Can I collect unemployment if my hours are reduced in California?
So my manager called me in last week and told me they're cutting everyone's hours starting next pay period. I went from a guaranteed 40 hours a week to somewhere between 18-22 hours depending on 'business needs' — which basically means I have no idea what my paycheck is going to look like from week to week. I've been with this company for almost 4 years and this came out of nowhere. A coworker mentioned I might be able to file for partial unemployment through California EDD since I'm not fully laid off, but I honestly have no idea how that works or if I even qualify. Like do they look at how much I'm making now vs before? Is there a minimum reduction required? I don't want to file and then get flagged for fraud or something if I'm not actually eligible. Has anyone dealt with a situation like this before with California EDD? Really stressed about making rent next month.

Yes you absolutely can file for partial unemployment benefits through California EDD when your hours are reduced. This is actually one of the most common situations EDD handles. The program is sometimes called 'partial claims' or partial UI. Here's how it generally works: EDD compares your current weekly earnings to your base period wages to determine if you qualify. As long as you're earning less than your weekly benefit amount (WBA) plus $25 or 25% of your WBA (whichever is higher), you can still receive some unemployment benefits. So even working reduced hours you could get a partial payment to make up some of the difference. You do need to report ALL earnings each week when you certify — do not skip that step or you risk an overpayment situation later.

AuthorThank you this is really helpful. So I still file weekly certifications even though I'm still employed? That part confuses me a bit.

Exactly right. You file weekly certifications just like someone who is fully unemployed, but you report your actual hours worked and wages earned each week. EDD then calculates whether you get a partial benefit payment for that week. It's a little tedious but very doable.

this is correct, I went through this exact situation about 8 months ago when my job cut me from full time to part time. partial UI is real and it helped a lot

Just to add some important info here — when you file your initial claim with California EDD for reduced hours, make sure you select the right reason for filing. You're NOT fully unemployed, you're still working but with reduced hours. There's a specific option for this in the online filing process on UI Online. If you accidentally file as fully unemployed when you're still working, that can cause adjudication issues and delays. Pick the option that reflects your actual situation accurately.

AuthorOh wow I did not know that, I almost would have just clicked 'laid off' since that's the most obvious option. Good to know there's a specific category for this.

Same thing happened to me, I picked the wrong reason at first and it caused my claim to go into adjudication for like 2 weeks while they sorted it out. Definitely pick the correct option from the start it saves so much time

does it matter what industry ur in for partial claims or is it the same process for everyone

I had a reduced hours situation with California EDD last year and honestly getting through to someone on the phone to ask questions was a nightmare. I kept getting the 'we're experiencing high call volume' message and then getting disconnected. What finally worked for me was using Claimyr — it's a service that basically holds your place in the phone queue and calls you back when an EDD agent is available. Saved me probably 3 days of constant redialing. Their site is claimyr.com and they have a demo video at https://youtu.be/JmuwXR7HA10 that shows exactly how it works. When you're stressed about income and have questions about partial UI eligibility it's way better than spending all day on hold.

AuthorI've never heard of that before, does it actually work? I've been trying to get through to EDD for two days already and it's so frustrating.

Yes it genuinely worked for me. I was skeptical too but I got a callback from an actual EDD agent who answered all my questions about reporting my reduced hours earnings correctly. Way better than hitting redial 400 times.

wait i'm confused, if ur still working are you even allowed to file?? I thought unemployment was only for people who lost their jobs completely. my friend told me you can't get it if you're still employed

This is a really common misconception! California EDD absolutely allows partial unemployment claims for workers whose hours have been significantly reduced. You don't have to be fully laid off. The key is that your earnings must fall below a certain threshold relative to your weekly benefit amount. Lots of people don't know about this and miss out on benefits they're entitled to.

oh wow I had no idea, I probably left money on the table when my hours got cut a couple years ago then 😭

Yeah partial UI is definitely a real thing. My whole department got cut to part time and half of us filed partial claims. EDD even has a specific section on their website about it.

The way the earnings calculation works with partial California EDD unemployment: your Weekly Benefit Amount gets established when you first file based on your highest earning quarter during your base period. Then each week you certify, EDD takes your earnings for that week, subtracts the disregard amount (which is $25 or 25% of your WBA, whichever is larger), and then reduces your benefit payment by whatever's left. So you still come out ahead compared to just working the reduced hours with no UI benefit. It's worth filing even if the partial amount seems small because every bit helps when your income drops unexpectedly.

