EDD Appeal Hearing Results Timeline - How Long After Overpayment Appeal?
Had my overpayment appeal hearing with the judge on Wednesday and I'm freaking out about when I'll get the decision. The EDD claims I was overpaid $5,800 because they say I underreported some freelance income, but I KNOW I reported everything correctly. The judge seemed pretty fair during the hearing and I had all my payment records and 1099s ready. My friend said she got her results in 2 weeks, but someone else told me it can take months?? I really need this resolved ASAP because they've already started garnishing my current benefits by 25% each payment and I can barely cover rent. Has anyone gone through the appeal process recently? How long did it take to get your decision letter after the hearing?

I went through an overpayment appeal back in January. In my experience, it took exactly 10 business days to receive the decision by mail. The judge told us at the end of the hearing that decisions are typically issued within 7-14 days, but that some complex cases might take longer. If you provided all your documentation clearly showing you reported income correctly, that should help speed things up. They're required by law to make a decision within 30 days, but they usually don't take that long for straightforward cases.

The ALJ (Administrative Law Judge) is SUPPOSED to make a decision within 30 days but LOL don't count on it!!! When I had my appeal for a similar overpayment issue last year it took almost 7 WEEKS to get my decision in the mail. And guess what? They DENIED my appeal even though I had proof I reported everything!!! Had to file a second level appeal with the CUIAB board which took ANOTHER 2 months!!! The EDD system is BROKEN. They make "mistakes" that hurt us and then make it impossible to fix them!!! 😡

•YES finally won at the board level but it took FOREVER and the stress nearly gave me an ulcer!!! They even admitted the EDD representative made an error in calculating my earnings!!! But instead of apologizing they just quietly reversed the decision. RIDICULOUS!!!

Complex cases can take up to 30 days (that's their internal guideline) 3. By California law, they're supposed to issue all decisions within 30 days, but this isn't always followed in practice Regarding your 25% reduction - unfortunately, they'll continue to withhold funds until a decision is made in your favor. If you win your appeal, they'll refund any incorrectly withheld amounts, but there's no pause during the appeal process. Make sure you check your UI Online account daily - sometimes the decision appears there before you get the physical mail. Also, if it's been more than 14 days, you can call the Appeals Division directly at (916) 263-1796 to check on the status.

I think it depends on which office handled your appeal and how complex your case is. I had an overpayment appeal hearing in November for a smaller amount (about $2,100) and got my decision in exactly 8 days. My partner had one for a larger amount with more documentation and it took just over 3 weeks. Did the judge say anything at the end of your hearing about when to expect the decision? Sometimes they'll give you a general timeframe.

•The judge just said I'd receive the decision "as soon as possible" which wasn't very helpful. I'm worried because my case had a lot of documentation - 1099s from three different clients plus my original certification screenshots. Maybe that will make it take longer to review everything?

It's one of the most frustrating aspects of the appeal process, but it is legal under California unemployment regulations. Just got my appeal decision yesterday for an overpayment issue with EDD. My hearing was on February 6, so it took exactly 16 days to get the decision in the mail. The letter was dated February 15 though, so it seems like they made the decision in about 9 days but then it took another week for mail delivery. Check your mailbox carefully - the envelope looks pretty ordinary and I almost thought it was junk mail!

Update: Got my decision in the mail today! That's 13 days after the hearing. The judge ruled in my favor and found that I had correctly reported all my income! They're cancelling the overpayment and will refund the money they've been deducting from my payments. So relieved this nightmare is over. Thanks everyone for your help and support!
