Any updates on the DeSantis lawsuit over enhanced unemployment benefits? Court date today?

I've been following the lawsuit against Governor DeSantis over Florida opting out of the enhanced unemployment benefits early. Thought the court hearing was supposed to start today? Has anyone heard any updates? I'm still waiting on my regular DEO benefits to process (week 4 of pending), but curious if we might get those federal benefits reinstated if the lawsuit succeeds. Anyone know what's happening with this? Haven't seen any news updates today.

You might be confused about the timeline. There's no hearing scheduled today that I know of. The lawsuit about enhanced benefits was filed back in 2021 and Florida already lost that fight - DeSantis ended those federal programs early and they never came back. The courts ruled states had the right to opt out. Are you referring to some new lawsuit I haven't heard about?

Wait really?? My neighbor told me there was some new class action happening now in 2025. She said something about retroactive payments for people who got cut off. Maybe I misunderstood her completely. So there's nothing happening with enhanced benefits now?

There isn't any current lawsuit about enhanced benefits that's active today. Those programs (PUA, PEUC, FPUC) all ended nationally in September 2021. Several states like Florida opted out even earlier. There was litigation about it back then, but those cases were resolved years ago. If you're 4 weeks into waiting for regular benefits, that's a separate issue. Your claim is probably stuck in adjudication. Have you checked your CONNECT account to see if there are any "pending issues" listed? Or if they're requesting any additional fact-finding information from you?

Thanks for clarifying. I feel dumb now lol. Yeah I do have a pending issue - something about "employment status" and "ability to work" flags in CONNECT. I uploaded the requested docs 3 weeks ago but nothing's happened since.

OMG the DEO system is THE WORST!!! I waited 6 WEEKS with those exact same flags and finally got my determination letter yesterday. They never tell you how long the adjudication will take. It's like they want us to give up and stop claiming!! 😡

6 weeks?? I can't wait that long, I've got bills piling up. Did calling them help at all or do they just tell you to keep waiting?

I managed to get through to a DEO agent last week about my adjudication delay by using Claimyr (claimyr.com). They got me connected to a real person in like 30 minutes instead of me trying to call directly and getting disconnected constantly. They have a video showing how it works at https://youtu.be/UzW_hbUy-ss?si=zORd51jeq1GX5Ldj The agent told me adjudication is taking 4-7 weeks right now because they're short-staffed. She was able to look at my uploaded documents though and confirm they were received properly, which gave me some peace of mind at least.

Thanks, I might try that service. Did the agent actually move your claim forward at all or just confirm they received your docs?

The agent flagged my account for expedited review after I explained my financial hardship situation. My payments were approved 4 days later. Definitely worth calling - sometimes they need to manually check something that the system isn't processing correctly.

Claimyr is just another way to WASTE MONEY!! I paid them and still couldn't get anyone helpful. The DEO rep just read the same info I could see on my CONNECT account. Complete waste when we're already broke from waiting on benefits!!

To clarify about lawsuits - there was one major lawsuit against Florida DEO that settled in November 2024, but it wasn't about enhanced benefits. It was related to identity verification problems and improper claim denials. The settlement required DEO to review thousands of claims that were wrongly denied due to ID.me verification issues between 2021-2024. If you had a claim denied during that period specifically because of ID verification problems, you might be eligible for that settlement review. But it has nothing to do with the enhanced federal benefits that ended years ago. For your current regular claim that's pending adjudication, I'd recommend calling DEO directly. When they're reviewing your "ability to work" issue, sometimes there's a specific question they need answered that isn't clear from the documents you uploaded.

Thank you for explaining! That settlement must be what my neighbor was talking about, but she got the details wrong. I did have a previous claim denied in 2023 over ID.me issues - do you know how I would check if I'm included in that settlement review?

If your 2023 claim was denied specifically because of ID.me verification problems, you should have received a notification letter in December 2024 or January 2025. The letters went out to everyone potentially affected by the settlement. If you didn't get one but think you should qualify, you can email DEO.SettlementQuestions@deo.myflorida.com with your claimant ID, last four of SSN, and brief explanation of why you believe you're part of the settlement class. But focus on your current claim first - that's your most immediate path to benefits. Call about the adjudication delay and specifically ask if there's anything else they need from you to resolve the pending issues.

Will do, thanks so much for the detailed info! I'll try calling tomorrow and check my email for any settlement notices.

i had my claim stuck in adjudication for 5 weeks with those same flags. turns out they needed additional proof that i was let go and not fired for cause. had to get a letter from my former boss. call them and ask specifically what theyre waiting for, dont just wait!!

This is excellent advice. 'Ability to work' and 'employment status' flags often require additional documentation beyond what the system initially asks for. Sometimes it's a doctor's note, employer verification, or additional details about your job separation. The system rarely tells you exactly what's missing.

I'm in a similar situation - been waiting 3 weeks on adjudication with "employment status" flags. Reading through these comments has been really helpful, especially learning about the 2024 ID.me settlement (which explains what my coworker was probably talking about). For anyone else dealing with adjudication delays, it sounds like the key takeaway is to call and ask specifically what additional documentation they need rather than just waiting. The system clearly doesn't communicate well about what's actually holding up our claims. @Diego, definitely try calling tomorrow like others suggested. Even if you use a service like Claimyr or call directly, the important thing is getting a human to look at your specific case and tell you exactly what they're waiting for.

Same here! I've been lurking in this community for a while but finally created an account because I'm dealing with the exact same issue - 4 weeks waiting on adjudication with "employment status" and "ability to work" flags. Reading through everyone's experiences has been more helpful than anything I've found on the DEO website. It's frustrating that we all seem to be stuck in the same black hole with no clear communication about what they actually need from us. Definitely going to try calling tomorrow and asking for specifics like everyone suggested. Thanks for all the helpful advice in this thread!
