How do business owners file for unemployment with California EDD?
So I'm in a really weird spot and not sure if I even qualify for any benefits. I ran a small landscaping business for about 6 years, had 3 employees at peak, but I had to shut everything down about 5 weeks ago. The contracts dried up, overhead was killing me, and I finally had to make the call to close. I dissolved the LLC officially and everything. Now I'm in this limbo where I don't know if I can even file for unemployment through California EDD. I was paying myself through payroll (W-2 wages) for the last couple years after my accountant told me to set it up that way for tax purposes, so I do have wages on record. But I also had ownership stake in the business obviously. Does anyone know how business owners are supposed to file for unemployment in California? I tried looking on the EDD website and it's super confusing because everything seems geared toward regular employees. I have no idea what my base period wages would even be or whether my ownership status disqualifies me. Any help would be appreciated because I'm completely lost on this.

This actually comes up more than people realize. The key thing California EDD looks at is whether you had W-2 wages reported during your base period - not whether you were an owner. If you were paying yourself legitimate payroll with taxes withheld (SDI contributions specifically), you likely have a valid wage record and can file a claim. The base period is typically the first four of the last five completed calendar quarters before you filed. So if you were running payroll consistently, those wages should appear in EDD's system. The tricky part for business owners is the 'able and available' requirement - you need to be genuinely available for work and actively seeking employment, not just waiting to restart your business. EDD may ask questions about your situation during the eligibility interview.

AuthorThis is really helpful, thank you. Yes I was definitely paying SDI through payroll this whole time. I didn't even know if that mattered. So I just go to UI Online and file like a normal employee would?

Exactly right about the SDI contributions. That's the gateway. No SDI withheld = no UI benefits. Most sole proprietors who pay themselves as contractors (1099) don't qualify for this reason.

wait so if you own the business but paid yourself W2 you can get unemployment?? i had no idea that was even possible

I went through almost this exact thing two years ago when I closed my catering business. Filed through UI Online just like a regular claim. The initial application asks about your separation reason and there's an option for business closure/self-employment. Just be completely honest about being an owner-operator. Here's the thing though - EDD will likely send you to a phone interview (they call it an eligibility interview) to verify your circumstances. They want to confirm the business is actually closed and you're not planning to reopen it. Have your dissolution paperwork ready.

AuthorDid they ask for a lot of documentation about the closure? I have the LLC dissolution papers from the state but I'm wondering what else they might need.

They asked me to confirm the date I stopped operating and why. I mentioned I had the dissolution paperwork and they noted it but didn't actually request it upfront. They may ask for it later if adjudication gets complicated.

this matches my experience too, the phone interview is pretty standard for any self-employed situation, just be straightforward with them

One thing I'd add - when you're filling out the initial claim, you'll hit a section asking about your most recent employer. Since you were both the employer AND the employee effectively, put the business name as the employer. The separation reason should be 'lack of work' or 'business closed' - this is accurate and it's the most straightforward framing. Also heads up: because you had ownership, your claim will almost certainly go into adjudication. This is normal and expected. Don't panic when you see that status. It just means a human reviewer needs to evaluate your specific circumstances rather than it being auto-processed.

AuthorHow long does adjudication usually take in these situations? I have bills coming up and I'm kind of stressing.

Honestly it varies a lot. Could be 2 weeks, could be 6+ weeks. The frustrating truth is there's no way to know in advance. If it drags past 4-5 weeks you should try to contact EDD directly to check status.

Six weeks is wildly optimistic lol. Mine took 11 weeks and they never even explained why it took so long

For contacting EDD when you're stuck in adjudication - I was in a similar boat with my claim and could NOT get through on the phone for weeks. A friend told me about a service called Claimyr (claimyr.com) that helps you actually reach a live EDD agent. There's a demo video at https://youtu.be/JmuwXR7HA10 that shows how it works. I was pretty skeptical but it actually connected me within the same day after I'd been trying on my own for almost two weeks. Really helpful when you need answers on your specific situation rather than just waiting and wondering.

AuthorOh interesting, I'll bookmark that for if my claim gets stuck. Did they help you with an adjudication situation specifically?

Sean Kelly
Yeah exactly that situation. The agent I reached was able to tell me what was holding up my claim and what documents they needed. Would have waited another month otherwise probably.

