Do I need a separation notice to file for California EDD unemployment?
So I got laid off from my warehouse job about two weeks ago and I'm trying to figure out what documents I actually need to file for unemployment. My HR department said they'd send me a separation notice but I haven't received anything yet and I'm kind of panicking about getting my claim started. Do I actually need a separation notice to file for California EDD unemployment benefits, or can I just go ahead and submit my claim without it? I don't want to delay any longer because I know there's already a waiting period built in. My last day was technically the 14th and I've just been sitting here waiting on this paperwork before I do anything. Someone at my old job told me you absolutely need it but another coworker said they filed without one just fine. Really confused about what the right move is here.

You do NOT need a separation notice to file your California EDD unemployment claim. Go file right now at UI Online. The separation notice is something your employer is required to give you but EDD doesn't require you to upload it to start your claim. You'll just answer questions about your separation during the filing process and EDD will contact your former employer to verify the reason for separation on their end.

AuthorOh wow okay that's a huge relief. So I can literally just go file today without waiting on that paperwork?

This is correct. I filed my claim the same day I was let go and nobody asked me for any separation documents at the intake stage. The claim just asked why I was no longer employed and I explained it was a layoff.

Yep just file ASAP. Every day you wait is money you're potentially leaving on the table. California EDD does have a one week unpaid waiting period but that clock doesn't start until you actually file and certify.

The separation notice question trips up a LOT of people. Here's what actually matters for your California EDD claim: California law requires employers to give you a Notice to Employee as to Change in Relationship form (DE 2320) when you're separated. But that's on your EMPLOYER to provide, it's not something you submit to EDD when filing. When you go through UI Online to file, you're just asked to describe your separation circumstances. EDD then does their own outreach to the employer. The separation notice can be useful if your employer tries to dispute the nature of your layoff later, so keep it when you get it.

AuthorWait so the DE 2320 is a real specific form? My HR never mentioned that form name at all they just said separation notice generically.

Sebastian Scott
Yes the DE 2320 is the official California form. In practice a lot of employers just use their own internal paperwork or a letter on company letterhead that says the same thing. Either way hold onto whatever they send you.

didn't even know that form existed when i filed last year lol, just answered the online questions and got approved no problem

Filing right away is definitely the move. I waited almost three weeks thinking I needed more documentation together and it ended up delaying my first payment significantly. One thing I'd add - when you DO get that separation notice, scan and save a digital copy somewhere safe. If your claim ever goes to adjudication because your employer pushes back on the reason for separation, having that documentation becomes really valuable. But for getting the initial claim submitted, you just need your employment history, Social Security number, and bank info for direct deposit.

AuthorThat's a good point about adjudication. My layoff was a mass layoff situation so hopefully there won't be any dispute but better to be prepared.

Mass layoffs are usually the cleanest claims honestly. When a whole department or facility gets cut it's harder for employers to dispute. Your adjudication risk is probably pretty low.

Okay real talk - file your claim today. Don't wait another hour. But I also want to mention something that saved me a ton of headache when I had questions during my claim process. I used a service called Claimyr (claimyr.com) to actually get through to a live California EDD agent on the phone when I had questions about my claim status. There's a video showing how it works at https://youtu.be/JmuwXR7HA10 - basically helps you skip the nightmare hold times and busy signals. I had a question about documentation and the EDD agent cleared it up in like 10 minutes once I actually got someone on the line. EDD's phone system is brutal to navigate on your own.

AuthorI've heard EDD is nearly impossible to reach by phone. Is Claimyr legit? I might need this if my claim gets complicated.

100% legit, I was skeptical too but it actually worked. Got connected to a real EDD rep who answered my questions directly. Way better than spending half a day redialing.

I've heard of this. Friend used it when her claim got stuck in adjudication and she said it was worth it just to get a human on the phone who could actually see her account.

DONT WAIT FOR THE SEPARATION NOTICE!! I made this exact mistake and lost almost 3 weeks of potential benefits because I thought I needed it first. California EDD back-dates to when you FIRST became unemployed but only if you file within a certain window. Just get that claim in. The separation notice situation gets sorted out separately.
0 coins
Alicia Stern
AuthorWait does EDD actually backdate? So even though I've been waiting 2 weeks I might still get benefits for those weeks?
0 coins
Gabriel Graham
Yes when you file they ask for your last day of work and they establish your benefit year from that date. So even filing now you'd indicate your actual last day of work was the 14th and those weeks would be included.
0 coins
Mason Kaczka
yes exactly that's why filing fast matters but also filing ACCURATELY matters. make sure you put in your actual last day worked not the day you're filing

To add some clarifying info here since this thread is covering a lot of ground: there are really two separate things happening. First is filing your initial claim on UI Online - no separation notice needed, just your personal info and employment history. Second is the certification process which starts the week after you file - that's where you're reporting job search activities and confirming your availability each week. Both of those can happen completely independently of whether your former employer has given you any paperwork. The separation notice is essentially just for your own records and potential dispute resolution.

