If I get denied unemployment can I apply again with California EDD?

So I just got a disqualification notice from California EDD and I'm completely lost on what my options are. Little background - I was laid off from my warehouse job about six weeks ago after my employer said there wasn't enough work to keep my position. Filed my UI claim pretty quickly after that, did everything online through UI Online, certified for my first two weeks, and then out of nowhere I get this notice saying my claim was denied. The reason they gave was something about 'misconduct' which makes zero sense because I was literally told the position was being eliminated due to slow business, not because I did anything wrong. Now I'm sitting here wondering - if I get denied unemployment, can I apply again? Like do I have to start the whole process over or is there another route? I've read some stuff about appeals but I don't know if that's different from reapplying. My finances are getting tight and I really need to figure this out fast. Has anyone been through a denial and managed to get their benefits eventually? What did you do?

Yes you can absolutely still get benefits after a denial, but the path depends on WHY you were denied. Since yours says misconduct, that's a disqualification - not just a technical issue. You'd want to file an appeal rather than a brand new claim. Reapplying won't help because EDD will just see the same employment record and deny you again. The appeal is where you actually get to tell your side of the story and present evidence. You have 30 days from the date on that notice to file the appeal, so don't wait.

0 coins

Okay so the appeal is the right move, not starting over. Does the appeal cost anything or is it free to file?

0 coins

Completely free. You file it through UI Online or mail in the paper form. Just make sure you include a written statement explaining why the disqualification reason is wrong and attach any documentation you have like termination letters, emails, whatever supports your story.

0 coins

This is right. I went through a misconduct denial last year and won my appeal. The key is getting documentation from your employer that contradicts their original claim. In my case HR had sent me a layoff letter and EDD accepted that as proof it wasn't misconduct.

0 coins

wait so if i get denied unemployment can i apply again separately or does the appeal replace that? genuinely confused about how this works

0 coins

Good question. If you got denied because of a disqualification like misconduct, you appeal the existing claim - you don't file a new one. But if your claim was denied for a technical reason like not meeting the base period earnings requirement, THEN you might file a new claim under different circumstances once you qualify. Two completely different situations.

0 coins

ohhhh okay that makes more sense. so OP needs to appeal not reapply got it

0 coins

I went through almost this exact situation earlier this year. My employer told EDD I quit voluntarily when I absolutely did not - they had cut my hours so drastically it was basically a forced layoff. Got denied, panicked, then someone told me about Claimyr which is a service that helps you actually get through to a live EDD agent on the phone. Used it at claimyr.com and they got me connected to an agent way faster than I ever could calling on my own. The agent I spoke with walked me through exactly what documentation would strengthen my appeal. There's a video showing how it works at https://youtu.be/JmuwXR7HA10 - honestly wish I had found it sooner because I spent weeks trying to get through before that.

0 coins

I've been trying to call EDD for days and can't get through at all. Might actually try this, thanks.

0 coins

does it actually work? EDD phones feel impossible

0 coins

It worked for me. I was skeptical too but I was desperate at that point. Got connected to a real agent within the same day and was able to ask all my questions about the appeal process directly.

0 coins

going to look into this too, been trying to reach EDD for two weeks straight

0 coins

The misconduct determination by EDD is actually one of the more commonly overturned disqualifications on appeal. California law defines misconduct pretty specifically - it has to be a willful or deliberate violation of the employer's interests, not just poor performance or a layoff. If your employer told EDD it was misconduct but then told you it was lack of work, that's a direct contradiction that an appeals judge would likely find significant. Make sure you document every interaction you had with your employer in the weeks before termination.

0 coins

This is really helpful to know. I do have a text from my supervisor saying the warehouse was slowing down and they needed to reduce staff. Would that be enough?

0 coins

That text could be very valuable evidence. Screenshot it, back it up somewhere. Also if you have any written communication showing you weren't given any warnings or write-ups for behavior issues, that helps establish there was no actual misconduct. EDD puts the burden of proof on the employer to show misconduct existed.

0 coins

Agreed on the text being useful. I'd also request any employment records you're entitled to, like performance reviews. Having clean reviews right up until a 'misconduct' termination looks really bad for the employer's credibility with the appeals judge.

0 coins

honestly edd is just awful at this stuff. they just rubber stamp whatever the employer says without investigating at all. i filed for unemployment twice and both times the employer lied and edd just believed them. first time i lost the appeal too because i didnt know what i was doing. DOCUMENT EVERYTHING people

0 coins

That's terrifying to hear. Did you eventually get approved on the second appeal?

