Laid off at 32 weeks pregnant - can I still get EDD SDI benefits? Company suddenly closed!

I'm 32 weeks pregnant and just got completely blindsided - my company shut down with ZERO notice yesterday and laid off EVERYONE (even HR disappeared!). I've been there for 7 years so I definitely worked enough hours to qualify for benefits, but now I'm panicking about what happens with my maternity leave. Can someone please explain like I'm five - do I still qualify for State Disability Insurance even though I'm now unemployed? Will this mess up my baby bonding PFL benefits after birth? Does unemployment affect anything? I'm seriously freaking out because the timing couldn't be worse. My brain is pregnancy-foggy and trying to research this is just leading me down confusing rabbit holes. Any help from someone who's been through something similar would be amazing! 😭

Yes, you absolutely still qualify for SDI! The good news is that in California, pregnancy disability and PFL benefits come from the state, not your employer. As long as you've contributed to SDI through payroll deductions (which you have after 7 years), you're eligible. Here's what you need to know: 1. File for SDI now (don't wait!) using form DE2501 - you can get 4 weeks before birth and up to 6-8 after delivery 2. After SDI runs out, you can transition to PFL for baby bonding (8 weeks) 3. You can also apply for unemployment for the weeks you're not on SDI/PFL The main thing is to get your disability claim started as soon as possible. You'll need your doctor to complete their portion of the form.

Omg thank you SO much!! This is exactly what I needed to hear. I was afraid losing my job would make me ineligible somehow. So I should apply for SDI right now even though I'm not on leave yet? And then unemployment would come after both SDI and PFL are done?

Ugh, companies that do this to pregnant employees should be ILLEGAL!!! I went through something similar but at 28 weeks. They'll try to make you think you don't qualify for anything but DON'T LISTEN TO THEM!! The state disability is YOUR MONEY that YOU PAID INTO the system. They can't take that away. Make sure you get that DE2501 form filed IMMEDIATELY - the EDD system is a nightmare and delays happen all the time. Your doctor needs to say you're disabled due to pregnancy. Get them to date it from your last day of work if possible!!!!

this is horrible but unfortunately legal. employers in california can terminate w/out notice unless you have a contract saying otherwise. happened to my sister when 7 months pregnant. good news is SDI still available but make sure u keep all documentation from ur employer

Actually, there's a specific sequence you should follow to maximize your benefits: 1. Apply for SDI immediately (up to 4 weeks pre-delivery plus 6-8 weeks post-delivery depending on delivery type) 2. After SDI ends, apply for PFL baby bonding (8 weeks) 3. THEN apply for unemployment after both disability and PFL are exhausted Remember that you cannot receive unemployment benefits and disability/PFL benefits simultaneously. For your SDI application, you'll need: - DE2501 form completed by your doctor - Last day worked information - Your wage information from recent quarters Your benefit amount will be based on your highest-earning quarter in the 12-month base period before your claim begins.

Just to add to this excellent advice - if you can't reach anyone at EDD and need to talk to a person about your application (which is highly likely with the complexity of your situation), I found a service called Claimyr that got me through to an actual EDD representative in about 20 minutes after spending days trying on my own. Saved my sanity during my maternity leave drama! They have a demo video at https://youtu.be/DOLxZQb92wM?si=6N1iCQ3a8Cdb2Ay5 and their website is claimyr.com - seriously made dealing with the impossible EDD phone system manageable.

my friend got laid off at 30 weeks last year! she still got disability no problem BUT had major delays getting her first payment. took like 6 weeks i think? make sure u have some savings to cover that gap if possible

0 coins

That's what I'm worried about! We have some savings but were counting on my income until birth. Did your friend have to do anything special to speed up the process?

don't worry about being laid off, it doesn't affect SDI. but MAKE SURE u report ur last day worked correctly on the form!!! if u put wrong date EDD will reject and make u reapply which adds weeks to process. also doctor section needs to be perfect or they send it back.

This is so true! When I applied for my maternity disability last year, my doctor's office put the wrong date format and my claim got delayed for THREE WEEKS. I had to keep calling and calling and finally got through after like 50 attempts. They're super picky about every little detail on that form.

Important clarification about unemployment: You should apply for unemployment immediately after being laid off, but understand that once your SDI/PFL benefits begin, you'll need to stop claiming unemployment. Here's the correct sequence: 1. Apply for unemployment now (since you were just laid off) 2. Apply for SDI to begin 4 weeks before your due date 3. Stop certifying for unemployment when SDI begins 4. Transition from SDI to PFL after recovery 5. Resume unemployment after PFL ends (if you're still job searching) This approach ensures you don't have gaps in income while waiting for disability to begin. The EDD systems don't automatically cross-check in real-time, but eventually they will, and receiving both simultaneously will result in an overpayment notice.