Sophia Russo
This is the clearest explanation in this whole thread. OP this is what you need to know.
0 coins
Alicia Stern
AuthorThank you for laying it out that cleanly. So I file initial claim now, then next week I start doing the weekly certifications?
0 coins
Sarah Jones
Exactly right. Your first certification will typically be available about 2 weeks after your initial filing. EDD will send you notice about when to certify. In between, make sure you're tracking your job search activities because you'll need to report those.

Something nobody mentioned yet - when you file online they DO ask you to describe your separation in your own words. Make sure you're clear that it was a layoff and use the word layoff specifically. Don't say things like 'the company had to let some people go' or vague stuff like that. Be direct: laid off due to reduction in workforce or whatever the actual reason was. This affects how quickly your claim gets processed.
0 coins
Alicia Stern
AuthorThat's actually really helpful. I was going to just describe it casually but being specific makes sense.
0 coins
Sebastian Scott
100% this. Specific language matters in the EDD system. Layoff, reduction in force, position eliminated - these all signal to the system that this is a straightforward claim. Vague or ambiguous descriptions can trigger additional review.

I put something vague on mine and it definitely took longer to process. Learn from my mistake lol

ugh this whole thread is bringing back my california edd trauma lol. I spent like 4 days trying to get through on the phone just to ask a simple question about whether my claim was processing. Kept getting the 'we are experiencing high call volume' message and getting disconnected. Finally a friend told me about Claimyr at claimyr.com and I actually got through to someone. They could see my claim in the system and told me everything was fine just processing normally. Would have saved me SO much anxiety if I'd known about it sooner. Check out https://youtu.be/JmuwXR7HA10 if you want to see how it works before your claim gets complicated.

AuthorIs it hard to use? I'm not super tech savvy and the whole EDD online system is already kind of overwhelming me.

Can I jump in with a related question? I'm in a slightly different situation - I was told my position was being eliminated but my employer is calling it a voluntary resignation because I technically signed something during a restructuring meeting. Does the separation notice situation change for me? Or same deal where I just file and describe what happened?
0 coins
Sebastian Scott
File immediately and describe what happened as accurately as possible. What you're describing sounds like it could be a constructive dismissal situation which is more complicated than a straightforward layoff. EDD will investigate the circumstances. The separation notice would be especially important to keep in your situation since the employer's characterization may differ from yours.
0 coins
Gabriel Graham
Whatever you do don't let the employer framing of 'voluntary resignation' stop you from filing. EDD makes their own determination of whether a separation was voluntary or involuntary based on the circumstances. You have the right to file and let EDD decide.

Ok filing today then. Thank you. This is nerve wracking.

Just want to circle back on the original question one more time because I keep seeing people in real life make this mistake: the separation notice (DE 2320) is actually a document your employer is LEGALLY required to give you at separation in California. If they haven't given you one, they're technically in violation of California labor law. You could report that to the Labor Commissioner separately. But again - doesn't affect your ability to file for UI benefits at all. File now, chase down the notice separately if you want it.
0 coins
Alicia Stern
AuthorI had no idea employers were legally required to provide it. That's actually useful to know. I might follow up with HR about that.
0 coins
Drake
Yep it's required at time of separation not weeks later. Your HR department dropped the ball on that.
0 coins
Evelyn Xu
Whether you report them for it is your call but definitely mention to HR that you're still waiting. Sometimes it's just an oversight not malicious. Other times... employers definitely try to delay paperwork hoping people don't realize what they're entitled to.

Filed my claim last month after getting laid off from a tech company and the whole process was way smoother than I expected honestly. Did it all online, no separation notice needed, had my benefit determination letter within about 10 days. The weekly certification process is the thing that requires the most attention - make sure you're completing those on time and keeping your job search log current. California EDD requires you to contact a certain number of employers per week as part of your job search requirements.
0 coins
Alicia Stern
AuthorHow many employers per week? I haven't seen that number anywhere yet.
0 coins
Sophia Russo
It's three job search activities per week. This can include submitting applications, attending job fairs, doing interviews, etc. Keep a log with dates, company names, positions, and contact methods. EDD can audit this at any time.
0 coins
Sarah Jones
Three activities per week is correct. And they have to be legitimate activities - you can't just write down that you googled job listings. Actual applications, interviews, networking events, things like that.

