EDD Overpayment Issue: Still Receiving Checks After Returning to Work - What to Do?

Hey everyone, I'm in a bit of a pickle with EDD. I went back to work on January 6th and submitted the form to notify them, but I'm still getting checks until February 6th. Now EDD is saying there's an overpayment and they might determine if I'm at fault and consider penalties. I haven't deposited any checks since the first one wasn't accurate (it included days after I started working). What should I do? Should I mail back all 3 checks I got but haven't deposited? Any advice would be appreciated!

Ugh, classic EDD mess-up. Here's what you need to do: 1. Call EDD ASAP and explain the situation 2. Tell them you haven't deposited any checks since returning to work 3. Ask about the exact overpayment amount and repayment options 4. Find out if there are penalties and how to avoid them 5. Get clear instructions on what to do with the checks 6. Document everything - take notes during the call Good luck dealing with this bureaucratic nightmare! 🙄

This is solid advice. I had a similar issue last year and following these steps saved me from a world of hurt.

True, getting through is a pain. But keep trying, it's worth it to avoid penalties!

whatever you do, DO NOT deposit those checks! That'll make things way worse. Keep em as proof you didnt cash em.

Yeah, I definitely won't deposit them. Should I mail them back or wait for EDD to tell me what to do?

Wait for EDD to give you instructions. Don't do anything without their say-so.

I found a method to get someone on the phone. I used this site's (claimyr.com) calling tool that dials the phone menu, stays on hold, waits for a live agent to pick up, then sends the call to my phone. It does cost $20, but it works. Here's a video about it: https://youtu.be/DOLxZQb92wM

Sounds sketchy. Is it legit?

Yeah, it's totally legit. I was skeptical too, but it saved me hours of hold time. Worth every penny tbh.

How long did it take to get through?

It took about 2 hours for me, but I didn't have to sit there listening to hold music. They just called me when an agent was on the line.

Have you checked your UI Online account? Sometimes there are messages or instructions there that don't come through the mail.

Good idea, I'll take a look. Thanks!

This happened to me last year. It took forever to sort out, but I didn't get hit with any penalties. Just make sure you're super clear with them about the dates and keep all your documentation. And yeah, don't cash those checks!

That's reassuring to hear. How long did it take you to resolve everything?

It took about 2 months all told. But most of that was just waiting for them to process everything. The actual conversations with EDD only took a couple hours total.

Quick question - did you certify for benefits after you went back to work? If so, that might be why you're still getting checks.

•

No, I didn't certify after going back to work. That's why I'm so confused about still getting checks.

Huh, that is weird then. Definitely sounds like a system error on their end. Make sure to emphasize that when you talk to them.

100% agree. The system is so outdated, it's ridiculous.

I went through something similar a few months ago! Definitely don't deposit those checks - you're smart for not cashing them. When I called EDD, they told me to keep the physical checks as proof and they eventually sent me a letter with instructions on how to return them. The key thing is to be proactive about calling them because if you wait too long, they might assume you're trying to keep the money. Also, make sure you have your exact return-to-work date handy when you call - they'll need that info to recalculate everything. Hang in there, it's stressful but totally fixable! 💪

Thanks for sharing your experience! This gives me hope that it's actually fixable. Quick question - how long did it take from when you first called them to when you got the letter with return instructions? Just trying to get an idea of the timeline I'm looking at here.
