I'm really confused about my EDD situation and could use some help. I just got a determination letter saying I was 'ineligible' for benefits for certain weeks (mid-February through early March 2025), but there's no mention of them collecting any money back from me. I've been on unemployment since January after my tech job laid me off, and I did some part-time consulting during those weeks (reported all earnings). The letter just states 'ineligible - excessive earnings' for those specific weeks but doesn't ask for repayment. Is this normal? What does being 'ineligible' actually mean if they're not asking for money back? Usually ineligibility means overpayment collection, right? I'm worried this will cause problems with my ongoing claim.
Hey everyone, I'm in a weird spot with EDD and getting nervous about an upcoming eligibility interview. I work for a janitorial company that's contracted to clean several schools, but I'm not directly employed by the school district. My summer break started 3 weeks ago, and my contract technically ended with the school year. The company hasn't told me if I'll be back in the fall or not - totally ghosting me when I ask about next semester. I applied for unemployment since I have no income right now, and EDD scheduled an interview to "determine eligibility" for next week. I'm worried they might disqualify me because of the school connection even though I'm a contractor. Has anyone dealt with this specific situation? Will they automatically deny me because I work at schools even though I'm not a teacher or district employee? Really stressing about this since I need to pay rent!
Just a quick update on the "reasonable assurance" rule - as of January 2025, EDD updated their guidelines for contract employees at educational institutions. The key factors they now consider are: 1. Whether there's a written guarantee of reemployment 2. Whether there's a consistent history of reemployment after breaks 3. Whether the contractor (not just the school) has indicated future work Make sure to download and review Form DE 1870C from the EDD website before your interview - it contains the specific questions they'll ask about educational employment. Being prepared with this information will help tremendously during your interview.
i think they just do these interviews to scare people tbh. my cousin works at a school cafeteria (not district employee either) and they did this same thing to her every summer for like 3 years. she always got approved in the end but they make you jump thru hoops first cause thats what edd does lol
I'm in a weird situation and really need advice. I was hired for a remote programming position last month and worked for exactly 7 days before they suddenly let me go saying I wasn't a good fit. The worst part is they never paid me for those 7 days I worked (about $1,800 worth of work). I've sent multiple emails requesting payment with no response, and my attorney even sent them a formal demand letter two weeks ago. Complete silence. Can I file for unemployment in this situation? I had a full-time job for 3 years before this that I left voluntarily to take this new position. Does the fact that I was never paid for those 7 days affect my ability to file? Would I need to prove I actually worked there? The only documentation I have is the offer letter, some onboarding emails, and the work I submitted through their project management system. Has anyone dealt with something similar? I'm not sure if I should keep pursuing payment first or if I can file for unemployment while still trying to get paid for those days. I'm really stressed about making rent next month.
Thanks everyone for the advice! I just submitted my unemployment application and listed both employers. I tried to be very detailed in explaining the situation. Now I'm just waiting to see what happens. I also called the Labor Commissioner's Office about filing a wage claim for the unpaid work, and they're sending me the paperwork. Fingers crossed this all works out soon because my savings are getting really low.
Good job taking action quickly! Be prepared for EDD to schedule an eligibility interview - this is standard procedure when there's a voluntary quit involved. Make sure your phone number is up to date in the system and answer any unknown calls during business hours as it could be EDD. Also check your UI Online account daily for any notices or requests for additional information.
So frustrated right now! I filed a new unemployment claim at the beginning of January and completed my first certification on Sunday. It's been several days and both weeks are stuck in 'pending' status. When I check the claim status details, it says 'a review is required to determine eligibility or verify information.' The weird thing is I already went through the whole ID.me verification process LAST year when I was briefly on unemployment. Does anyone know why I'd have to verify again? Or how long this review typically takes? My rent is due next week and I'm starting to panic a little. Has anyone dealt with this recently?
I'm seriously losing my mind trying to get my 1099-G form from EDD for unemployment I received in 2020! My tax guy is breathing down my neck and I CANNOT file without this form. We've called EDD THREE separate times over the past 2 months, and each time the rep swears they're sending it out, but nothing ever shows up in my mailbox. The last person I talked to said it would take 5-7 business days. It's been 3 weeks! Do they even care that tax deadline is approaching? Has anyone else had this nightmare situation? Is there another way to get this form besides calling and being promised it'll be mailed? I'm desperate at this point!
EDD is THE WORST at sending mail!!! I never got ANYTHING from them on time during my whole claim. Everything was always late or never came at all. I ended up just doing everything online because I couldn't trust their mail system. Did you try logging into UI Online??? That's where I got all my tax forms.
Just a heads-up for anyone dealing with this issue in the future: EDD makes 1099-G forms for unemployment benefits available by January 31st each year. You can access them immediately in your UI Online account rather than waiting for mail. If you need forms from previous years (like 2020-2023), they remain accessible in your account history. If you've changed addresses or no longer have UI Online access, you can request a duplicate 1099-G by calling 1-866-401-2849, but online access is much faster if you can get into your account. This applies to regular UI, disability, and PFL benefits.

One additional thing to be aware of: make sure this ineligibility determination is only for the weeks you had excessive earnings and doesn't extend to other weeks. Sometimes the EDD can make mistakes in the date ranges. If you believe the determination incorrectly includes weeks where you should have been eligible, you would need to appeal within 30 days of receiving the notice.

AuthorGood point! I checked and the ineligibility determination is only for the exact weeks I did the consulting work (Feb 15-Mar 8). All my other weeks are showing as paid correctly. So it looks like everything is accurate.

AuthorAbsolutely! I've been super careful about reporting every dollar I earn. Not worth the risk of problems later on.