Has anyone dealt with an employer who submitted incorrect information to EDD after a layoff? My previous employer told EDD I was let go for performance reasons which was completely false - it was a budget cut that eliminated my whole team. My claim went to adjudication because of the discrepancy and it was a whole ordeal. I eventually got approved but it took forever. In that situation having the separation notice with the actual reason stated in writing was crucial.
0 coins
Alicia Stern
AuthorThis is exactly what I'm worried about. My manager and I didn't end exactly on the best terms even though it was definitely a company-wide layoff.
0 coins
Natalie Adams
Start documenting now. Email correspondence, any company announcements about the layoffs, anything in writing that establishes this was a company decision and not performance related. If you have coworkers who were also laid off at the same time, their contact info could be useful too.
0 coins
Sebastian Scott
Also if it goes to adjudication and you need to talk to EDD to clarify your side, that's when being able to actually reach someone by phone matters a lot. I've heard Claimyr (claimyr.com) is really useful in adjudication situations specifically because you need to actually talk to a human not just wait for letters.
0 coins
Natalie Adams
Yeah the phone access thing during adjudication is real. I spent two weeks just trying to get confirmation that my appeal had been received. Being able to talk to an actual EDD agent would have saved me so much stress.

ok random but what's the difference between the separation notice and the Notice of Unemployment Insurance Award letter? i got confused between these when i filed and wasn't sure which was which
0 coins
Gabriel Graham
Very different documents. Separation notice (DE 2320) comes FROM your employer and documents why your employment ended. The Notice of Unemployment Insurance Award is from California EDD and tells you how much your weekly benefit amount will be and how long you're eligible. One comes before your claim, one comes after EDD processes it.
0 coins
Emily Sanjay
ohhhh ok that makes way more sense. I definitely got confused about these when I filed.
0 coins
Jordan Walker
This is a really common point of confusion. There are so many documents flying around when you get laid off and start a claim. Employer side: separation notice/DE 2320. EDD side: award notice, then later your EDD debit card, then weekly certification reminders.

The CalJOBS thing tripped me up when I filed. You're supposed to register on CalJOBS as part of your job search requirements and I completely forgot about it initially. Then EDD sent me something saying my benefits could be affected if I didn't register. Just mentioning this because nobody brought it up yet - it's a requirement that catches people off guard.
0 coins
Alicia Stern
AuthorOh I had no idea CalJOBS registration was required. What is that exactly?
0 coins
Olivia Van-Cleve
It's California's job seeker database. You create a profile and it counts as part of your job search requirements. It's free, you just go to caljobs.ca.gov and create an account. Your EDD paperwork should mention it but easy to miss.
0 coins
Sarah Jones
CalJOBS registration is technically required within the first few weeks of your claim. Some claimants get letters about it, some don't but it's still a requirement. Definitely do it early in your claim period.
0 coins
Sophia Russo
I registered on CalJOBS day one just to check that box. The site itself isn't great but it only takes like 20 minutes to set up a basic profile.

Going back to documentation for a second - I'd recommend creating a folder (physical or digital) specifically for your unemployment claim and keeping everything in it. Separation notice when it arrives, your EDD claim confirmation number, copies of your weekly certification submissions, your job search log, any letters EDD sends you. If anything goes sideways with your claim you'll have everything in one place. Claims can sometimes get complicated months after you think everything is settled.

Alicia Stern
AuthorThis is good advice in general. I've already started a folder but I should be more systematic about it.

OP I want to make sure you actually go file today after reading all this. The core answer to your question: NO you do not need a separation notice to file for California EDD unemployment. File at unemployment.edd.ca.gov right now using UI Online. Have your Social Security number, employment history for the past 18 months, and bank account info ready. The whole initial filing takes maybe 30-45 minutes. Don't let the separation notice situation delay you even one more day.

One more thing for anyone finding this thread later: the separation notice question comes up a lot because employers often make it seem like you can't do anything until they give you paperwork. Sometimes that's unintentional, sometimes they're trying to slow down your ability to file. California EDD does not require any documentation from your employer to initiate a claim. The claim process begins with your self-reported information and EDD handles employer verification separately. Don't let paperwork delays stop you from filing.

This needs to be pinned at the top of every EDD help forum honestly. So many people delay filing because they're waiting on their employer for something.

Agreed. And if anyone ever has questions about their claim status after filing and can't get through to EDD by phone, using Claimyr at claimyr.com to connect with a live agent really does work - saw the demo at https://youtu.be/JmuwXR7HA10 before I tried it and it was exactly what they showed. Sometimes you just need to talk to a real human who can actually see your claim in the system.