I need to be the reality check voice here. Business owner unemployment claims are HEAVILY scrutinized by EDD. I don't say this to discourage you - if you genuinely closed and have W-2 wages on record you likely DO qualify - but prepare yourself mentally for a long process. The main hurdles I've seen: 1. EDD will want to confirm you have no continuing interest in any business entity 2. They'll check whether you're 'available for work' in a way that suggests you might restart 3. Any income you receive while claiming (consulting, freelance jobs, etc.) has to be reported weekly Just go in with eyes open. The rules are legitimate and you can clear them, it just takes patience.

AuthorThis is good to know. I'm definitely not planning to restart - the market I was in basically collapsed and I'm looking at completely different work. Is there a way to communicate that clearly to EDD during the interview?
0 coins
StellarSurfer
Yes - during the eligibility interview just be straightforward that you dissolved the entity and are seeking employment in a different field. The interviewer isn't trying to catch you in anything, they just need to verify the basic facts.

the 'no continuing interest' thing caught me off guard. i had a second smaller LLC i forgot about and that triggered a whole extra review

Quick technical point on base period wages since you mentioned not knowing what they'd be: For a claim filed in 2025, EDD will look at wages from approximately October 2023 through September 2024 as your standard base period. If your wages during that time were lower than you'd like, you can request an alternate base period that uses more recent quarters. To qualify you generally need at least $1,300 in your highest quarter OR at least $900 in your highest quarter AND total base period wages of 1.25x that amount. With 6 years of paying yourself W-2 wages you almost certainly clear this threshold easily.
0 coins
Ravi Choudhury
AuthorI paid myself about $52,000 a year in W-2 wages so that should be well above the threshold right?
0 coins
Freya Johansen
Yes, comfortably so. Your weekly benefit amount would be calculated based on those wages and would likely be near the maximum weekly benefit amount that EDD pays.

what is the max weekly benefit right now? I keep seeing different numbers

Filing online through UI Online is honestly pretty intuitive even for non-standard situations. Go to edd.ca.gov and create a myEDD account if you don't have one, then start a new UI claim. Few tips: - Don't overthink the employer section, just put your business name and your own name/address as employer contact info - For 'reason for separation' use 'lack of work' if business closure isn't explicitly listed as an option in your flow - After submitting you'll get a confirmation number - save that - You'll also need to register with CalJOBS (the state job search system) within 21 days
0 coins
Ravi Choudhury
AuthorWhat is CalJOBS exactly? Is that separate from the EDD claim process?
0 coins
Mateo Rodriguez
CalJOBS is California's job search database - you create a profile and it's tied to your unemployment claim to show you're actively looking for work. It's required for most claimants. You can find it at caljobs.ca.gov. It's annoying to set up but doesn't take more than 30-45 minutes.

Also make sure you understand the job search activity requirements. In California you need to complete 3 job search activities per week while claiming benefits. Keep a log because EDD can audit this.

omg same situation here literally just posted about this last week. closed my alterations shop in march. filed my claim and its been in adjudication for going on 5 weeks now. the waiting is killing me. at least i know im not alone in this

nothing. literally nothing. the status just says adjudication in progress. no letters, no calls, nothing
0 coins
StellarSurfer
This is unfortunately very common. The lack of communication from EDD during adjudication is a chronic complaint. You can try calling to get a status update but getting through is its own challenge.

For anyone stuck waiting like the person above - seriously try Claimyr (claimyr.com) if you need to actually talk to someone at EDD. The video demo is at https://youtu.be/JmuwXR7HA10. When my adjudication was dragging with zero communication I used it to get connected to an agent who pulled up my file and gave me an actual status. Found out they needed one more piece of info from me and hadn't even sent the notice yet. Would still be waiting otherwise.

One thing that trips up former business owners during the weekly certification process: you need to report ALL income earned during each week you certify, not just wages. If someone hires you for a consulting gig, a one-time job, anything - report it. EDD will deduct some of that from your benefit payment but you won't necessarily lose benefits entirely. Where people get in trouble is not reporting and then getting caught during an audit. The overpayment notices that result from that are a nightmare to deal with.

AuthorWhat if I do some odd jobs while looking for work? Like helping a friend move his equipment or something small like that?
0 coins
CosmosCaptain
Even informal income should technically be reported. EDD asks if you 'worked or earned any wages' during the week. Small amounts may reduce your benefit by a small amount but it's much better than having an unreported income issue later.

this tripped me up. did a small consulting thing for an old client without thinking, didn't report it, and ended up with an overpayment notice 8 months later. was not fun.

i keep hearing about how hard it is to qualify as a business owner but my cousin did it last year with no problems at all?? maybe it just depends on the agent you get
0 coins
StellarSurfer
It definitely varies by situation. The more clearly documented your case is (dissolved LLC, W-2 wage history, no continuing business activity) the smoother it tends to go. Your cousin probably had a clean-cut situation.