This is really helpful, thank you! So I should actually apply for unemployment right now even though I'll be switching to SDI in a few weeks? That makes sense to avoid gaps. Do I just stop certifying for unemployment once I start receiving SDI, or do I need to formally notify them somewhere?

0 coins

Exactly - apply for unemployment now since you're currently unemployed and able to work. When your doctor puts you on pregnancy disability (typically 4 weeks before due date), you'll simply stop certifying for unemployment and switch to SDI. You don't need to formally notify the unemployment department - just stop certifying. And don't worry about the 'looking for work' requirement for these few weeks - California recognizes pregnancy as a good cause for limited job searching, especially this late in pregnancy. Just document any job search activities you do perform, even if limited.

I'm going through something similar and found this really confusing too! My doctor wrote a note saying I can only work from home with limited hours due to pregnancy complications. Does anyone know if this affects my ability to get unemployment before going on full disability? The EDD website is so hard to understand!

WAIT!!!! Make sure you get a copy of your FINAL PAYSTUB from your company before they completely disappear!!!! You'll need it for all your SDI/PFL paperwork and it can be IMPOSSIBLE to get once the company is gone. Also get any documentation about the layoff in writing if possible! I've been through this nightmare and chasing down paperwork was the WORST part!!

That's a really good point - thank you! I'm going to email my former manager right now to request all of that. Hopefully they're still checking email even though the company is shutting down.

One more important detail: When you transition from SDI (pregnancy disability) to PFL (baby bonding), there should be no gap. The system should automatically transition you, but sometimes this fails. To ensure a smooth transition: 1. About a week before your pregnancy disability is scheduled to end, log into your EDD account 2. Look for the option to file for PFL 3. Complete this before your SDI claim ends If you don't see this option, call EDD immediately. This transition period is where many new parents experience payment delays.

This transition was actually where I used Claimyr to reach someone at EDD. I had completed everything online but my payments just stopped after SDI ended even though I filed for PFL. Turns out there was a glitch in their system. Had to call multiple times but couldn't get through until I used their service. Having a real person fix it made all the difference.

i just had my baby 3 months ago and went thru this exact process! the edd website has all the eligibility info but its super confusing. the most important thing is filing for disability as soon as possible and having ur doctor fill out their part CORRECTLY. my friend had her doc mess up the form and it delayed everything by weeks!

0 coins

Congrats on your baby! Did you hand-deliver the form to your doctor or did you fill out your part online and then they got notified somehow? I have an appointment next week and want to make sure I do this right the first time.

You can either file your claim online through SDI Online (recommended) or use a paper DE2501 form. If you file online: 1. You'll complete your portion at edd.ca.gov/SDI_Online 2. Your doctor will receive electronic notification to complete their part 3. You can track the status through your online account If using paper, bring the form to your next appointment. However, online is faster and reduces the risk of mail delays or lost paperwork. Just make sure your doctor knows to expect the electronic notification and completes it promptly. And remember - the date your doctor certifies as your disability start date is critical. For pregnancy, this is typically 4 weeks before your due date, but can be earlier with complications.

Thank you so much for all of this help! I feel much less panicked now. I'll apply online this weekend and let my doctor know to watch for the notification at my appointment next week. At least the timing worked out where I wasn't planning to start maternity leave for a few more weeks anyway.

I'm so sorry this happened to you! What an awful situation to deal with while pregnant. I went through a similar layoff (though not pregnant) and the stress is unreal. One thing I haven't seen mentioned yet - since your company closed suddenly, make sure you also file a claim with the California Labor Commissioner for any unpaid wages, accrued vacation, or severance you might be owed. Companies that shut down abruptly often leave employees hanging, but the state can sometimes help recover what you're owed. Also, don't forget about COBRA for your health insurance! You should get paperwork within 60 days, and you have 60 days to elect coverage retroactive to when you lost your job. Super important with a baby coming. The premium will be expensive but worth it for maternity care. You've got this mama! The SDI/PFL system isn't perfect but it does work, and you've paid into it for 7 years. Take it one step at a time and don't hesitate to ask for help when you need it. 💪

