Amended return stuck for 7+ months after removing fraudulent fuel credit - $8,365 balance frozen since February

My brother filed his 2023 taxes and just found out his tax preparer fraudulently added a fuel credit to his return. He filed an amended return back in August to fix this mistake, but everything seems frozen since then. I've got his transcript from this year and I'm trying to figure out what's happening with his refund. Then there's this large credit of -$12,520.00 to his account, which I'm guessing includes the fraudulent fuel credit. His amended return shows as filed and forwarded for processing on 07-23-2024, but there's been no movement since then. It's now been over 7 months since the amended return was filed and everything still appears frozen. The account balance shows -$9,455.00 which means the IRS thinks they owe him money, but he knows that's not correct because of the fraudulent credit. Why would there be a refund freeze BEFORE he even filed? And why is there no additional activity after the amended return was processed? Is this typical for fraud cases? What should he expect next? Something looks fishy with those dates. How was there a refund freeze on 02-08-2024 but the return wasn't filed until May? And why would a fraudulent fuel credit even be attempted on a normal W-2 worker? Those are typically for businesses with specific fuel usage.

I noticed that too! I think maybe he filed in January/February but it wasn't fully processed until May? As for the credit, the tax preparer apparently did this to multiple clients to inflate refunds and get higher fees. My brother didn't even notice until he got a letter from the IRS questioning it.

The reason why this is taking so long is cuz the IRS thinks your brother committed fraud, not his tax preparer. The freeze code (810) indicates investigation. Since this is a potentially fraudulent fuel credit claim, expect a looooong wait. The IRS is buried in these cases rn.

I'm suprised no one said this yet, but your brother needs to be prepared to PAY BACK the portion of the refund he already received that was fraudulent. The IRS will eventually want that money back with interest. He should start setting aside funds now if possible.

The IRS system probably detected the issue during pre-processing. When returns are e-filed, they go through initial validation before formal acceptance. The 150 code date is when the return completed full processing, not when it was initially received.

Definitely get thru to a human ASAP!!! I had a similar issue that took 14 months to resolve because I just waited for letters. Yes! The key is getting connected to the right department. When you get through, immediately ask to be transferred to the amended return department. The first agent might say they can't help, but insist on the transfer. That's what worked for me.

Good luck getting through to TAS right now. They're so backed up they're rejecting cases unless you can prove severe financial hardship. I tried for 2 months and couldn't even get past their phone system.
