MFJ First Time - Will IRS take refund for spouse's 2016-2017 back taxes?

Filed married jointly for first time with 2 dependents. My spouse has back taxes from 2016 and 2017. Anyone know if the IRS will take our entire refund? Really need this money and not sure how this offset thing works.

Tax pro here - Yes, the IRS can and likely will offset your joint refund for your spouse's prior tax debt. You might be able to file Form 8379 (Injured Spouse) to claim your portion of the refund. The form basically tells IRS not to take your share of the refund for your spouse's separate debt.

It can take 11-14 weeks from the time they receive it. Sometimes longer if they're backed up 🙄
