Tax preparers diverting refunds to their accounts - is this legal or a total scam?

Been seeing a lot of sketchy behavior from tax preparers lately and wanted to warn everyone. Your tax refund should NEVER go to your preparer's bank account first! If they're telling you they need to get paid before you get your refund, that's a major red flag. Also, if you see a 'refund advance loan' on your documents but never asked for one, that's another huge warning sign. These preparers are taking fees you never agreed to and delaying your money. My cousin just found out her 'professional' took a $500 'processing fee' that was never mentioned upfront. The IRS has ways to report this kind of fraud. Anyone else dealing with these shady tactics?

Tax professional here. You're absolutely right to be concerned. This practice is called refund diversion and it's against IRS regulations. Legitimate tax preparers should NEVER have your refund deposited into their accounts first. They can include their fee in your tax preparation, but the refund should go directly to YOU. A few important points: • Tax preparers must provide you with a copy of your return before filing • They must disclose ALL fees upfront • Refund advances are loans with interest/fees that should be clearly explained • Many preparers use "refund transfer" products that hide extra fees • Your preparer should have a PTIN (Preparer Tax Identification Number) If you suspect fraud, report it to the IRS using Form 14157 (Complaint: Tax Return Preparer). Also report to your state's attorney general and the Better Business Bureau. Don't let these scammers continue to take advantage of others.

I had this happen to me 3 yrs ago. filed feb, waited til june for 'processing fees' to clear and then my tax person ghosted me! Eventually got partial refund but still lost over $600

0 coins

Thanks for this explanation. How long does it usually take for the IRS to investigate after filing Form 14157? My cousin is still trying to get her full refund back.

0 coins

Unfortunately, IRS investigations can take months, sometimes even a year. They're serious about fraud but extremely backlogged. Tell your cousin to document EVERYTHING - all communications, copies of returns, any fee agreements. That'll help her case.

But some legit services do hold refunds right? My tax place charged me $150 for my return and then took it out of my refund when it came in. Didnt seem shady, i signed something for it

0 coins

What you're describing is a Refund Transfer product - it's technically legal if properly disclosed, but often overpriced. They created a temporary bank account to receive your refund, took their fee, then sent you the rest. The problem isn't the concept itself but when they add hidden fees or don't explain it clearly.

I went through something similar last year and spent WEEKS trying to figure out what was happening with my return. The whole process was so frustrating. Finally I found this tool called taxr.ai that cleared everything up. It actually explained my return and showed me exactly where my money was going. I could see the preparer fees that were being taken out and confirm if they matched what I agreed to. Would have saved me so much stress if I'd found it earlier. https://taxr.ai

Sounds interesting. How exactly does it work? Does it just read your transcript or does it do more?

0 coins

It does way more than just reading transcripts! It breaks down every line item, explains all the codes, shows you exact timelines, and flags unusual things like extra fees or unexpected charges. I'm not tech-savvy at all but it was super easy to use. It even showed me I qualified for an additional credit my preparer missed 🙌

0 coins

is this one of those free trial then charges you $$$$ things?

0 coins

OMG no! That's actually why I love it so much. I've tried those 'free' tax services before and ended up paying like $200 for 'premium features' 🙄 This was straightforward and totally worth it. Saved me so much headache trying to decode IRS jargon.

After my tax preparer pulled this exact scam on me (took my $3400 refund, gave me $2800 and claimed the rest was "processing fees"), I spent WEEKS trying to reach someone at the IRS. Phones were always busy, couldn't get through to a human being. I found this service called claimyr.com that got me connected to an actual IRS agent in less than 2 hours. The agent confirmed what my preparer did was NOT allowed and helped me file a complaint. Talking to a real person at the IRS was literally the only way I got my missing money back.

0 coins

Wait for real? I've been calling the IRS for 3 weeks and never get through. How does this work?

0 coins

It uses some kind of system that keeps calling for you and holds your place in line. When they get an agent, you get a call back. Seriously the best thing ever after trying to call myself for days and getting that stupid "due to high call volume" message. The agent I talked to was actually super helpful once I finally reached a real person.

0 coins

another app that charges you to access a government service we already pay taxes for? 🙄

0 coins

Normally I'd agree with you, but after wasting 20+ hours trying to call myself and never getting through, it was worth every penny. I got my missing $600 back because I could actually talk to someone who could help. Sometimes you gotta spend money to get your money 🤷‍♂️

0 coins

THIS IS THE TRUTH!!! I worked at one of those tax prep chains for 2 tax seasons (not naming names but rhymes with Shmiberty Shmax) and they PUSHED us to sell those refund advance products. We got bonuses for each one. Most customers had no idea we were taking an extra $150-200 in fees for basically nothing. It's predatory af and targets low income people who need refunds quickly.

