EDD overpayment appeal hearing - timeframe for decision?

I had my EDD overpayment appeal hearing last week (Feb 10th) and I'm freaking out about how long it'll take to get a decision. The judge said he'd mail his decision but didn't say how long it would take. They're claiming I was overpaid $5,780 because I supposedly didn't report all my earnings correctly in 2024, but I definitely did! I've been stressing about this for months and just want it to be over. Has anyone gone through an appeal hearing for overpayment? How long did it take to get the decision letter after your hearing? I keep checking my mailbox every day and it's making my anxiety worse. Thanks in advance for any info!

I went through this last year. After my appeal hearing, it took almost exactly 4 weeks to receive the written decision in the mail. The Administrative Law Judge has to review all the evidence presented, write up detailed findings, and then it has to go through their processing system. Try not to stress too much (easier said than done, I know). In my case, they reversed about 70% of my alleged overpayment because I was able to provide proof of my income reporting attempts.

Thank you! 4 weeks seems like forever when you're waiting but at least that gives me a timeframe. Did you call them at all during that time or just wait? And did they email you the decision or just regular mail?

mine took 6 weeks to get back last summer and they still ruled against me even tho i had all my proof!! the whole system is rigged against us regular people. good luck but dont get your hopes up

That's not necessarily true for everyone. The appeals process actually has a pretty good success rate if you presented your case well and had documentation. I've seen statistics showing around 45-55% of overpayment appeals get at least partially reversed. Did you bring all your income reporting records and screenshots to your hearing?

That's definitely not normal. You should absolutely contact the Appeals Board office where your hearing was held. They should be able to tell you the status of your decision.

To answer your earlier question - no, unfortunately appeal decisions don't appear in your UI Online account. They strictly come through postal mail. This is different from regular EDD notices which sometimes show up in both places. That's why it's so important your address is current with both EDD and the Appeals Board (they're separate systems).

yeah he had all his pay stubs and showed some emails where he tried to contact edd about reporting issues but their website was down or something

While you're waiting for the decision, make sure you keep copies of ALL your documentation related to the case. If the decision doesn't go your way, you have 30 days to file a second-level appeal to the CUIAB Board itself (the first hearing is just with a single Administrative Law Judge). About 15-20% of first-level appeal decisions get modified or overturned at the Board level, so it's not over even if you get a negative decision. Also, if your overpayment was classified as "non-fraud," you can request a waiver for financial hardship even if you lose the appeal. This option isn't available if they determined there was willful misrepresentation, though.

This is really important info, thank you! They didn't say anything about fraud in my notice - it just said I "failed to report earnings" but didn't claim I did it intentionally. So maybe I could get a waiver if needed? I hope I win the appeal though.

For those following this thread with similar concerns, there are actually three possible outcomes of an overpayment appeal: 1. Full reversal - The overpayment determination is completely eliminated 2. Partial reversal - The overpayment amount is reduced 3. Affirmation - The original overpayment determination stands In addition, if you do receive an unfavorable decision, remember that EDD is required to offer reasonable payment plans for overpayment recovery. They can't demand the entire amount immediately if you can demonstrate financial hardship. Standard payment plans can be as low as $25 per month depending on your situation.
