Why is my California EDD unemployment claim under fact finding?
So I logged into UI Online this morning to check my weekly claim status and noticed it says my unemployment is under fact finding. Nobody told me this was happening, no letter, no email, nothing. I just randomly noticed it when I went to certify. I've been getting payments for about 6 weeks without any issues and then out of nowhere this pops up. I work in restaurant management and got laid off when the location closed down. My separation was completely straightforward - the whole place shut down. I don't understand why California EDD would suddenly need to do fact finding on my claim. Does this mean my payments are going to stop? Is this the same as adjudication? I'm really confused about what fact finding even means and what happens next. Has anyone else had their claim go into fact finding without any warning?

fact finding basically means EDD has a question about something on your claim and they want to gather more info before making a decision. it's different from being fully adjudicated but they're related. usually happens when your employer contests the claim or when EDD notices something that doesn't add up with what you reported. your payments might be on hold while this is happening depending on what triggered it

AuthorMy employer definitely knew I was laid off, the whole restaurant closed. Why would they contest it? That doesn't make sense to me.

employers contest ALL THE TIME even legit layoffs because it can affect their UI tax rates. its super common dont panic yet

I went through fact finding last year with my California EDD claim and here's what I learned the hard way. Check your UI Online account under the 'Claim Summary' section - there should be more detail about what specifically triggered the fact finding. Also check your myEDD inbox because sometimes the notice ends up there even when you don't get a physical letter. The fact finding process means EDD is reaching out to both you and your former employer to verify the circumstances of your separation. In a clear-cut layoff like a business closure, it usually resolves in your favor but it can take anywhere from 2 to 6 weeks depending on how backed up they are.

AuthorI checked my myEDD inbox and there's nothing there either. Just the status on the claim summary page showing fact finding. This is so frustrating.

Same exact situation happened to me when my company downsized. Ended up being fine but the waiting was brutal. Make sure you keep certifying every week even while it's in fact finding status or you'll lose those weeks of benefits if it resolves in your favor.

Yes this is really important - DO NOT stop certifying your weekly claims just because of the fact finding status. A lot of people make this mistake and then when the issue gets resolved they've lost weeks of potential payments.

honestly the fact that EDD does this with zero communication is infuriating. you're just supposed to randomly notice your claim changed status? i was in fact finding for SEVEN WEEKS last spring and couldn't get anyone on the phone to tell me what was happening. called every single day. got the busy signal hang up routine constantly. the whole system is designed to make you give up

7 weeks is way too long for fact finding. Did it ever get resolved or did you have to file an appeal?

it eventually resolved on its own but i never got a clear explanation. just suddenly got a payment one day. the lack of communication from EDD is honestly criminal

When my claim went into fact finding a while back I was in the same boat trying to figure out how to actually reach someone at EDD to find out what was going on. I stumbled across a service called Claimyr that basically gets you connected to a live EDD agent without having to sit on hold for hours or keep redialing. I was really skeptical at first but it actually worked and the agent I spoke with was able to tell me exactly what triggered my fact finding and what documentation I needed to submit. Their website is claimyr.com and there's a video showing how it works at https://youtu.be/JmuwXR7HA10 - honestly saved me so much stress during an already terrible situation

AuthorI've never heard of this. Does it actually work? I'm desperate to talk to someone at EDD at this point.

I've heard of Claimyr too, a friend used it when her weekly claims got messed up. Said it was the only way she could actually get a human on the phone

To answer your question about whether fact finding is the same as adjudication - they're closely related but technically different. Fact finding is the investigative stage where EDD collects information from both parties. Adjudication is the decision-making stage that follows. So the flow is usually: something triggers a question on your claim → EDD initiates fact finding → they gather info → they adjudicate (make a decision) → you get either an approval or a Notice of Determination. In a business closure situation your fact finding should move relatively quickly because there's not much to dispute - the business either closed or it didn't.

AuthorThis actually helps a lot, thank you. So fact finding comes before adjudication? I was using those terms interchangeably.

Amina Diallo
Exactly - fact finding feeds into adjudication. Once they have all the information from fact finding they'll make their determination. You might get a letter or just see your status change in UI Online.

wait so if you're in fact finding does that mean you're definitely going to go through full adjudication too? or can fact finding resolve without escalating?

my claim went into fact finding twice lol. first time was because i listed my last day wrong by like 3 days and it flagged something. second time my old boss straight up lied and said i quit when i was laid off. both times got resolved but man the second one took forever and i had to send in a ton of documents

Yara Sayegh
AuthorWhen they needed documents from you, how did you submit them? Online through UI Online or by mail?
0 coins
Keisha Williams
i did it through the document upload in UI Online, way faster than mailing anything. under the 'Upload Documents' section

Paolo Conti
Yes always upload digitally if possible. Mail at EDD can take weeks to process and sometimes gets lost entirely

Keep certifying!! I can't stress this enough. My sister stopped certifying when her claim went into fact finding because she thought there was no point and when it finally resolved she lost about 4 weeks of payments. California EDD won't backfill those unless you filed for them during the fact finding period.

Yara Sayegh
AuthorYes I've seen this advice a few times in this thread. I'm still certifying every week, I definitely don't want to lose any weeks.

your sister's situation is so common and so preventable. the EDD instructions on this are really unclear

Has anyone actually been able to reach EDD while in fact finding status to ask specific questions? I'm currently in a similar situation and every time I call I either get a busy signal or get connected and then disconnected within like 30 seconds. I've tried calling at 8am when they open, I've tried calling at random times during the day, nothing works consistently.

