Can I work part time and still get California EDD unemployment benefits?
So I got laid off from my full time job at a logistics company about a month ago and I just started picking up some part time shifts at a friend's restaurant to help cover bills while I keep job searching. Someone told me I might still qualify for partial unemployment benefits through California EDD but I honestly have no idea how that works. Like do I just lose my benefits completely if I'm earning anything at all? Or does EDD reduce what they pay me based on what I make? I'm scared to even report the hours because what if they just cut me off entirely. I filed my initial claim two weeks ago and I'm still waiting on approval so I haven't even gotten my first payment yet. Anyone dealt with this situation before? I really don't want to mess up my claim by doing something wrong but I also can't just sit around with zero income.

Yes you can absolutely work part time and still collect unemployment in California - this is called partial unemployment and it's totally legitimate. Here's how it works: California EDD uses something called the earnings disregard rule. You can earn up to 25% of your weekly benefit amount (WBA) without any reduction in benefits. For every dollar you earn ABOVE that 25% threshold, EDD deducts a dollar from your weekly payment. So you're not just getting cut off - you get a reduced payment instead. The key thing is you MUST report all earnings during the week you EARN them (not when you get paid). When you certify each week on UI Online, there's a section where you enter your gross wages. Do not skip this or underreport. That's how people end up with overpayment notices months later.

Authorok so if my weekly benefit is like $400, i can make up to $100 at the restaurant without losing anything? and then after that it's dollar for dollar reduction?

Lola Perez
Exactly right. $400 x 25% = $100 earnings disregard. So if you make $150 that week, EDD subtracts $50 from your $400 benefit, and you'd receive $350. You'd still come out ahead compared to just working part time alone.

This is correct. Just want to add - if your part time earnings in a given week EXCEED your weekly benefit amount, EDD won't pay you anything for that week. But your claim stays active and you just certify $0 for that week. Your remaining benefit balance doesn't disappear.

PLEASE report every penny you earn, I can't stress this enough. My cousin didn't report like $300 he made doing some side work and EDD caught it through wage cross-matching with the EDD tax records. He ended up with an overpayment notice for over $2,000 plus a fraud penalty on top of that. The restaurant will report your wages to the state - EDD WILL find out. It's not worth it.

Authoryeah that's what I'm worried about, I don't want to accidentally commit fraud by not understanding how to report things correctly

As long as you're honest on your weekly certifications you'll be fine. The fraud cases happen when people deliberately hide income, not when they're trying to do things right and make an honest mistake. If you DO mess up a certification you can call EDD to correct it.

For the calling EDD part - I was in a similar situation where I had questions about reporting part time work and couldn't get anyone on the phone for like 10 days. A friend told me about Claimyr (claimyr.com) and it actually got me connected to a live EDD agent within a couple hours. There's a video demo at https://youtu.be/JmuwXR7HA10 that explains how it works. I was skeptical but at that point I just needed answers and it saved me a ton of stress. Would recommend if you're going in circles trying to reach someone at EDD.

wait so does this apply if youre doing gig work too? like if im doordashing while on unemployment do i have to report that income the same way
0 coins
Lola Perez
Yes - all earned income must be reported regardless of the source. Gig work, freelance, cash jobs, part time W-2 work, all of it. EDD asks specifically about this on the weekly certification. The same 25% disregard rule applies.

ugh ok. what about tips? do tips count as earnings
0 coins
Nathaniel Stewart
Yes tips absolutely count as gross earnings and must be reported. Report your total gross earnings including tips for each week you certify.

Something important OP didn't mention that I want to flag - you also need to make sure you're still meeting the able, available, and actively seeking work requirements even while working part time. EDD requires you to complete a minimum of three job search activities per week and log them. Working part time doesn't exempt you from job search requirements unless your employer has placed you on a temporary layoff and you're on standby status - which is a different situation entirely. Make sure you're keeping a job search log with dates, employer names, contact info, and what type of contact you made.

