Back to California Unemployment

I quit my job - can I still get California EDD unemployment benefits?

So I recently walked off my job at a logistics warehouse after my supervisor kept scheduling me for mandatory overtime without any notice, sometimes texting me at 9pm telling me I had to be in at 5am the next morning. This went on for about four months and I documented everything including the texts. I finally hit my limit two weeks ago and quit. Now I'm trying to figure out if I can even file for California EDD unemployment or if quitting automatically disqualifies me. I've heard conflicting things from friends - some say you can never get UI if you quit, others say there are exceptions. I went ahead and filed a claim anyway but honestly I have no idea what to expect. Has anyone successfully received unemployment benefits after quitting in California?

This is actually one of the most misunderstood things about California EDD unemployment. Quitting does NOT automatically disqualify you. There's a legal concept called 'good cause' and if your working conditions were genuinely intolerable or violated your rights, California EDD can approve your claim even though you voluntarily left. The mandatory overnight scheduling with no notice could absolutely qualify depending on how EDD evaluates it. The key things they look at are: did you try to resolve the issue before quitting, did the conditions violate your employment agreement or California labor laws, and was a reasonable person in your situation likely to quit too. Document everything - those texts you mentioned are gold.

0 coins

That's really helpful to know. I did actually talk to HR twice about the scheduling before I quit, I just never got anything in writing from those conversations. Does that hurt my case?

0 coins

Not necessarily fatal but definitely makes it harder. Going forward write down dates and details of those HR conversations as best you can remember them - even a personal memo you write now helps establish the timeline. EDD will ask about steps you took to fix the problem before quitting.

0 coins

same thing happened to my cousin she quit bc her boss was harassing her and she got approved. just depends on the situation i think

I work in HR and I've seen this play out both ways. California EDD will classify your separation as 'voluntary quit' and then investigate whether you had good cause. They'll contact your former employer for their side of the story - and trust me, employers almost always push back and claim the conditions were fine. The adjudication process for voluntary quits typically takes longer than regular layoff claims, sometimes 4-6 weeks. Make sure when you fill out your claim questionnaire you're super specific about the dates, what was required of you, what your original schedule agreement was, and exactly what steps you took to address it. Vague answers hurt claims badly.

0 coins

The questionnaire is what I'm most nervous about. Is there a specific section where I explain why I quit or does it come later?

0 coins

You'll get a separate eligibility questionnaire from California EDD after you submit the initial claim - it's specifically for situations where your separation wasn't a straightforward layoff. Answer every single question thoroughly, don't leave anything blank, and be consistent with whatever you told your employer.

0 coins

this is accurate. the employer response is huge. if they say the schedule was always like that and you knew when you were hired, EDD might side with them even if thats not true

I quit a retail job back in early 2024 under somewhat similar circumstances - hostile management, kept changing my hours without notice. My claim went into adjudication and I was freaking out waiting. What actually helped me get through to someone at California EDD to check my status was using a service called Claimyr. I'd been calling for weeks and getting the busy signal or getting disconnected. Claimyr basically holds your place in the EDD phone queue and calls you back when an agent is on the line. Took me forever to find it but it saved me so much stress. You can check it out at claimyr.com - they also have a demo video at https://youtu.be/JmuwXR7HA10 that shows how it works. When I finally got through to an agent I was able to ask exactly what documentation they needed for my voluntary quit case and that made a huge difference.

0 coins

Wait this actually works? I've been trying to call EDD for three days straight and can't get through to anyone. I'll check out that video.

0 coins

yeah the EDD phone system is basically designed to make you give up lol. anything that actually gets you through to a real person is worth trying

0 coins

It 100% worked for me. The agent I spoke to was actually really helpful once I got through - gave me a checklist of what to include in my questionnaire response for the voluntary quit review. That information alone probably saved my claim.

0 coins

ok wait so if you quit does that mean you have to do job search requirements right away or is there a waiting period or what. asking bc i might be in a similar situation soon

0 coins

Yes, if your claim is approved you will need to certify weekly and meet the job search requirements - currently that means completing 3 job search activities per week in California. There's no special exception from job search just because you quit rather than got laid off. The difference is just in whether you get approved in the first place.

0 coins

3 job search activities a week got it, that seems doable at least

0 coins

Just to add - make sure you're logging those activities in a way you can document. California EDD can audit your job search records and you want to have specifics: company name, position, date, how you applied. CalJOBS registration is also required if you haven't done that already.

0 coins

I went through this exact situation and I want to give you a realistic picture. I quit my job as a medical billing specialist because my company suddenly required us to work weekends with zero additional pay and it wasn't in my original contract. I filed, went through adjudication, and got DENIED the first time. I appealed and WON at the appeals board hearing. The whole process took almost 3 months. So even if you get denied initially, don't give up - the appeal is absolutely worth pursuing if you have documentation. The ALJ at my hearing was way more understanding than the initial EDD determination.