This is exactly why I mentioned Claimyr earlier in the thread - it was the only thing that worked for me to consistently get through to EDD. Check out claimyr.com if you haven't already, the video demo at https://youtu.be/JmuwXR7HA10 explains how it works better than I can. During fact finding specifically you really want to talk to an agent because they can tell you exactly what triggered it and what if anything you need to submit

Natasha Kuznetsova
I'll definitely look into that. At this point anything is worth trying

calling EDD is like a part time job that doesn't pay. the fact that people have to resort to third party services just to talk to a government agency about their benefits is wild

something that helped me understand my fact finding was requesting my claim file through a public records request. it takes a few weeks to get but it shows you literally everything EDD has on your claim including what triggered the review. by the time i got mine the fact finding was already resolved but it was still eye opening to see what was in there
0 coins
Yara Sayegh
AuthorI didn't know you could request your claim file. How do you do that?
0 coins
AstroAdventurer
you submit a written request to EDD asking for your claim records under the California Public Records Act. there's info on the EDD website about the process. like i said takes a while but good to know about

OP - one thing worth doing is writing down a detailed timeline of your employment situation. When the closure was announced, your last day, any severance you received, whether you were offered any position at another location etc. When EDD does fact finding on a restaurant closure they sometimes ask these specific questions and having it all written out means you don't have to scramble. Also if you have any documentation from your employer about the closure like a letter or email save those.
0 coins
Yara Sayegh
AuthorI did get an email from the owner when they announced the closure. I'll make sure that's saved somewhere accessible.

Malik Davis
Perfect. That kind of documentation makes your case very straightforward. Business closure with written confirmation is about as clean as a separation gets from EDD's perspective.

Amina Diallo
This is great advice. Documentation of the business closure is probably the most useful thing you can have ready if EDD asks any questions during fact finding.

SAME SITUATION HERE. been in fact finding for 11 days already and nothing has changed on my UI Online. i was a server and the restaurant i worked at shut down in december. i dont have any idea what triggered the review and im starting to get really anxious about my rent. does anyone know if theres an average timeline for how long fact finding takes for business closures specifically
0 coins
Paolo Conti
Business closures typically move faster through fact finding than disputed separations because the facts are more straightforward. That said EDD backlogs vary a lot. I'd say realistically 3-5 weeks is common but it can be shorter. The best thing you can do right now is keep certifying and try to get through to an EDD agent to confirm what they need from you if anything.

3-5 weeks feels really long when you're waiting on money. ugh

i feel you on the anxiety. worst part of fact finding is the uncertainty of not knowing what triggered it or when it'll end

NebulaNova
one thing a lot of people don't realize is that fact finding can also get triggered by something that seems totally unrelated to your separation. like if you reported earnings during a certification week and the amount was close to a threshold EDD uses, or if your employer's payroll records show something slightly different from what you reported on your initial claim. it's not always about the separation itself
0 coins
Yara Sayegh
AuthorI haven't worked at all since I was laid off so it shouldn't be an earnings issue. Unless my former employer reported something wrong on their end.

NebulaNova
employer reporting discrepancies are actually pretty common. like if they had a payroll processing delay and submitted hours after your claim week ended it can create a mismatch in the system

just wanted to add that when i was in fact finding i got a letter eventually asking me to call a specific EDD phone number to do an interview with an investigator. it wasn't the regular EDD number. if you get something like that respond immediately because missing that contact attempt can really delay your case

Yara Sayegh
AuthorI'll watch for that. I've been checking both my physical mailbox and my myEDD inbox daily.

good. also check your spam folder for email from EDD. i almost missed an email from them because it landed in spam

The phone interview thing is really important. It can happen at a specific scheduled time so you have to be available. Missing it is a big deal.

update on my situation from earlier - I tried Claimyr to get through to EDD and it actually worked. Talked to an agent for about 15 minutes who explained exactly why my claim is in fact finding (employer responded to the separation notice with some information that didn't match my dates). Agent told me specifically what to upload to clear it up. If you're stuck trying to reach EDD definitely worth checking out claimyr.com - here's the demo video again https://youtu.be/JmuwXR7HA10

Something worth knowing: if your fact finding results in a disqualification you don't agree with, you have the right to appeal within 30 days of the Notice of Determination. The appeal process through California EDD is separate from fact finding and adjudication - it goes to the California Unemployment Insurance Appeals Board. In a clear business closure situation I would not expect it to come to that but it's good to know the option exists.
0 coins
Yara Sayegh
AuthorI really hope it doesn't come to an appeal. Business really did close, I have documentation. This should be straightforward.

Malik Davis
For what it's worth I've never heard of a fact finding on a business closure going to appeal. It would be pretty hard for anyone to argue the business didn't close if it clearly didn't. Your situation sounds solid.

does anyone know if you can speed up fact finding by proactively submitting documentation even if EDD hasn't asked for it yet? like if i just upload my closure letter and last pay stub would that help or would it just confuse things
0 coins
Paolo Conti
Yes you can absolutely submit documentation proactively and it can actually help move things along. In UI Online go to the document upload section and make sure to label what you're submitting clearly. A closure letter especially is very useful to have in your claim file.

AstroAdventurer
ok good to know i'll do that today

Agree with this. Proactive documentation for a business closure is a good idea. Just make sure anything you upload is clearly relevant to your separation circumstances.

Just to summarize the key things for anyone finding this thread later who's also asking why is their unemployment under fact finding: 1) Keep certifying every single week no matter what 2) Check both your UI Online claim summary AND your myEDD inbox for any notices 3) Proactively upload documentation related to your separation 4) If you need to reach an EDD agent to find out specifically what triggered your fact finding, Claimyr at claimyr.com has been mentioned by multiple people in this thread as a way to actually get through - video at https://youtu.be/JmuwXR7HA10 5) If it results in a disqualification you have 30 days to appeal