Ethan Scott
Authoroh I didn't realize I still had to do the job search activities. I've been doing them anyway but didn't know it was required

Riya Sharma
Yeah EDD can audit your job search records at any time. Keep detailed logs. CalJOBS registration is also required within 21 days of filing if I remember correctly.
0 coins
Nathaniel Stewart
That's right on the CalJOBS requirement. You should have received a notice about it. Go to caljobs.ca.gov and create a profile if you haven't already. EDD can flag your claim if this isn't completed.

honestly the whole partial unemployment thing sounds great in theory but my experience was that EDD kept screwing up my reported wages anyway. I reported everything correctly three certifications in a row and they still sent me a notice saying I hadn't reported wages from my part time job. I had to get it corrected and it took FOREVER. The system is broken.

Authorthat sounds like a nightmare, how did you eventually get it sorted out

had to call in and speak to an agent who could see my certification history and the wages I'd reported. they fixed it on their end. took like 3 weeks total to resolve

This is exactly why being able to actually reach an EDD rep matters so much. For anyone struggling to get through on the phones, claimyr.com was what finally worked for me - connects you to a live agent without spending days redialing. Genuinely useful when you have something like this that needs a human to fix.

I went through the exact same situation last spring, laid off from full time, picked up part time retail shifts. What tripped me up at first was not knowing WHEN to report earnings. You report wages in the week they are EARNED, not the week you actually receive the paycheck. So if you worked Tuesday through Saturday of a certification week, you report all those earnings for that week even if payday is the following Friday. This confused me for my first two certifications and I had to go back and amend them.

Authorthis is super helpful actually, I was assuming it was based on when the money hits my account. good to know

Yeah EDD is really clear about this in the certification questions actually - they say 'did you work and earn wages this week' not 'did you receive payment' - but it's still confusing when you first start

does it matter if you're paid weekly vs biweekly for this? like what if your paycheck covers two certification weeks

just here to confirm this works, I've been doing part time work + collecting partial UI for about 3 months now. as long as you report accurately every week it's totally fine and legal. just keep your earnings under your WBA if you can so you still get something from EDD

honestly the EDD website FAQ about partial unemployment is pretty detailed if you search for it. worth reading through before your first certification so you know what to expect
0 coins
Santiago Diaz
what happens to your claim if one week you make MORE than your WBA from part time work? does that disqualify you going forward or just for that week
0 coins
Lola Perez
Just for that week. Your claim stays open, your remaining benefit balance is preserved, and you simply don't receive a payment for that week. You still need to certify for that week and report your earnings accurately - do not skip certifications even if you know you'll get $0.
0 coins
Santiago Diaz
ok that's a relief I was worried it would reset my claim or something
0 coins
Nathaniel Stewart
And to add - if you have several high-earning weeks in a row, EDD may send you a letter asking about your job search activities to confirm you're still genuinely seeking full time work. Just make sure your job search logs are up to date.
0 coins
Debra Bai
Wait I'm confused about something - if OP is still waiting on their initial claim to be approved does the part time work affect whether they get approved at all? Like could reporting income cause them to get denied?
0 coins
Lola Perez
No - the eligibility decision for initial approval is based on your base period wages and the reason for separation from your full time job. Earning income from a NEW part time job after you filed doesn't affect whether you qualify. It only affects the payment amount for the weeks you work. These are two completely separate determinations.
0 coins
Debra Bai
ok that makes way more sense, I was confusing the initial eligibility with the weekly certification process

omg I've been reporting my earnings wrong this whole time I think. I've been reporting the NET amount after taxes are taken out not the gross amount. is that a big deal
0 coins
Nathaniel Stewart
You need to report gross earnings - that's your pay before any deductions including taxes, health insurance, etc. If you've been reporting net you've been underreporting and that could technically result in an overpayment. I would call EDD to discuss correcting your past certifications sooner rather than later. Proactively correcting this is always better than EDD finding it during an audit.
0 coins
Laura Lopez
okay I'm spiraling a little. how far back can EDD go to audit this
0 coins
Riya Sharma
Don't panic but do address it. EDD can technically go back to the beginning of your claim. Call them to get ahead of it. If you genuinely made an honest mistake and correct it voluntarily the consequences are much less severe than if they catch it themselves.

the 25 percent disregard rule is pretty recent right? I feel like it used to be different
0 coins
Nathaniel Stewart
California updated the earnings disregard from a flat $25 to 25% of your weekly benefit amount in 2021. So yes, it changed. The current 25% rule is more generous for most claimants than the old flat deduction was. The dollar-for-dollar reduction above the disregard amount hasn't changed though.