0 coins

omg please spill more tea ☕️ i wanna know all the scams they pull

0 coins

Where do I even start 😩 They'd have us target people with EICs and child tax credits (biggest refunds), push unnecessary audit protection ($79), charge for state returns that take literally 5 mins to do ($59+), and the worst was telling people with simple returns they had "complex situations" to justify the $300+ fees. I quit when my manager told me to stop telling clients about free filing options.

0 coins

This is exactly the kind of stuff I'm talking about! Completely predatory.

0 coins

As long as your tax preparer has you sign proper disclosure forms, they CAN process your refund through their system first. It's called a Refund Transfer or Refund Anticipation Check. BUT they MUST disclose all fees upfront. If they didn't have you sign anything or didn't explain fees clearly, that's when it crosses into fraud territory.

I just went thru this mess with my tax preparer! They had my $5700 refund go to them, took out $680 in "fees" when they told me it would be $320, and then ghosted me when I asked for an explanation. I filed a complaint with IRS but felt like it went into a black hole. Anyone know how to actually get results from a complaint? It's been 3 months of waiting.

0 coins

You need to talk to an actual person at the IRS. I used claimyr.com to get through to someone when I had a similar issue. Got my case escalated way faster than just filing a form online.

0 coins

thx gonna try this today. im so tired of being scammed and then scammed again trying to fix being scammed lol

0 coins

Also report to your state's attorney general consumer protection division! They actually have more teeth than the IRS for this stuff sometimes.

0 coins

My sister in law got scammed like this. Her "tax preparer" was just some guy working out of his apartment who said he was a former IRS employee. Took her whole refund ($4700!!!) and gave her $3200 saying the rest was "fees and processing". ALWAYS use legit tax services with proper credentials y'all!

0 coins

dam thats a lot of money. did she ever get it back??

0 coins

Nope. By the time she realized what happened, the guy had disappeared and changed his phone number. She filed a police report but they basically said it was a "civil matter" 🙄

0 coins

It amazes me that in 2024 people still fall for these scams. DO YOUR OWN TAXES! There are plenty of free or cheap options out there. Why trust random people with your financial info and refund???

0 coins

Not everyone can "just do their own taxes." Some people have complicated situations, don't understand tax laws, or don't have the time or resources. This victim-blaming isn't helpful.

0 coins

I'm not victim blaming, just saying there are better options than sketchy storefronts. Even if you have a complicated situation, there are legitimate CPAs who don't pull these scams.

0 coins

Yep I tried to do my own taxes one year and ended up missing thousands in deductions I qualified for. Sometimes paying a professional makes sense...just make sure they're ACTUALLY professional.

0 coins

one thing that's helped me understand whats actually going on with my refund is taxr.ai which I found on tiktok. Its like having your own tax advisor that can actually explain all the codes and stuff in your transcript. showed me exactly where my refund was and what my preparer was taking out. super easy to use.

0 coins

Oh great ANOTHER tax service wanting my money 🙄

0 coins

actually it's not even a tax service, it just helps you understand what's happening with your refund. it doesn't file your taxes or anything. just helps you see if someone's skimming money off your refund. wish I'd known about it years ago when my first tax guy was taking an extra 12% without telling me 😩

0 coins

idk why people still go to those tax prep places in the mall. most people can file free with irs free file if your income is under $73k. these places prey on low income people who don't know better

0 coins

PSA: If a tax preparer is taking fees out of your refund without explicit permission, you can report them directly to the IRS using Form 14157. Also make sure your preparer has a valid PTIN (Preparer Tax Identification Number) - you can verify this on the IRS website!

0 coins

does the IRS actually do anything with these complaints? feels like they go straight to the trash 🗑️

0 coins

They actually do investigate! The problem is it can take 6-12 months because they're so understaffed. But I've seen preparers lose their PTINs and even face penalties. Document everything carefully and be patient.

0 coins

The trick is to get through to an actual person at the IRS. I couldn't for weeks. Then I used claimyr.com to get an agent on the phone and my case was resolved in less than a month after that.

