work for a tax firm (not in MA though) and we see this a lot. The general timeline is: - IRS takes the refund: Day 0 - IRS sends to federal offset program: 1-2 weeks - Federal offset program sends to state: 1-2 weeks - State processes and sends to custodial parent: 2-4 weeks So total time is typically 4-8 weeks, but can be longer during peak tax season which we're in right now.

This is super helpful, thanks! Do you know if direct deposit is faster than waiting for a check?

Yes, direct deposit is definitely faster! If you haven't set up direct deposit for child support payments, do that ASAP. Can save 5-7 days of waiting for a paper check.

I have direct deposit set up already so that's good news at least!

Have you called the Treasury Offset Program directly? Sometimes they have more info than the state does. Their number is 800-304-3107. You'll need your ex's SSN and your case number.