0 coins

second time around i knew more about what to present and yes i finally got approved but it took like 5 months total. the whole process is exhausting

0 coins

Five months is brutal. Were you able to get any backdated payments once you won or did they only pay going forward?

0 coins

I got back payments all the way to my original filing date which was a big relief. Make sure you keep certifying for your weekly claims even while the appeal is pending - that part is super important

0 coins

Jumping in to clarify something important that sometimes gets missed - while your appeal is being processed you should continue certifying for your weekly benefits through UI Online. I know it might seem pointless if you're denied but if your appeal is successful EDD will pay all those weeks retroactively back to your original claim date. If you stop certifying you could lose those weeks of payments even if you win.

0 coins

Oh wow I didn't know that. I actually stopped certifying after I got the denial notice. Can I go back and certify for the missed weeks?

0 coins

You can request to certify for past weeks but you'll need to contact EDD directly to unlock those weeks since they've passed. This is another situation where getting through to an actual agent on the phone would really help you - they can manually process those backdated certifications.

0 coins

this is really important info that nobody tells you when you get denied. glad someone posted it

0 coins

I went through the appeals process earlier this year for a similar situation. Few things I wish I had known going in: 1) The appeals hearing is conducted by an Administrative Law Judge from the California Unemployment Insurance Appeals Board - it's separate from EDD itself. 2) You can have a representative at the hearing, even a non-attorney. 3) The hearing is usually over the phone, not in person. 4) Your former employer will also have the opportunity to present their side. So prepare to counter whatever they say.

0 coins

So my employer will be on the call too? That's kind of nerve wracking honestly.

0 coins

Yes but don't panic about it. Just stick to the facts, present your evidence clearly, and let the judge ask questions. Most claimants who appeal misconduct denials with good documentation do reasonably well. The judge isn't there to take sides, they're looking at the facts.

0 coins

Also worth noting you can request a postponement of the hearing if you need more time to gather documentation. Don't rush into the hearing unprepared.

0 coins

something nobody mentioned yet - check the date on that denial notice carefully. you have exactly 30 calendar days from that date to file the appeal, not business days. and the clock starts from the mailing date on the notice, not from when you actually received it. so if you're already a week or two out from getting the letter you need to move fast

0 coins

I got the letter about 5 days ago so I still have time but you're right I should not sit on this

0 coins

Definitely get it filed this week if you can. Better to file an incomplete appeal and add documentation later than to miss the deadline entirely.

0 coins

This is such a critical point. Missing the appeal deadline basically means you have to start completely fresh and lose all those potential back payment weeks. Don't let it slip.

0 coins

Can I ask a dumb question - when you say you can reapply, does that mean going to the EDD website and filing a whole new claim from scratch? Because I'm kind of in a different situation where my previous claim just expired and I need to file a new benefit year. Wasn't sure if that was the same thing being discussed here or different

0 coins

That's actually a different situation. What you're describing is filing for a new benefit year which is normal and expected - claims expire after a year and if you're still unemployed you file a fresh claim. The OP's situation is a disqualification appeal which is different. For your situation just go to UI Online and start a new claim, it's pretty straightforward.

0 coins

Oh okay good, that's less complicated than I thought. Thanks for clarifying

0 coins

I tried calling EDD about my denied claim for literally three weeks. Calling at 8am, calling at 12pm, calling at random times, getting the 'we cannot take your call' message every single time. Finally my friend told me about Claimyr and I was honestly ready to try anything at that point. It's at claimyr.com - basically gets you in the queue to reach an actual EDD phone agent without you having to sit there redialing for hours. Totally changed my situation because the agent was able to explain exactly why my claim was flagged and what I needed to do.

0 coins

Okay two people have mentioned this service now. I'm definitely going to try it because I cannot keep calling and getting nowhere.

0 coins

The video at https://youtu.be/JmuwXR7HA10 shows how it works if you want to see before you commit. It's not complicated at all.

0 coins

wish i had known about this when i was fighting my appeal. spent so much time on hold going nowhere

0 coins

so wait if you get denied unemployment can you apply again immediately or do you have to wait some period? asking because my situation is different - i was denied because i apparently didnt earn enough in my base period but im about to hit a year at my new job

0 coins

For a base period earnings issue you actually can reapply once you have sufficient wages in a new base period. EDD uses the first four of the last five completed quarters to calculate your base period. Once you have enough earnings in that window you can file a new claim. There's no waiting period beyond just having the qualifying wages.