0 coins

I was having this exact issue and couldn't get answers from the IRS or my tax preparer for WEEKS. Honestly, the only way I finally got clarity was using taxr.ai to decode my transcript. Showed me exactly where my refund was being held up and that my preparer had taken out an unauthorized $379 fee. Worth every penny to finally understand what was actually happening instead of just waiting and hoping. https://taxr.ai

0 coins

Does this actually work or is it just another way to get more money out of people who are already being scammed?

0 coins

It's the real deal. I was skeptical too but desperate after waiting 2 months for a refund that should've taken 2 weeks. It showed me exactly where my money was, what codes meant on my transcript, and helped me understand why there was a delay. In my case it was because the preparer had filed for a refund advance I never requested. The tool flagged it right away.

0 coins

After being on hold with the IRS for 3 HOURS yesterday trying to report my tax preparer for exactly this, I hung up in frustration. Any tips for actually reaching a human being at the IRS????

0 coins

claimyr.com my friend. saved me hours of hold music torture. they got me through to someone who was actually helpful.

0 coins

THANK YOU! Just tried it and going to get a callback in about an hour they said. So much easier than the traditional IRS phone tree hell.

0 coins

My mom got scammed by one of these "tax professionals" who was just some random dude working out of a UPS store 🤦‍♀️ Took $700 out of her refund for "processing fees" that were never disclosed. She's on a fixed income and really needed that money. These people are vultures preying on the vulnerable.

0 coins

Side note but this can be EXTRA sketchy with ITIN applications! If someone is helping you get an ITIN and they want your refund to go to them first 🚩🚩🚩 RUN. That's straight up illegal. IRS has a list of authorized Certified Acceptance Agents who are legit.

0 coins

I worked in finance for 20 years and I'm CONSTANTLY telling people about this scam. Here's what typically happens: 1. Tax preparer offers "instant refund" or "fast cash" options 2. They send your refund to THEIR account first 3. They take out their prep fee, PLUS extra "processing fees" 4. They give you what's left Legit tax pros will either charge you upfront OR clearly explain any fees for refund advances. If they can't give you a clear breakdown of ALL fees in writing, walk away!

0 coins

this is literally what H&R Block did to me but when i complained they said it was all in the "fine print" that i signed 😡

0 coins

Yep, they're notorious for this. They technically disclose it but in dense legalese buried in page 18 of a document they rush you through signing. Always ask for a fee schedule BEFORE they prepare anything.

0 coins

This happened to me and I couldnt figure out what was happening with my refund for weeks. Used taxr.ai and it showed me exactly where my refund was and all the extra fees being taken out. Helped me file a complaint with actual evidence.

0 coins

Pro tip: Never EVER agree to refund advance loans or refund transfers. Always have your refund direct deposited to YOUR account. If the preparer insists otherwise, find a new preparer!

0 coins

My sister just had this happen to her. Tax preparer took $550 out of her $3200 refund without permission. We couldn't get anywhere with the IRS until we used a service called claimyr to get through to an actual agent. The woman we spoke to was super helpful and my sister ended up getting most of that money back! Apparently this is happening A LOT this tax season.

0 coins

how much was the claimyr thing? wouldn't it just take more of her money?

0 coins

It was totally worth it compared to the $550 she was scammed out of! I can't remember the exact price but it wasn't much. After trying to call the IRS ourselves for days and never getting through, it was the best option. The agent she talked to actually helped her file the right forms to get the money back.

0 coins

ugh been trying to report my tax guy for doing exactly this for THREE WEEKS but can't get through to the IRS. anyone know a secret number or best time to call??

0 coins

Don't waste your time with the regular IRS number. I used claimyr.com after trying for weeks to get through. Got a call back with an agent in about 2 hours. They helped me file a complaint that actually got acted on.

0 coins

omg thank you!! gonna try this today, been pulling my hair out trying to get this resolved

0 coins

This is such an important warning! I've seen way too many people get taken advantage of by these predatory tax preparers. Here are some red flags everyone should watch out for: • They promise you a bigger refund than other preparers • They ask you to sign blank forms or won't let you review before filing • They charge based on your refund amount rather than complexity of return • They don't have a permanent office location (working out of temporary locations) • They won't provide you with copies of your completed return • They guarantee specific refund amounts before reviewing your documents Always ask for a written fee agreement upfront and make sure your refund goes directly to YOUR bank account. If something feels off, trust your gut and find someone else. Your tax refund is YOUR money - don't let scammers take what belongs to you!