nobody ever talks about this but the stress of trying to figure all this out while also job searching and picking up shifts and worrying about money is genuinely exhausting. One more thing I'll add for OP and anyone else in this situation - if your claim is still pending approval and you have questions about the timeline, EDD's online portal (UI Online) sometimes doesn't show the full picture of what's happening with your claim. If you need to actually speak to someone to find out where things stand, the phone situation is genuinely terrible right now. Claimyr at claimyr.com got me through to an agent when I was in adjudication limbo - they have a video showing how it works at https://youtu.be/JmuwXR7HA10. Just mentioning it because waiting around not knowing what's happening with your claim while also navigating the part time earnings stuff is a lot to deal with at once.

Authormy claim has been pending for 16 days now and UI Online just says 'pending' with no explanation. definitely going to try this
0 coins
JaylinCharles
yeah the UI Online portal is pretty useless for getting actual information about claim status. it's basically just a certification interface
0 coins
Victoria Brown
16 days isn't unusual but I'd start pushing for answers around 3 weeks. some pending statuses are just processing delays but others are actual adjudication holds that need human intervention to move forward

something I wish someone had told me - keep records of EVERYTHING. Screenshot your certifications after you submit them. Save confirmation numbers. Keep a spreadsheet of what you reported each week, what you were paid, what your part time earnings were. If EDD ever questions anything you'll be so glad you have documentation.
0 coins
Ethan Scott
Authorthis is great advice, starting a spreadsheet right now actually

also screenshot the questions EDD asks during certification because they sometimes change the wording slightly and it's useful to have a record of exactly what was asked

the 'print confirmation' option at the end of your certification is also useful - save those as PDFs

slightly off topic but does anyone know if there's a limit to how many weeks you can collect partial unemployment? like can you just be in this half employed situation indefinitely
0 coins
Lola Perez
Your regular UI claim in California has a maximum of 26 weeks of benefits within your benefit year (which is 52 weeks from your filing date). This 26-week cap applies regardless of whether you're collecting full or partial benefits. Each week you collect - even a partial payment - counts as one of your 26 weeks. Weeks where you earn over your WBA and receive $0 do NOT count against your 26 weeks.
0 coins
Eloise Kendrick
oh interesting so I should actually try to work more in weeks where I'd barely get any benefit anyway to preserve my claim weeks
0 coins
Nathaniel Stewart
That's actually smart math. If you're going to have a high-earning week and you'd get a very small benefit anyway, it might be worth picking up extra shifts that week to save a claim week for later when you might need it more.

I work part time and collect unemployment and the thing that always gets me is the timing of the certification weeks. EDD's weeks run Sunday to Saturday. If your work schedule crosses over into different certification weeks you have to split your earnings by which week they were earned. Pain in the neck when your employer pays biweekly.
0 coins
KaiEsmeralda
yes this is so annoying. I keep a running daily tally of what I earn each day so I can accurately split it between certification weeks when needed
0 coins
Lucas Schmidt
same, daily tally is the only way. my employer couldn't care less about EDD's certification calendar lol

AuthorI didn't even think about this. my shifts are usually contained within one week but I can see how this would get complicated

Has anyone dealt with EDD questioning your job search activities when you're doing part time work? Like do they give you any leeway on the number of contacts required since you're already technically working?
0 coins
Nathaniel Stewart
No leeway unfortunately. Three job search activities per week is the standard requirement unless you're on approved standby status. Working part time doesn't reduce this requirement. EDD's position is that you're still underemployed and should be actively seeking full time employment.
0 coins
Freya Collins
that seems like a lot when you're already working part time shifts and trying to balance everything
0 coins
Riya Sharma
It is a lot but the job search activities don't all have to be formal applications. Things like attending a job fair, creating or updating a resume, setting up job alerts, registering with a staffing agency - these can count depending on the activity type. Check the full list of qualifying activities on the EDD website.

Quick practical tip - when you're doing your weekly certification and it asks about your earnings, enter your gross wages for the week BEFORE you get to the job search questions. EDD's UI Online interface can be a little clunky and sometimes people get confused about the order of the questions and either skip something or enter it in the wrong field. Just take it slow, read each question carefully, and don't rush through it.
