Wait time for EDD appeal decision after hearing - how long before I know?

I had my EDD appeal hearing last Thursday (for my disqualification due to 'voluntary quit'). The judge seemed pretty fair and listened to my side about how my employer reduced my hours by 60% which forced me to look for other work. The hearing lasted about 45 minutes and I submitted all my documentation showing the reduction in hours and emails with my manager. Now I'm anxiously waiting for the decision. The judge didn't give me any timeline of when to expect results. Has anyone gone through the appeal process recently? How long did it take to get your decision letter after the hearing? I'm starting to stress because I'm on week 8 with no benefits and rent is coming up soon. Any experiences would be super helpful!

I went through an appeal hearing back in January. In my experience, it took about 3 weeks to get the decision in the mail. The judge ruled in my favor (misconduct allegation that wasn't true). The letter will come from the CUIAB (California Unemployment Insurance Appeals Board) not directly from EDD. If you win, it still takes another 1-2 weeks for EDD to process the payments after the decision. Make sure you keep certifying for benefits every two weeks even while waiting! If you win, they'll pay for all the weeks you certified during the wait period.

Thank you so much for sharing! 3 weeks isn't as bad as I feared. And yes, I've been certifying every two weeks even though they all show "disqualified" status. Fingers crossed the judge sees it my way - a 60% cut in hours is basically constructive dismissal from everything I've read. I'll keep an eye out for CUIAB mail.

The official timeline from CUIAB states that administrative law judges are supposed to issue decisions within 30 days of the hearing, but in practice this varies considerably. Based on what I've seen with clients, the average is currently 2-4 weeks, with some receiving decisions in as little as 7-10 days and others waiting 6+ weeks. A few tips while you wait: 1. Continue certifying for all weeks as normal 2. Check your UI Online account daily - sometimes the decision shows there before the letter arrives 3. If it's been more than 4 weeks, you can contact CUIAB directly at 1-800-400-7166 to check on status 4. Your case about reduced hours (constructive dismissal) is actually fairly common and often successful If you need to speak with EDD directly about your case or payments, I recommend using Claimyr (claimyr.com) to get through to a representative quickly. They have a service that helps you bypass the hold times. There's a video demo here: https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km that shows how it works. Once you get the favorable decision, you'll want to contact EDD to make sure they process your payments promptly.

I used Claimyr last month when my payments were stuck pending for 6 weeks. It actually worked - got through to EDD in about 20 minutes instead of spending days redialing. Worth it for me since I needed to get $3700 in back payments released. Just sharing my experience!

THE WHOLE SYSTEM IS DESIGNED TO MAKE YOU GIVE UP!!!!! I waited SEVEN WEEKS after my hearing and then got a DENIAL even though I had PROOF my employer lied. Then I had to file a second level appeal which took ANOTHER 8 weeks!!! By that time I was already at a new job and missed out on $9300 in benefits I was ENTITLED to. EDD is BROKEN BY DESIGN to protect employers!!!!!

Agree! The system is stacked against workers. My cousin had almost the exact same situation - won on second appeal but took nearly 4 months total. Ridiculous waste of time.

While the system definitely has problems, most first-level appeals are actually decided in favor of the claimant (about 60% according to CUIAB stats). The delays are frustrating for sure, but don't assume you'll be denied just because the previous poster was. Each case is different.

Thank you everyone for the responses! Sounds like I should expect 3-4 weeks but be prepared it could take longer. I'll definitely keep certifying and check my UI Online account regularly. Really hope I don't have to go through a second appeal like some of you mentioned. This whole process is so stressful when you're watching your savings disappear.

That's exactly right - 3-4 weeks is typical but prepare for longer. One other tip: if you do win, make sure you call EDD right away to confirm they've processed the decision. Sometimes there's a lag between CUIAB ruling in your favor and EDD implementing the changes in their system. Stay persistent!

I had my appeal back in November and stiill havent gotten my decision. Called and they said "its in process" whatever that means. Totally gave up and found a new job. The whole UI system is a joke honestly.

That's extremely unusual - you should definitely call CUIAB directly (not EDD). Something is wrong if it's been that long. Decisions are required by law to be issued within a reasonable timeframe. Did you check if perhaps they sent it to an old address?

Just wanted to update everyone - I got my decision in the mail today! Only took 18 days after the hearing. The judge ruled in my favor, saying that a 60% reduction in hours constitutes a "compelling reason" to leave employment. Now I'm just waiting for EDD to process the payments. Thanks for all your advice and support during the wait!

That's great news! Congratulations! As I mentioned, it might take another week or so for the payments to process. If it goes longer than that, definitely call EDD to make sure there's no additional hold-up.

Awesome! So happy for you. I was in a similar boat last year and it feels amazing when justice prevails!
