EDD PFL denied due to employer payroll error - no response since September

I'm at my wits end trying to get my PFL benefits! Back in September I took 4 weeks off for baby bonding, but my claim was denied because my employer accidentally recorded me as working 4 days that month AND paid me for those days (which they later deducted from my next paycheck). I immediately sent back the correction paperwork in late September, but it's been radio silence from EDD since then. I filed a new claim in late November thinking maybe the first one was lost in their system. Still nothing. Then I took another 4 weeks in December for additional bonding time and filed for that period too. It's now been MONTHS and I haven't received a single response about ANY of my claims! My savings are completely drained and I'm starting to panic. Has anyone dealt with the employer error situation before? Any suggestions on how to actually get someone at EDD to look at my case? I've called at least 20 times and can't get through to a human.

This happened to me last year! The employer error is a nightmare to fix. You need to get your employer to send a formal letter to EDD explaining the payroll mistake and confirming the dates you were actually on leave. Make sure they include your claim ID number on all correspondence. Also, did you try calling the alternate number? 833-978-2511 sometimes has better luck than the main line.

Thanks for the advice! My HR already sent a correction letter in October (which EDD apparently ignored). I'll ask them to send another one with my claim ID specifically mentioned. And no, I didn't know about the alternate number - I'll try that tomorrow morning!

hav u checked ur online account? sometimes they update the status there but dont send notices. also check ur spam folder maybe?

Yes, I check the online portal daily - still shows "pending" for all three claims. And I've been obsessively checking my email spam folder too. Nothing!

The EDD is COMPLETELY BROKEN right now!!! I've been fighting with them for 5 months over a similar issue where my employer reported incorrect wages. They keep saying they're "processing" my claim but NOTHING HAPPENS. I've called 50+ times and either get disconnected or told to "wait for processing to complete" which is USELESS!!! The only thing that finally worked was filing a complaint with my state assembly member's office. They have EDD liaisons who can actually get things done. Google your local assembly member and call their constituent services office.

It took about 3 weeks after I contacted my assembly member, but that was after MONTHS of trying on my own. Their office made me fill out a form authorizing them to inquire about my case, then they submitted it directly to their EDD contact. WAY faster than the normal channels.

Have you considered that maybe the reason you haven't heard back is that they're denying all your claims? My cousin had her PFL baby bonding denied because you can't take it in segments that are less than 2 weeks each. Maybe the 4 weeks in September and 4 weeks in December weren't filed correctly as bonding time? The rules for PFL bonding are different than disability leave.

This is incorrect information. While PFL baby bonding must be taken within the first year of a child's birth, it CAN be taken in increments as small as one day. You're thinking of the old rules that changed several years ago. The current California PFL program allows for intermittent bonding leave.

Thanks for pointing this out, but I did check before filing and confirmed with my HR that I could take bonding time in 4-week increments. And even if there was some issue with the December claim, they should have at least processed the September one by now!

when my wife had our baby last year the same thing happend... her work reported her as taking vacation days when she was actually on PFL. we tried calling for WEEKS with no luck. finally what worked was sending a physical letter through certified mail to the appeals board with all our documentation. took about 5 weeks but they finally fixed it and sent all the backpay. make sure you keep copies of EVERYTHING and get tracking on any mail you send them!!!

we sent it to the appeals office in sacramento. i dont remember the exact address but its on the EDD website under appeals. we labeled the envelope "URGENT: PFL APPEAL" in big letters.

One more thing - if your employer already made the payroll correction and deducted the money, make sure you get a formal wage adjustment statement from them. EDD won't just take your word that the money was paid back. They need official documentation from the employer showing the correction was made. Also, when you do finally reach someone, ask them to check if your claim has been flagged for potential fraud. Sometimes when there are employer reporting discrepancies, the claim gets automatically flagged and sent to their fraud department, where it sits for months without anyone telling you.

my sister works at edd (not in benefits tho) and she says their systems r super backed up right now. lots of ppl having baby during pandemic so theyre still catching up. might just need more time unfortunately

That's NO EXCUSE for a 5-MONTH delay!!! The pandemic baby boom was two years ago. They're just using that as an excuse for their terrible service at this point. The real problem is they haven't upgraded their ancient computer systems that crash constantly.

My employer also had a payroll mix-up where they initially coded my leave as sick time instead of family leave.