0 coins

Three months is a long time to go without income. Did you have any way to survive financially during that period while waiting?

0 coins

It was really tough honestly. I had some savings and borrowed from family. If I had it to do over I would have started a side gig or part time work immediately rather than waiting to see what EDD decided - you can still collect partial benefits if you work part time and earn under a certain threshold.

0 coins

the appeals process is underrated. people give up after a denial but the ALJ hearings are genuinely fairer than the initial EDD review in my experience too

0 coins

QUITTING IS NOT THE AUTOMATIC DEATH SENTENCE EVERYONE THINKS IT IS. Sorry for caps but I see so many people on here assume they have zero shot and don't even bother filing. California EDD themselves say good cause includes situations where the working conditions were unsafe, significantly changed from what you were hired for, or involved harassment or discrimination. Mandatory surprise overtime with 8 hour notice could definitely fall under 'significant change in working conditions.' FILE THE CLAIM. Worst case they deny it and you appeal. Best case you get approved. Either way you have nothing to lose by trying.

0 coins

You're right, I did file already. Just anxious about the outcome. The not knowing is the worst part.

0 coins

Totally get that. Once you're in adjudication the waiting is brutal. If you can get through to an EDD agent to at least confirm they received your questionnaire responses, that helps mentally even if they can't tell you the outcome yet.

0 coins

agreed just file. my brother assumed he couldnt get anything after quitting and never filed, found out later he probably woulda qualified. dont make that mistake

0 coins

Just want to add something practical - when California EDD sends you the questionnaire about your voluntary quit (it might be called a Notice of Unemployment Insurance Claim Filed or you might get a phone interview scheduled), use phrases like 'substantial change in working conditions' and 'I attempted to resolve the situation through proper channels before separating.' These are phrases EDD adjudicators are literally trained to look for when evaluating good cause. I'm not saying be dishonest - I'm saying present your true situation using language that maps to their evaluation criteria.

0 coins

This is really tactical advice, thank you. I want to make sure I'm communicating clearly and not just venting about how unfair it was.

0 coins

Exactly - the questionnaire is not the place to vent. Stick to facts, dates, specific incidents, and the steps you took to fix the problem. Emotional language can actually work against you even when your situation is legitimate.

0 coins

100% this. adjudicators are reviewing dozens of cases. clear factual language makes their job easier and makes you look credible

0 coins

genuine question - does it matter what industry you're in? like do some types of jobs get more scrutiny than others when you quit

0 coins

Industry doesn't directly affect the evaluation - it's about the specific circumstances of your separation. However, jobs where variable schedules are considered standard (restaurants, retail, warehouse work) can sometimes make it harder to argue that changing schedules were unexpected, because EDD might consider that 'typical' for the industry. That's why your original employment agreement or any written schedule expectations matter so much.

0 coins

makes sense. so like if you worked at a restaurant and they changed your shifts you might have a harder time than someone in an office job

0 coins

Generally yes, though each case is individual. Industry context is one of many factors. A restaurant worker who was hired for specific daytime shifts and suddenly forced to work nights could still have a valid claim - it's about the change from what was agreed, not just what the industry typically does.

0 coins

I've been following this thread because I'm in a similar boat. I quit my job as a warehouse associate three weeks ago due to safety violations my employer refused to address - forklifts operating in areas without proper warnings, things that could have seriously injured me. Filed my California EDD claim and it's been sitting in adjudication for 19 days. I tried calling EDD every day this week and can't get through at all. Getting really anxious.

0 coins

Safety violations are actually one of the stronger good cause arguments you can have. If you filed complaints with Cal/OSHA or reported internally before quitting, that documentation is incredibly valuable. On the phone issue - have you tried Claimyr? That's what I used when I couldn't get through to California EDD. Visit claimyr.com and watch their demo video at https://youtu.be/JmuwXR7HA10 - it got me connected to an actual EDD agent after weeks of failed calls. For a safety violation quit case specifically, talking to an agent can help you understand what additional documentation they might need.

0 coins

I did file a verbal complaint with the safety coordinator twice. I have the dates written down but nothing in writing from them. I'll try Claimyr because honestly I just need to talk to someone at EDD who can tell me where things stand.

0 coins

Verbal safety complaints documented by date is still meaningful. Wish you luck - safety violation quits definitely have strong good cause backing in California.

0 coins

lol the EDD phone system is genuinely one of the most frustrating things I've ever dealt with in my life. called 47 times in one day once and got through zero times. ZERO. the automated system just hangs up on you when they're at capacity. it's honestly absurd for a government agency that people depend on

0 coins

47 times in one day... I felt that in my soul. The phone system is absolutely designed to discourage people from getting through. It's a feature not a bug at this point.

0 coins

Right!! And then when you DO somehow get through you get put on hold for 2 hours and then disconnected anyway. I've been hung up on mid-sentence by EDD agents before. It's demoralizing.