AuthorSo if my WBA ends up being like $400/week and I earn $200 working reduced hours, roughly how much would I get from EDD on top of that?
0 coins
Diego Mendoza
Using rough numbers: 25% of $400 WBA = $100 disregard. Your $200 earnings minus $100 disregard = $100 reduction. So your EDD payment would be about $300 that week. On top of your $200 wages that's $500 total vs just the $200 you'd have without filing. Definitely worth it.

This math is basically right. The disregard calculation is the part most people don't understand and why some people think partial UI isn't worth filing for when it actually is.

I went through reduced hours with California EDD and the thing nobody told me is that your employer might already have a Work Sharing program set up which is slightly different from filing a regular partial UI claim on your own. Work Sharing is when the employer files the claim on behalf of all affected workers. If your company has more than just you getting reduced hours it's worth asking HR if they've looked into the Work Sharing program because it can be easier and faster than everyone filing individually.
0 coins
Ravi Choudhury
AuthorI had no idea the Work Sharing program existed. I'll definitely bring this up with HR — there are probably 15-20 of us with cut hours.

Chloe Wilson
Yes exactly, for that many employees Work Sharing makes a lot of sense. The employer coordinates with EDD and the process is more streamlined. Look up 'California EDD Work Sharing Program' and you can find the details to share with HR.

Work Sharing is underrated, I wish my employer had done it instead of making everyone file separately. It took forever to sort out my individual partial claim

does work sharing affect your total benefit weeks the same way regular UI does?

CAN SOMEONE EXPLAIN why EDD makes this so complicated?? I went through reduced hours last year and I spent weeks just trying to figure out what forms to file, how to report earnings correctly, whether I'd get flagged for fraud — it's incredibly stressful when you're already dealing with a pay cut. The instructions on the EDD website are written like legal documents and the phone line is basically useless. I finally got through to someone after using Claimyr (claimyr.com) which at least solved the phone access problem, but the whole system should be a lot more user friendly for people in legitimate need.

AuthorYep the EDD website language is really dense. I've been reading the same FAQ page for like an hour and I still have questions.

The worst part is when you finally get through on the phone the agent actually explains things clearly in like 5 minutes. It's just getting to that agent that's the brutal part. Hence why Claimyr was a lifesaver for me.

CosmosCaptain
The complexity is frustrating but to EDD's credit the partial UI program does exist and does pay out — the system works once you understand it. The access issue is the bigger problem.

One thing to be aware of: when you file your initial claim for reduced hours partial UI, EDD will look at your base period to establish your weekly benefit amount. Your base period is typically the first four of the last five completed calendar quarters before you file. If you've been with your employer 4 years your wages should be well documented and establishing your claim shouldn't be an issue. Just make sure your employer has been reporting your wages correctly to the state.

Ravi Choudhury
AuthorHow do I verify that my employer has been reporting correctly? Is there somewhere I can check?
0 coins
Freya Johansen
When you file your EDD claim online it will pull your wage records. If the amounts look way off you can contact EDD to report a discrepancy. Usually it's fine for long-term W2 employees but good to double check.

Omar Fawzi
Also worth noting — if you have any weeks where you work zero hours due to business slowdowns during this period, those full weeks of no work can be claimed at your full WBA rather than a partial amount. So keep track of any weeks you're not scheduled at all.

just wanted to say I was in almost the exact same boat six months ago, went from 40hrs to like 20hrs overnight and thought I was just stuck with the pay cut. Wish someone had told me earlier that partial UI was an option. Filed my claim, got approved, it wasn't the full benefit obviously but it covered my car payment every month while things were slow. Definitely file OP, you have nothing to lose by applying.

AuthorThis is really reassuring to hear from someone who actually went through it. Did the process take long to get approved?

For me it took about 2 weeks from filing to first payment. I didn't have any adjudication issues because I picked the right filing reason from the start. Some people have longer waits if there are complications.

Same experience here, about 2 weeks. Though a friend of mine had adjudication issues that dragged it out to almost 6 weeks. Hoping OP has a smooth one.

Small but important thing — when you certify each week and report your wages, report the gross wages (before taxes) for the week you WORKED them, not when you got paid. This trips a lot of people up with partial UI claims and can cause overpayment issues down the road if you do it wrong.
0 coins
Ravi Choudhury
AuthorWait really? So if I work Monday through Friday of one week but don't get paid until the following Friday, I report those wages in the first week's certification?
0 coins
StellarSurfer
Exactly. Report wages in the week the work was performed, not when the paycheck arrives. EDD is very specific about this and it matters for their calculations.

Diego Mendoza
This is correct and it's one of the most common mistakes people make with partial UI. Reporting wages in the wrong week creates overpayment notices later and those are a whole headache to deal with.