This is such an overwhelming situation, but you're going to be okay! I just went through something similar when my company downsized unexpectedly at 35 weeks pregnant. Here's what I wish someone had told me: First, breathe. You WILL get your benefits - being laid off doesn't disqualify you from SDI or PFL since you've been paying into the system for 7 years. My timeline was: - Applied for unemployment immediately after layoff - Filed SDI claim online 4 weeks before due date - Doctor completed their portion within 2 days - First SDI payment came about 3 weeks later - Seamlessly transitioned to PFL after delivery The key things that helped me: 1. File everything online through SDI Online - it's faster than paper 2. Call your doctor's office before your appointment to let them know to expect the electronic notification 3. Keep detailed records of all dates and reference numbers 4. Don't panic if there are delays - they're frustrating but normal You've got this! The system exists exactly for situations like yours. Focus on taking care of yourself and that baby, and let the state programs do what they're designed to do. ❤️

Thank you so much for sharing your timeline! This is exactly what I needed to see. It's so reassuring to hear from someone who went through the same thing and came out okay. I was especially worried about the transition from SDI to PFL - good to know it can be seamless when done right. I'm definitely going to file everything online like you suggested. Did you have to do anything special to make sure the transition went smoothly, or did it just happen automatically?

I'm so sorry you're going through this! The stress of a sudden layoff while pregnant must be overwhelming. Just wanted to add one more thing I haven't seen mentioned - if you're feeling anxious about the paperwork or process, consider having your partner or a trusted family member help you with the applications. Pregnancy brain is real, and having someone double-check dates and forms can prevent those costly mistakes that cause delays. Also, once you start receiving benefits, set up direct deposit if you haven't already. Paper checks can get delayed or lost in the mail, and the last thing you need is payment issues when you have a newborn. You mentioned feeling panicked, but honestly, your situation is more common than you think. The state disability system was literally created for working parents like you who've paid into it. You've earned these benefits! Focus on your health and your baby - the bureaucracy will sort itself out. Sending you positive thoughts! 💕

This is such great advice about having someone help with the paperwork! I'm definitely going to ask my partner to double-check everything before I submit it. My pregnancy brain has been so bad lately - I literally forgot my own phone number the other day 🤦‍♀️ And yes to direct deposit! I hadn't even thought about that but you're absolutely right, the last thing I need is to be chasing down a missing check while dealing with a newborn. Thank you for the reassurance that this situation is more common than I thought. It really helps to not feel so alone in this mess.

I went through almost the exact same thing at 29 weeks pregnant! My company gave us literally 2 hours notice before shutting down permanently. I was terrified about losing my maternity benefits, but it actually worked out fine. The most important thing I learned: being unemployed does NOT affect your SDI eligibility at all. You paid into the system for 7 years - that money is YOURS. The state disability insurance comes from your previous earnings, not your current employment status. Here's what saved me time and stress: 1. I applied for both unemployment AND SDI on the same day (unemployment for immediate income, SDI to start 4 weeks before due date) 2. I printed out my wage statements from my online portal before my company's systems went dark 3. I had my doctor's office put a rush on the medical certification One thing that surprised me - I actually got my first unemployment payment faster than I expected, which helped bridge the gap until SDI kicked in. Just remember to stop certifying for unemployment the week your disability benefits start. You're going to be okay! The timing is scary but the safety net exists for exactly this reason. Focus on your health and that baby - the paperwork stuff will sort itself out! 🤗

Thank you SO much for sharing your experience! It's incredibly reassuring to hear from someone who went through almost the exact same situation. The 2 hours notice is even worse than what happened to me - I can't imagine how stressful that must have been! Your tip about printing wage statements before the company systems go dark is brilliant - I'm going to do that right now while I still can access everything. And I love that you applied for both unemployment and SDI on the same day - that makes so much sense to avoid any gaps. Did you have any issues with the transition from unemployment to SDI when your disability started? I'm worried about accidentally creating problems by having both claims open at the same time, even though I know I need to stop certifying for unemployment once SDI begins. It really helps to know that someone else made it through this chaos successfully. Thank you for taking the time to share your timeline and tips! 💙

Oh honey, I'm so sorry this happened to you! What terrible timing, but please don't panic - you're going to be okay! I went through something similar when my employer suddenly filed for bankruptcy at 34 weeks. I was absolutely terrified, but it turns out that being laid off actually doesn't affect your SDI/PFL eligibility AT ALL. These are state programs that you've been paying into for 7 years through your paychecks - think of it as insurance you've already bought and paid for. Here's what I wish someone had told me right away: - Apply for SDI online ASAP (even before you're technically disabled) to get the paperwork started - Get your final paystub and any employment documentation before your company completely disappears - Your benefits are calculated based on your previous earnings, not current employment status - The timing actually works out okay since you weren't planning to start leave for a few more weeks anyway The hardest part for me was just not knowing what to expect, but once I understood that my job status didn't matter for disability benefits, it was such a relief. You've EARNED these benefits - they can't take them away from you! Take care of yourself and that baby. The state systems aren't perfect but they do work, and you're going to get through this! 💕