0 coins

This is exactly what I'm running into. Three days of calling and nothing. Going to try that Claimyr thing someone mentioned earlier, at this point I'll try anything.

0 coins

One thing nobody mentioned yet - if your California EDD voluntary quit claim gets denied, you have 30 days from the date on the denial notice to file a UI appeal. Do NOT miss that deadline. The appeal goes to the California Unemployment Insurance Appeals Board and as someone mentioned above, the ALJ hearings are often more favorable than initial determinations. At the hearing you can present your texts, explain the timeline, bring witnesses if you have them. Many people who were denied initially win on appeal.

0 coins

30 days - noted. I really hope it doesn't come to that but good to know the option exists.

0 coins

Also worth knowing - you continue filing your weekly certifications during the appeal process even while the appeal is pending. If you win the appeal, you get backdated benefits for those weeks. If you stop certifying you might lose those payments.

0 coins

wait you still have to do the weekly certifications even when youre waiting on an appeal?? that seems like a lot but i guess it makes sense if they backpay you

0 coins

Something to be careful about - California EDD will ask your former employer directly whether there were complaints about scheduling and whether they were addressed. If your employer tells EDD there were no complaints or that you never raised the issue, your claim gets way more complicated. This is why having ANY written record matters. Even texts between you and coworkers about the situation, calendar entries, anything. Verbal only is harder but not impossible.

0 coins

I have the texts from my supervisor announcing the last-minute schedule changes. Would those count as documentation even though they're not formal complaints?

0 coins

Yes absolutely - those texts showing the pattern of last-minute mandatory overtime are actually really strong evidence. They don't just document the problem, they document it in your employer's own words. Screenshot and back those up somewhere safe.

0 coins

This is such a good point. Your employer's own communications showing the scheduling practices are way more credible than just your word against theirs. That evidence could be decisive.

0 coins

honestly just wanted to say this thread is really helpful. been scared to file because i quit my last job too and everyone keeps telling me i won't qualify for anything. feels less hopeless reading all this

0 coins

Please file! The worst outcome is a denial that you can then appeal. But many people in voluntary quit situations with valid reasons do get approved. Don't let the misconception that quitting = automatic disqualification stop you from trying.

0 coins

okay I'm going to file today. thank you

0 coins

Good!! Come back and let us know what happens. And document everything about why you left before any details get fuzzy.

0 coins

Quick practical note for anyone in adjudication for a voluntary quit: check your UI Online account daily. Sometimes EDD uploads notices or requests for additional information that they DON'T send by mail - or the mail comes days after it's posted online. Missing a deadline to respond to a request for information can result in an automatic denial. I almost lost my claim because I didn't know to check online separately from waiting for mail.

0 coins

Oh wow I didn't know this. I've just been waiting for mail. Going to log into UI Online right now.

0 coins

Definitely check it. Look under 'notices' and 'inbox' - both sections. Some communications show up in one and not the other for some reason. Also make sure your email on file is current because some notifications only go there.

0 coins

This is great advice. The UI Online dashboard is honestly not intuitive but the notices section is critical. Treat it like your primary channel with EDD, not a backup to mail.

UPDATE for anyone following: I was in a situation similar to OP about two months ago, quit a toxic job, filed for California EDD, went through adjudication. My claim was APPROVED last week. What I think made the difference was that I was very specific in my questionnaire about dates and incidents, I mentioned that I had talked to a supervisor about the issue before quitting, and I had text message evidence of the working conditions. The adjudicator never even called me, they just made the determination from the paperwork. So it IS possible to get approved for UI after quitting in California.

0 coins

This is so encouraging to read, thank you for coming back to share. I'm in adjudication right now and this gives me hope.

0 coins

Hang in there. The waiting is the hardest part. Make sure all your weekly certifications are submitted on time and your UI Online info is up to date. If they do approve you, you want to make sure payment goes smoothly right away.

0 coins

congrats!! this is the kind of update this thread needed

0 coins

I got through to a California EDD agent yesterday after trying forever - I ended up using Claimyr like someone recommended in this thread a few weeks back. Finally got confirmation that my voluntary quit claim was approved. The agent also confirmed my payment timeline. If you're stuck trying to reach EDD by phone, seriously just try claimyr.com - the video at https://youtu.be/JmuwXR7HA10 explains it well and it actually worked for me when nothing else did.

0 coins

So glad to hear this worked for you. I tried it last week and also got through - the agent I spoke to confirmed my questionnaire was received and told me what stage my claim was in. It was such a relief to get actual information after days of radio silence from EDD.

0 coins

I used it too after seeing this thread and got through to an EDD agent on the same day. They told me my safety violation quit claim was still under review and what documentation would help. Genuinely the only way I've been able to communicate with EDD at all.

0 coins

ok fine you've all convinced me to try it. the EDD phone system has beaten me into submission