Does anyone know if California EDD can contact your employer when you file a partial claim for reduced hours? Like will my manager find out I filed? I'm a little worried about retaliation even though I know that's technically illegal.
0 coins
CosmosCaptain
EDD does notify employers when a claim is filed — they send a notice asking the employer to verify your wages and separation/reduction reason. However, you have legal protections against retaliation for filing a valid UI claim. That said, your manager will likely be aware at some point. It's unfortunately part of how the verification process works.

For what it's worth, with a large group of employees all getting hours cut, it's pretty obvious to the employer that multiple people might file. They kind of already know what they triggered when they made the cuts.

My situation is slightly different — my hours weren't cut but my pay rate was reduced. Same number of hours but lower hourly wage. Does California EDD partial unemployment still apply in that scenario? Or is it only for actual hour reductions?
0 coins
Diego Mendoza
Interesting question. Technically EDD partial UI is based on your weekly earnings, not hours specifically. So if a wage rate reduction drops your weekly earnings significantly it could potentially qualify you, but the threshold requirements still apply. You'd want to compare your new weekly earnings to your established WBA to see if you fall below the disregard threshold. Might be worth calling EDD or checking with them directly.
0 coins
GalacticGladiator
Okay so I should probably actually calculate whether my new weekly wages fall below the qualifying threshold before filing. Makes sense. Thanks.

Omar Fawzi
Also worth considering: a unilateral pay cut by your employer could potentially qualify as a 'good cause' reason to quit and file for full unemployment in some circumstances. That's a more complex path but something to be aware of if the wage reduction is significant.

how long can you collect partial ui for reduced hours? is it the same 26 weeks as regular unemployment or different
0 coins
CosmosCaptain
It draws from the same benefit year and maximum benefit amount as regular UI. Your benefit year is 52 weeks from when you file, and your total maximum benefit amount is typically 26 times your WBA. Each week you collect partial benefits draws down from that total just like regular UI would. So if your situation eventually turns into a full layoff you'd still have remaining benefits available.
0 coins
Ethan Brown
oh ok so it all comes from the same pool basically, got it
0 coins
Freya Johansen
Yes exactly. And if your hours go back to normal before you exhaust benefits you just stop filing certifications. You don't have to formally close out anything, just stop certifying and your claim goes inactive.

anyone else notice that edd's ui online system sometimes shows weird statuses when you file a partial claim? mine showed 'pending' for almost 3 weeks and I panicked thinking something was wrong with my claim but then a payment just showed up. no explanation no notification just money in my account

This happened to me too. The status updates on UI Online are notoriously unreliable. I've heard from multiple people that the backend processing happens even when the status page looks stuck. Stressful but apparently normal.

I wish EDD would just fix the status page. Three weeks of anxiety for no reason.

The whole UI Online interface is outdated. It gives you minimal information and what it does show isn't always accurate or timely. Another reason why actually talking to an agent is sometimes the only way to get real answers about your claim.

OP one thing to think about is setting aside some of your UI payments for taxes. Unemployment benefits including partial UI are taxable income at the federal level (California doesn't tax UI benefits at the state level). If you don't withhold voluntarily you might have a tax surprise next year. You can elect to have 10% withheld from your EDD payments when you set up your claim.
0 coins
Ravi Choudhury
AuthorOh I completely forgot about the tax angle, thank you for bringing this up. I'll definitely opt into withholding when I file.
0 coins
Carmen Ruiz
Yeah California being tax-free on UI is actually a benefit a lot of people don't realize. But federal taxes still apply so the 10% withholding option is smart especially if you're also going to have wages from the reduced hours job.

I'm kind of in a weird in-between situation — I'm technically salary not hourly so when my company 'reduced my hours' they just started sending me home early some days but my official salary stayed the same on paper. EDD claim was a mess to figure out. Anyone dealt with salaried reduced hours partial UI?
0 coins
Diego Mendoza
Salaried situations can be tricky because if your actual take-home pay isn't changing your partial UI claim gets more complicated. EDD looks at actual wages paid not scheduled hours for salaried employees. If your paycheck is the same amount despite working fewer hours you may not qualify for partial benefits since your compensation isn't reduced.
0 coins
Andre Lefebvre
Yeah that's kind of what I figured. My pay didn't change just my time. So I probably don't have a valid partial claim in that case.
0 coins
Omar Fawzi
Correct — if your earnings aren't actually reduced, there's no wage gap for EDD to fill. Partial UI is based on earnings difference, not hours on a schedule.

Update for anyone following — I filed my partial claim today through UI Online. The process was actually smoother than I expected. There's definitely a reason selection for 'still employed but hours reduced' so I picked that. It said my claim will be processed and I should start certifying in 3 weeks.
