EDD ghosting me on disability claim from 2023 knee surgery - Need help reviving expired claim!

I'm at my wits end with this situation. Back in July 2023, I had to get knee reconstruction surgery and filed for SDI benefits. Everything seemed fine until I realized my claim was stuck in processing. After logging into SDI Online, I discovered EDD kept saying they were 'waiting for employer verification'. Here's where it gets ridiculous - I've worked at the same company for 8 years, our HR department swears they never received ANY requests from EDD, and I've sent in THREE separate employer verification forms myself! Every time I call EDD, I get transferred around until someone tells me 'we'll resend the verification request' but then nothing happens. It's been over 8 months now, and my claim has actually EXPIRED in the system. I can't even access it on the portal anymore to check status. The medical bills are piling up, and I'm out thousands in lost wages. Has anyone successfully revived an expired disability claim? Or found a way to make EDD actually communicate with employers? I'm desperate for any advice at this point!

You need to file an appeal immediately! This is called a 'late claim' situation. Download the DE 1000A form from the EDD website and fill it out completely. Include a detailed explanation of your attempts to resolve the issue with both EDD and your employer. Make sure to attach copies of ANY communications you've had with both parties. The appeal deadline is typically 20 days from the expiration notice, but you can request an exception due to 'good cause.' Your documentation of repeated attempts to resolve will support this. Send it certified mail so you have proof they received it.

Thanks for this info! I didn't know about the DE 1000A form. Do you know if I need a new medical certification from my doctor since the surgery was back in 2023? My recovery took longer than expected (4 months) and I'm worried they'll deny it based on the dates.

Thanks for sharing your experience. Yeah, unfortunately my claim is completely expired now. I'm going to try the appeal route that the other person suggested. I wish I'd known to have my supervisor call directly months ago!

This is a classic case of what I call the "EDD verification loop". You're not alone in this frustration. Here's what you need to do: 1. File the appeal as mentioned above using DE 1000A 2. Contact your state assembly member's office IMMEDIATELY (google "[your city] state assembly member") - their constituent services can work miracles with EDD 3. Ask your HR to provide a written statement that they never received verification requests 4. Request your employer's payroll department to provide wage verification directly 5. If your claim is reinstated, you'll likely need updated medical certification I've helped dozens of people through this exact situation. The key is getting your assembly member involved - they have direct contacts at EDD that bypass the regular phone system. But don't wait, there's usually a time limit on appeals even with good cause explanations.

Calling ur state assembly person WORKS!! i was stuck in EDD hell for 3 months until i did this and magically my claim got fixed in 2 DAYS. they have special contacts at EDD that regular people cant reach

This is incorrect information. While there is typically a one-year filing deadline from the date of disability, there are several exceptions that allow for late claims, especially when the claimant can demonstrate ongoing attempts to resolve verification issues. The Administrative Law Judge has discretion to approve late claims when there's evidence of system failures or communication breakdowns between EDD and employers. Please be careful about posting definitive statements that could discourage someone from pursuing a legitimate claim.

Try using Claimyr to reach an EDD representative directly. I was in a similar situation with my claim showing as 'expired' and couldn't get through on the phone for weeks. Claimyr got me connected to an actual claims specialist in about 20 minutes who was able to reactivate my claim and process the employer verification while I was on the phone. Their website is claimyr.com and they have a video demo that shows how it works: https://youtu.be/1X-mEsLtbmQ?si=1hcSq3KFtCr4oAmd The EDD rep told me that with expired claims, you often need to speak directly with a Tier 2 specialist who has the authority to reactivate them in special circumstances - which it sounds like yours would qualify for since it wasn't your fault.

Thank you for this suggestion! I'm desperate enough to try anything at this point. The EDD phone system is a nightmare - I've spent hours getting hung up on. I'll check out that video and see if this can help me get to an actual decision maker instead of the frontline reps who just tell me to wait.

Don't give up!!! I had almost the EXACT same situation happen with my carpal tunnel surgery disability claim in 2024. My employer kept claiming they never got the verification forms, and EDD kept saying they sent them multiple times. My claim expired after 9 months of this back-and-forth nonsense. I finally got it resolved by: 1. Getting my direct supervisor AND HR manager on a conference call with me to EDD 2. Having all medical documentation ready (operative reports, post-op progress notes, physical therapy records) 3. Filing a formal complaint through the EDD website about the verification process It took another 6 weeks, but they eventually reinstated my claim AND paid all my back benefits with interest (which I didn't even know was a thing!). The key was the conference call - it forced both sides to communicate directly instead of using me as the messenger.

A conference call is such a smart idea! That way they can't each blame the other party when I'm not around. I'm going to try to set this up if the assembly member route doesn't work quickly. Thank you for sharing what worked for you - it gives me hope!

Quick update based on some of the comments here: 1. You absolutely CAN revive an expired claim in many cases, especially when there were verification issues 2. Make sure to address your appeal to the "SDI Appeals Board" specifically, not just general EDD 3. If using the assembly member route, ask specifically for help with a "claim verification failure resulting in expiration" 4. Document EVERYTHING from this point forward - names, ID numbers, dates, and summaries of all conversations 5. When explaining your situation, use the phrase "ongoing attempts to resolve verification issues" as this specific language helps demonstrate good cause for late processing The verification loop between employers and EDD is unfortunately common. I'd suggest trying both the assembly member AND appeals approaches simultaneously for the best chance of resolution.

Thank you for these specific tips! I especially appreciate the exact phrases to use - that's incredibly helpful. I'll definitely pursue both tracks at once and keep detailed records of everything going forward.
