EDD Appeal Decision Timeframes - Judge still hasn't ruled 3 weeks after hearing

I had my unemployment appeal hearing with an Administrative Law Judge on August 6th (a little over 3 weeks ago) and still haven't received any decision. This whole process has been so frustrating! I initially appealed my disqualification back in April, waited forever for a hearing date, and now I'm in limbo again. Has anyone gone through the appeals process in 2025 who can tell me how long it took to get your decision AFTER the hearing? I'm specifically dealing with the Inland Office of Appeals. I'm getting conflicting information from their office - one rep told me 2-4 weeks for a decision, another said 12-18 weeks! That's a huge difference when you're trying to plan financially. My appeal involves two issues: - Whether my employer's account should be charged (code 1030/32) - Whether I left voluntarily without good cause or was discharged for misconduct (code 1256) The waiting is killing me. Any insights would be appreciated!

I had my appeal hearing in January 2025 with the San Diego office (not inland, sorry) and it took almost exactly 6 weeks to get the decision. The judge said 30 days at the hearing but it was definitely longer. My sister went through appeals with the Inland office last month and got her decision in 5 weeks. So I'm guessing the 12-18 week estimate is them covering their butts for worst case scenario. But who knows with EDD... they change their timeframes all the time! 🙄

Thank you for sharing your experience! 5-6 weeks sounds more reasonable than 12-18 weeks. Did you or your sister do anything to follow up during the waiting period, or just wait it out?

the judge told me at my hearing they have 75 days by law to issue a decision but most come faster. mine took 8 weeks exactly, this was in march. check your online account they sometimes post it there before you get the letter

I've been checking my online account almost daily! Nothing there yet. 75 days is over 10 weeks - that's a long time to wait. I hope mine doesn't take that long.

I just went through the appeals process with the Inland Office in May-June 2025. Here's what you should know: 1. Their official guideline is 30-45 days to issue a decision after the hearing 2. However, they're currently backlogged due to staffing issues 3. In my case, it took exactly 7 weeks to receive my decision 4. The decision was posted to my UI Online account 3 days before I received the paper copy The nature of your case (voluntary quit vs. misconduct) does impact timing. These cases require more detailed analysis than simple technical violations, so they often take longer. The fact that you also have the employer reserve account charge issue (1030/32) makes it more complex. If you need to follow up, call early in the morning (right when they open) and specifically ask to speak with the Appeals Board clerk, not just any representative. The clerk can give you more accurate information about your specific case.

This is incredibly helpful, thank you! I didn't realize the type of case affected the timeline, but that makes sense. And great tip about asking for the clerk - I'll try calling first thing tomorrow morning. I appreciate the detailed response!

i had my hearing in february and never got a decision! had to call multiple times and finally found out they "lost" my case. had to request a new hearing and start all over. make sure u keep calling every few days to check status, dont trust them to do their job right

OMG that's awful! How does a government agency just "lose" something so important? I'd be furious! This is why I have no faith in the system anymore...

Have you tried calling the Claimyr service? I was in the same boat last month - waiting forever after my appeal hearing and getting nowhere when I called EDD directly. Used claimyr.com and they got me connected to an actual EDD rep in under 30 minutes who looked up my case and gave me accurate info. There's a video showing how it works here: https://youtu.be/1X-mEsLtbmQ?si=1hcSq3KFtCr4oAmd The rep I spoke with told me my decision was actually finalized but hadn't been mailed yet due to a processing backlog. They expedited sending it out after our call. Might be worth trying if you're really anxious about the timeline.

I hadn't heard of Claimyr before. Did you find it was worth it? I'm definitely getting anxious about this whole situation.

Absolutely worth it. I spent weeks trying to get through on my own with no luck. With Claimyr I was talking to someone in less than 30 minutes, and they actually had access to see the status of my appeal decision which wasn't visible in my online account.

The appeal decision timeframe is RIDICULOUS!!!! I had my hearing in April and didn't get my decision until JULY - that's like 12 weeks! And then when I finally got it, they ruled against me even though I had PROOF my employer was lying. The whole system is designed to wear you down until you give up. Just prepare yourself for a long wait and don't count on that money anytime soon. EDD is completely BROKEN and they don't care how many people suffer while they take their sweet time.

I'm sorry you had such a negative experience. I hope my case doesn't take 12 weeks - that would be devastating. Did you appeal the judge's decision or just accept it at that point?

I appealed to the Board but that's ANOTHER 3-4 month wait they said. It's my money and I NEED IT NOW but they don't care. The system is rigged against us regular people.

My cousin works at EDD (not in appeals though) and she says they're super understaffed right now and most decisions are taking 6-8 weeks minimum. But if your case is straightforward sometimes it can be faster. Did the judge seem to lean one way or another during your hearing? Sometimes you can tell how they'll rule.

The judge was really neutral during the hearing, so I couldn't get a read on which way he was leaning. My former employer didn't even show up to the hearing, which I thought might work in my favor, but the judge still asked me a ton of questions about the separation. It's hard to predict anything with this process.

Just a follow-up suggestion - while you're waiting, make sure you've gathered all documentation related to your case and keep it organized. If you receive a favorable decision, you'll want to be prepared for potential backpay processing. If the decision is unfavorable and you decide to appeal to the CUIAB Board level, you'll need all your evidence ready. Also, check if you qualify for any other assistance programs while waiting. The appeal process doesn't stop you from applying for other benefits you might be eligible for, such as State Disability Insurance if you have a qualifying medical condition, or CalFresh for food assistance.

Good advice, thank you. I've been keeping a folder with all my documentation, but I hadn't considered looking into other assistance programs during this waiting period. I'll definitely look into those options.

Congrats on winning your appeal! That gives me hope. Did you have to do anything special to get them to start paying after you won? Or did the payments just start automatically?

I had my hearing in March for a similar issue (voluntary quit vs discharge) and interestingly it only took 17 days to get my decision! But then I have a friend who had his hearing the week after mine and he waited almost 9 weeks. I think it depends on which judge you get and how complicated your case is. Some judges are apparently known for quick decisions while others take forever. Did you happen to catch your judge's name? Some people in my local unemployment group keep track of which judges are faster with decisions.

That's interesting! My judge was Judge Richardson. Have you heard anything about him? It's strange how the timeframes can vary so dramatically even within the same office.

I don't know Richardson personally but I can ask in my group if anyone has experience with him! Will let you know if I hear anything