Freya Johansen
Also varies by how busy EDD is processing claims at any given time. When they have backlogs everything gets harder.

makes sense. i just wanted OP to know its not impossible lol

Just want to make sure people know - you HAVE to file your weekly certifications even while in adjudication. A lot of people think they should wait until adjudication is resolved to start certifying but that's wrong. File every week or you'll lose those weeks of benefits permanently. EDD doesn't backfill missed certification weeks.
0 coins
Ravi Choudhury
AuthorOh this is super important, thank you! So I should be certifying every week starting from when I filed the initial claim?
0 coins
Ethan Brown
Yes exactly. The UI Online system should prompt you when your certification is available each week. Do not skip weeks.

Aisha Hussain
WISH someone had told me this earlier. I missed two weeks because I thought I had to wait. Lost those payments.

This is one of the most common mistakes claimants make. Adjudication doesn't pause your certification requirement.

Random but can you file for unemployment if youre also applying for jobs in a totally different industry than what you did before? Like OP was in landscaping, can they apply for office jobs and still qualify
0 coins
CosmosCaptain
Yes absolutely. California doesn't require you to search only in your prior occupation. You're expected to seek suitable work, but as you gain time on unemployment the definition of 'suitable' broadens. An office job after running a landscaping business is totally reasonable.

Yuki Yamamoto
ok good to know. asking for a friend who is in similar situation lol

The job search just needs to be genuine. Actually applying, actually being available for interviews, etc. The industry switch itself isn't a problem at all.

For the OP and anyone else in this situation - when EDD does the eligibility phone interview, have all this stuff ready: - Date you last operated the business - Date you officially dissolved/filed paperwork - Your EIN if you have one - Name and address of the business - Approximate payroll records showing W-2 wages Having it all in front of you makes the call go faster and you sound credible. The interviewers are usually pretty fair if you're organized and honest.

EDD is honestly such a disaster for any non-standard situation. my adjudication took 4 months. FOUR MONTHS. and when i finally got through they approved me in literally 10 minutes. the review itself was nothing, the wait was everything. i was beside myself by the end of it
0 coins
Ravi Choudhury
Author4 months... that's terrifying. How did you survive financially during that time?
0 coins
Carmen Ruiz
honestly barely. had to borrow from family. EDD did pay all the back weeks when it finally resolved which helped but the stress during that time was extreme
0 coins
StellarSurfer
This is unfortunately real. The backlog problem is structural. Once you're in adjudication the outcome is often fine but the timeline is completely unpredictable.

can business owners get the full max weekly benefit or is it reduced because they were self employed
0 coins
Freya Johansen
The weekly benefit amount is calculated purely from your W-2 wages in the base period, not from your ownership status. So if your wages were high enough you'd get the same maximum benefit as any other W-2 employee with the same wage history. Ownership doesn't reduce the benefit amount.
0 coins
Luca Greco
oh interesting ok. so it all comes down to whether you had real payroll
0 coins
CosmosCaptain
Exactly. The SDI contribution on those wages is what creates the eligibility. No SDI = no UI. W-2 wages with proper withholding = full eligibility calculation.

update for anyone following this thread type of thing - i was in almost identical situation 3 months ago and my claim got approved after 7 weeks in adjudication. got back payments for all the weeks i certified during that time. so it does work out. key was the dissolution paperwork and being super clear in the interview that i had no plans to continue any business activity

for the job search requirements - i was confused about what counts as a 'job search activity.' its not just submitting applications. it can also include attending a job fair, creating a resume, doing an employment workshop, or contacting an employer even if they're not actively hiring. california gives you some flexibility there
0 coins
Ravi Choudhury
AuthorOh that's helpful. I've been updating my resume and going through online certifications so maybe some of that counts.

Came back to say I finally got through to EDD by using Claimyr (claimyr.com) - had been calling for almost two weeks straight with no luck. The video at https://youtu.be/JmuwXR7HA10 explains the process. Got connected to an agent who walked me through exactly what was needed to move my adjudication forward.
