Will CalWORKs deny my entire case if I'm missing my daughter's stolen SSN during recertification?
I'm seriously stressing about my CalWORKs recertification right now! Just completed everything but I have a huge problem - I don't have my daughter's social security number because her dad's mother STOLE it (long story but she's done identity theft before). I told my eligibility worker about the situation during my interview, and all they said was "it's up to the computer, not us" which wasn't helpful AT ALL. I'm worried they'll cut off benefits for my whole family (me + 2 kids). Does anyone know if they'll just remove my daughter from the case and keep me and my son on there? I've already reported the SSN theft and started the process to get her a new card, but that takes time and my recertification is happening NOW. I can't afford to lose all our Cash Aid while I'm waiting for the replacement!

•Really?? That's a relief to hear. Did she have to do anything special to prove she was trying to get the SSN replaced? I have a police report about the theft but that's it so far.

They BETTER not deny ur whole case for something that's not even ur fault!! I swear the system always punishes parents for things out of their control. When I had my renewal last year they gave me so much trouble because my ex took my son's birth certificate when he moved out. I had to pay $25 for a new one AND they reduced my benefits for a month because it was "late verification" even though I TOLD them why it was late!!!!

•The system is totally designed to find ANY reason to cut people off. They don't care what your situation is.

To answer your question directly - no, they should not deny the entire case. When verification is missing for one household member, that person becomes ineligible until the verification is provided, but other eligible household members can still receive benefits. Here's what you need to do: 1. Get a letter from the Social Security office confirming you've applied for a replacement card 2. Submit this as verification that you're actively resolving the issue 3. Complete form CW 2.1 (Statement of Facts) explaining the situation 4. Submit a copy of the police report about the theft The eligibility worker wasn't being fully accurate when they said "it's up to the computer" - they have the ability to code your daughter as temporarily excluded for good cause while maintaining benefits for you and your son.

•Thank you so much for this detailed response! I already have the police report and I called the Social Security office to start the replacement process. Do I need to physically go to my county office with these documents or can I upload them to BenefitsCal? My worker never answers the phone when I call.

•You can upload them to BenefitsCal, but I'd also recommend trying to speak directly with a worker to explain the situation. If you're having trouble reaching someone by phone, you might want to try Claimyr (claimyr.com). They have a service that gets you through to CalWORKs workers much faster than waiting on hold. There's a video explaining how it works here: https://youtu.be/jzISHxCPLwE It's really important that you talk to someone directly about this since your recertification is time-sensitive and you want to make sure they understand the situation is temporary while you resolve the SSN issue.

I work for a nonprofit that helps people with benefit issues. You should know that the county is required to help you obtain verification documents when there are circumstances beyond your control. Call your worker back and specifically ask for "reasonable accommodations" in your case due to the theft. Use those exact words. They should give you a conditional approval while you work on getting the new SSN. Make sure you keep documentation of all your attempts to resolve this - dates you called SSA, copy of application for replacement, police report, etc. And don't panic about the "computer" making decisions. While the system does flag missing verification, workers have override codes they can use for situations exactly like yours.

•Thank you for this info! I didn't know I could ask for "reasonable accommodations" - that's really helpful. I'll definitely use those exact words when I talk to them. I've been keeping a folder with all my documentation so far.

when my sister had this problem they made her fill out a form called "statement of facts to get a fee waiver for vital records" and that let her get a copy of her kids birth certificate for free and then she used that to help get a new social security card. ask your worker about this form!!! also they kept her on benefits while she was fixing everything so dont worry

OK so everyone is saying they won't cut you off completely but that wasn't my experience. I had a similar issue (not stolen SSN but I couldn't find my son's card anywhere) and they discontinued my ENTIRE case during recertification. I had to reapply from scratch and went without benefits for almost 2 months. Finally got it worked out but it was a nightmare. I think it depends on your county and worker. Some are more understanding than others. Document EVERYTHING. Email is better than calling because then you have proof you tried to resolve it. Also ask to speak to a supervisor if your worker isn't helping.

•Omg that's exactly what I'm afraid of! Which county was this in? I'm in Los Angeles County. Did they give you retroactive benefits for the 2 months you were cut off?

•I'm in San Bernardino. And no, they didn't give me retroactive benefits even though it was their mistake! That's why I'm saying document everything and don't just rely on what your worker says. If possible, get their responses in writing or email.

Make sure you're also documenting the identity theft issue separately from your CalWORKs case. Since this involves your child's SSN, you should: 1. File a report with the Federal Trade Commission at IdentityTheft.gov 2. Place a credit freeze with all three credit bureaus (yes, even for a child) 3. Contact the Social Security Administration to flag the number for monitoring As for your CalWORKs case, you have the right to request a Reasonable Accommodation as I mentioned before. But also ask specifically for your case to be marked with a Special Indicator for identity theft. This can help prevent automatic discontinuance during the computer processing of your recertification.

•Thank you so much, I didn't even think about putting a credit freeze for her. I'll definitely do that right away. And I'll ask about that Special Indicator - that sounds like exactly what I need. Really appreciate all this help!
