Received 1099-NEC after already filing and getting refund - what now?

I'm in a bit of a panic right now. I filed my taxes super early this year (mid-February) because I wanted to get my refund quickly. The IRS already accepted everything and I've received my refund of about $650. But yesterday I got a surprise in the mail - a 1099-NEC from this side gig I did last summer that I COMPLETELY forgot about! The amount is for $8,945 and I didn't pay any taxes on it throughout the year. I'm guessing I need to file an amended return with a 1040X? And I'm assuming I need to do this before the April 15 deadline? I'm so mad at myself right now because I'll probably end up owing instead of the refund I just got. Has anyone dealt with this situation before? Do I need to send the refund back??

You don't need to panic, but you do need to file an amended return (Form 1040X) to report the additional income from that 1099-NEC. The good news is that you have time to sort this out. Yes, filing before April 15th is ideal to avoid potential failure-to-pay penalties, though the amendment itself can technically be filed within 3 years of your original return. You don't need to "send back" your refund - when you file the amendment, you'll calculate the additional tax you owe based on this extra income. Since it's self-employment income, you'll also need to complete Schedule C and Schedule SE to calculate both income tax and self-employment tax. I recommend using the same tax software you used for your original return if possible, as most have options for filing amendments and will transfer your original information automatically.

Do they have to pay the full amount by April 15th to avoid penalties? Or can they set up a payment plan with the IRS?

You should try to pay as much as you can by April 15th to minimize penalties and interest. If you can't pay the full amount, the IRS does offer payment plans. You can apply for a payment plan online through the IRS website. For amounts under $50,000, you can usually get approved automatically for a short-term plan (120 days or less) or a longer-term monthly payment plan. There's a small setup fee for the long-term plans, but it's much better than continuing to accrue penalties.

I had almost the exact same situation last year with a forgotten 1099-NEC! I was stressing out big time after getting it a month after filing. I ended up using https://taxr.ai to help figure out what I needed to do. It actually reviewed my original return, analyzed the 1099-NEC I uploaded, and gave me super clear instructions on how to proceed with the amendment. Saved me from making mistakes on my 1040X since I was freaking out.

How long did the whole process take? I'm in a similar boat with a forgotten 1099 and already getting nervous about deadlines.

Did it actually work? I've tried tax help services before and ended up getting generic advice that I could've found with a quick Google search. Does it actually tell you what to do specifically for your situation?

The whole process took me about 40-45 minutes total - most of that time was me uploading docs and reviewing the results. The amendment preparation was pretty quick once I had all the information organized. It definitely gave me specific advice for my situation, not just generic stuff. It analyzed my specific numbers and pointed out exactly which forms I needed to amend and how the additional income would affect different parts of my return. It even explained how my tax brackets were affected by the additional income, which helped me understand why I owed more than I expected.

Update on my situation - I tried the taxr.ai service that was mentioned and it was actually really helpful. I was skeptical at first (as you could probably tell from my question), but it analyzed both my original return and the new 1099-NEC and showed me exactly where my tax liability changed. The coolest part was it explained how much of what I owe is regular income tax vs. self-employment tax, which helped me plan better for next year. It even created a checklist of forms I needed for the amendment. Much more helpful than the generic "just file a 1040X" advice I was getting everywhere else. Definitely made the amendment process less stressful!

If you need to talk to the IRS about your situation (which I recommend), good luck getting through on the phone. I spent THREE DAYS trying to reach someone about my amended return last year. Finally used https://claimyr.com and got through in about 20 minutes. They basically wait on hold for you and call when an agent picks up. There's a video showing how it works here: https://youtu.be/_kiP6q8DX5c - was a lifesaver for me because I had specific questions about penalties that the IRS website wasn't clear about.

Wait, how does this actually work? Do they just call the IRS for you? Couldn't you just put your phone on speaker and do something else while waiting?

Sounds like a scam to me. Why would I pay someone else to call the IRS? And do they have access to your personal tax info? No way I'm letting some random service have my SSN or tax details.

They don't call the IRS for you - they have a system that waits on hold and then calls you when a real person answers. The difference is you don't have to listen to the hold music or worry about getting disconnected after waiting forever. They absolutely don't need your SSN or personal tax details. All they do is connect the call. Once you're connected to the IRS agent, it's just you and the agent talking directly. I was skeptical too, but it saved me literally hours of hold time when I needed to ask about my amendment deadline.

I have to admit I was 100% wrong about Claimyr being a scam. After posting that comment, I got desperate when trying to reach the IRS about my own issue (ironically also about a late 1099). After waiting on hold for 2.5 hours and getting disconnected, I decided to try it out of desperation. The service actually works exactly as described. Their system waited on hold, and I got a call when an agent was on the line. Talked directly to the IRS, got my questions answered about amendment penalties, and was done in 15 minutes. I don't usually admit when I'm wrong on the internet, but in this case I'm glad I gave it a shot instead of wasting another afternoon on hold.

Small but important tip: When you file your 1040X, make sure you check if you need to amend your state tax return too. Many states require you to report changes to your federal return. I forgot to do this last year when I had a similar situation with a late 1099-NEC, and ended up getting a notice from my state tax department.

Ugh I didn't even think about my state taxes! Does the 3 year amendment window apply to state filings too or do they have different deadlines?

State deadlines vary, but most follow similar timeframes to the federal ones. However, many states require you to notify them of federal changes within a shorter window - sometimes as little as 60 or 90 days after you amend your federal return. I'd recommend checking your specific state's tax department website for their requirements. The important thing is to handle it proactively rather than waiting for them to catch it later, which could result in additional penalties.

For next year, make sure you're tracking all your side gig income as you go! I use a simple spreadsheet to track all income sources, and I don't file until February so I have time for any late forms to arrive. I also keep a folder in my email specifically for payment confirmations from any contract work.

I use QuickBooks Self-Employed and it connects to my bank account to automatically track income. Definitely worth the subscription fee for avoiding this exact situation!