0 coins

okay so i should be able to file again in a few months then. good to know, thank you

0 coins

Won my appeal after a misconduct denial about eight months ago. Biggest advice I can give - be really specific in your written appeal statement. Don't just say 'my employer is wrong.' Lay out a factual timeline. When were you hired. When were business conditions mentioned to you. When were you let go and what exact words did your employer use. What documentation exists. Judges respond way better to organized factual accounts than emotional arguments.

0 coins

This is really practical advice thank you. I'm going to write out a timeline tonight.

0 coins

Good luck. Also keep copies of everything you submit. EDD has been known to lose documents.

0 coins

The timeline approach is exactly right. And attach any exhibit like documents with a labeled reference in your statement - 'as shown in Exhibit A' - so the judge can follow along easily.

0 coins

One more thing worth mentioning - if you do get to your appeals hearing and the judge rules against you, there's STILL another level you can go to. The California Unemployment Insurance Appeals Board reviews ALJ decisions if you file a second level appeal. Most people don't know this exists. It's a long road but you have more options than just one appeal.

0 coins

I had no idea there were multiple appeal levels. Hopefully I won't need that but good to know it exists.

0 coins

That's true but the second level appeal doesn't involve a new hearing - it's a review of the record from the first hearing. So you really want to make your best case at the ALJ level where you can actually present evidence and speak.

reading this whole thread is making me realize how many people get wrongly denied by edd. seems like the system is set up to deny first and let people fight for it which is messed up

0 coins

That's exactly what it feels like from the inside. The default seems to be deny and see who bothers to push back.

0 coins

There's some truth to this but also a lot of employers do misrepresent things to EDD which causes denials that shouldn't happen. The appeals process exists to catch those errors it just requires you to know your rights and document everything.

0 coins

i was in a somewhat similar boat last spring - got denied, didn't know if i get denied unemployment can i apply again or had to appeal, ended up doing both by accident because i didn't understand the system. filed a new claim AND an appeal at the same time. EDD eventually consolidated everything and processed my appeal. so even if you take a wrong turn the system does sometimes sort it out, just takes longer

0 coins

Glad it worked out but I wouldn't recommend trying both at once on purpose - it can create confusion in your account and delay things even more.

0 coins

yeah definitely not recommending it lol it was a mess. just saying even if you make a mistake it's not necessarily the end of the world

0 coins

Does anyone know if your weekly benefit amount stays the same if your appeal gets approved? Like does winning the appeal lock in the same payment amount you originally would have gotten or can that change

0 coins

Your weekly benefit amount is based on your base period wages and gets calculated when the claim is first filed. Winning an appeal doesn't change that amount - you'd get paid the same weekly benefit amount that was originally calculated, just for the weeks that were denied during the disqualification period.

0 coins

okay good, that's what I was hoping. thanks

0 coins

UPDATE for anyone following: I finally got through to an EDD agent using Claimyr like someone mentioned above. Claimyr.com - it actually worked. Agent confirmed I could unlock my missed certification weeks since I had stopped certifying after my denial, and they noted on my account that I have an active appeal. Feeling much better about my situation now knowing there's a real path forward. The video demo at https://youtu.be/JmuwXR7HA10 is worth watching if you're skeptical like I was.

0 coins

This is so reassuring to see. I'm going to do the same thing with Claimyr and also make sure I get my appeal filed before that 30 day window closes. Thank you everyone in this thread.

0 coins

good luck! document everything and you've got this

0 coins

Rooting for you. Come back and update us when you get your decision.

Final summary for anyone finding this thread later who is wondering if they get denied unemployment can they apply again - here's the breakdown: 1) Denied due to disqualification like misconduct or voluntary quit = file an APPEAL within 30 days, don't file a new claim. 2) Denied due to insufficient base period earnings = you can file a NEW CLAIM once you have qualifying wages. 3) Denied due to a technical/ID verification issue = contact EDD directly to resolve the issue on your existing claim. Keep certifying weekly no matter what while you wait for resolution.

This is an incredibly clear summary. This should be pinned somewhere.

bookmarking this whole thread honestly

thank you this cleared up a lot of confusion i had too
