EDD appeal hearing decision timeline - when will judge notify me?
I finally had my appeal hearing with the administrative law judge last Thursday after waiting almost 2 months since filing my appeal. The judge seemed pretty neutral during the hearing, and I think I explained my situation well about why I had to quit my restaurant job (unsafe working conditions - no ventilation in the kitchen and temperatures over 100°). My former employer showed up too and tried to claim I just walked out, but I had text messages proving I gave notice. Anyway, at the end of the hearing the judge just said he'd review everything and make his decision, but didn't say WHEN I'd hear back. It's been 5 days now and I'm getting really anxious checking my mail every day. Anyone know how long it typically takes to get the decision letter after an EDD appeal hearing? I'm down to my last $230 and really need this resolved soon!

Typically the EDD administrative law judge will mail out the decision within 7-10 business days after your hearing. In some complex cases, it might take up to 2-3 weeks, but that's less common. The judge has to review all testimony and evidence presented before making their final determination. Just keep checking your mailbox - they only send decisions by regular mail, not electronically through UI Online. Based on what you described (unsafe working conditions with documentation), you have a decent chance at a favorable outcome. Good job bringing those text messages as evidence!

•Thank you! That helps calm my nerves a bit. Do you know if they tell you the decision over the phone too, or is it just through mail? I'm afraid I might miss the letter somehow.

•Wow, 4 days is super fast! Was your case pretty straightforward? Mine felt complicated with the employer showing up to contest everything.

It varies wildly. Mine took exactly 16 days, but I had a colleague who got hers in 5 days. It really depends on the judge's caseload and the complexity of your specific situation. What matters is that you presented your evidence well. If it's been more than 3 weeks and you haven't received anything, you can call the Office of Appeals at the number on your hearing notice to inquire about the status. Just be prepared that getting through can be extremely difficult. If you need to speak directly with an EDD representative about anything in the meantime, I'd recommend using Claimyr (claimyr.com). They have a service that helps you get through to EDD phone lines without waiting for hours. Saved me so much frustration when I needed to check on my benefits after my appeal. They have a video that shows how it works: https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km

•Thank you for the specific timeframe examples. I'll try to be patient but it's really hard when the bills are piling up. I'll check out that Claimyr thing if I need to call them - actually tried calling EDD yesterday and gave up after 45 minutes on hold.

Mine took 12 days and it came in a regular white envelope that looked like junk mail so CHECK EVERYTHING in your mailbox carefully!!! Almost threw mine away by accident. The decision was in my favor tho and I got backpay for 8 weeks which was AMAZING after stressing for so long. Crossing fingers for you!!!

•Omg thank you for the warning about the envelope! I definitely would have expected something more official looking. Really hoping I get backpay too - it would be a lifesaver right now.

The judges are supposed to issue decisions within 30 days according to the unemployment appeals handbook but usually its faster. My cousin is still waiting after 3 weeks tho so its not always quick.

The system is COMPLETELY BROKEN. I waited 24 days for my decision and when it finally came, it was obvious the judge didn't even listen to a word I said during the hearing. Then you have to wait ANOTHER 4-5 weeks for them to actually release any payment if you win. It's like they WANT people to become homeless while waiting! And don't think you'll get a straight answer if you call to ask about the status. They just tell you to wait and be patient. EASY FOR THEM TO SAY when they're getting paid every two weeks!!! The whole appeal process is designed to make you give up.

•That's exactly what I'm worried about - waiting all this time just to get denied. The worst part is the uncertainty. If I knew for sure I wasn't getting the money, I could at least make other plans. Really sorry you had such a terrible experience.

•You're absolutely right. I won my appeal after 14 days of waiting, but then it took another MONTH before the payment actually showed up on my Money Network card. When I called to ask why it was taking so long, the rep literally told me "the system hasn't processed your payment yet" - like the computer is making the decisions! Meanwhile my landlord doesn't care about EDD's broken systems...

wait did they record your hearing?? they recorded mine and the judge said that meant it would take longer to process because they had to review the recording or something

•Yes, it was recorded. The judge mentioned that at the beginning. Now I'm worried it'll take even longer :

I wanted to follow up because there's some misinformation in this thread. The timeframe for decisions is usually 7-14 days, regardless of whether the hearing was recorded (all hearings are recorded as standard procedure). What actually affects the timeline is: 1. The complexity of the case 2. How many witnesses testified 3. How much documentation needs to be reviewed 4. The judge's current caseload If you win your appeal, payments aren't automatic. You'll need to continue certifying for benefits while waiting. Once the decision is processed, you should see pending payments change to paid status within a few days. If they don't, that's when you need to contact EDD directly. Also, the decision letter will explain your next steps whether you win or lose. If you disagree with the decision, you have 30 days to file an appeal to the CUIAB Board, which is the second level of appeals.

•Thank you for the detailed explanation! I've been certifying every two weeks as normal, so hopefully that means if I win, I'll get paid relatively quickly. Really appreciate all the helpful information everyone's provided.

UPDATE: Just wanted to let everyone know I received my decision letter today! So it took exactly 8 days after the hearing. I WON MY APPEAL! The judge agreed that the working conditions were unsuitable. Now I'm just waiting for the payments to be processed. Thank you all for your help and support during this stressful time!

•CONGRATS!!! So happy for you! The relief must be incredible. Now just keep an eye on your UI Online account for those pending payments to switch to paid!

•Great news! Make sure to continue certifying for any weeks you're eligible. The backpay should appear in your payment history within 3-5 business days. Congratulations!

Congratulations Logan! That's fantastic news! 🎉 Your case really shows how important it is to document everything - those text messages proving you gave notice made all the difference. I'm currently waiting for my own appeal decision (had my hearing 2 weeks ago for a similar situation) and your timeline gives me hope. Just wanted to add for anyone else reading - make sure you keep certifying for benefits while waiting for the payments to process. I made the mistake of stopping during my first appeal thinking it was automatic, and it delayed everything even more. Thanks for updating us with the good news!

•That's such great advice about continuing to certify! I almost made that same mistake - thankfully someone on here warned me early on. Two weeks isn't too bad of a wait, hopefully you'll hear something soon! It really does make such a difference having proper documentation. I was lucky my manager was texting instead of just talking in person. Fingers crossed for your appeal! 🤞
