How long does CalWORKs child support take to find absent parent with a DUI case?
Just got approved for CalWORKs last month and immediately the child support dept contacted me for my son's father's information. I gave them everything I know - his last known address (from 2 years ago), his parents' address, his old workplace, and his cell # that he sometimes answers. They told me they'd "locate" him but I'm wondering how long this usually takes? He's actually got an ongoing DUI case in Riverside County right now (3rd offense) so I'm thinking they should be able to find him pretty easily through court records, right? This is my first time dealing with CalWORKs and the child support requirement. Once they find him, will I be kept in the loop about what's happening, or is it strictly between him and the child support office from now on? I'm kinda worried about him finding out where we live now.

They should be able to locate him pretty quickly with the court case info. Child Support Services (DCSS) has access to a ton of databases - DMV records, court records, employment records, etc. With a current court case, they'll find him within a month most likely. As for communications, you'll get some notifications, but not everything. You'll be informed when they establish a child support order and when they start collecting payments. You won't know about all their communications with him. If you're concerned about your address being disclosed, you should immediately contact your child support caseworker and request address confidentiality. Make sure to tell them you have safety concerns.

my ex had 2 duis and they found him IN JAIL lol. took like 3 weeks. but then it took another 4 months to get the actual support order set up cuz he kept dodging them after he got out. make sure u give them EVERYTHING u know about him so they can track him down faster

They told me they'd find my kids dad too but it's been 6 months and nothing! Still getting my CalWORKs though. I think it depends on the county maybe? I'm in LA County and everything takes FOREVER here. You might get lucky if your county office is more efficient. Did they tell you that you HAVE to cooperate with child support to keep getting Cash Aid?

To answer your question directly: DCSS handles all communication with the non-custodial parent once you've provided your information. You won't be involved in their conversations with him. They will notify you when they establish a child support order, and you'll get updates on payments received. You can request address confidentiality at any time if you have safety concerns. Your address can be removed from all court documents. Also, if there's any history of domestic violence or you fear for your safety, you can request a "good cause" exemption from the child support requirement altogether while still keeping your CalWORKs benefits. Typically with someone in the court system, location happens quickly (2-8 weeks). The full process of establishing an order can take 3-6 months depending on whether he cooperates or contests anything.

Been trying to reach the child support office for weeks with questions about my case and ALWAYS get disconnected after waiting forever. So annoying! I finally used this service called Claimyr (claimyr.com) that got me through to an actual person at child support in like 10 minutes. You might get asked to provide updated income info at that point. I got basically zero updates until suddenly one day I got a letter that they'd established an order.

Wait they can acutally FIND the fathers?? Mine disappeared 3 years ago and they havent found him yet lol. But i still get my calworks no problem. As long as YOU cooperate they cant deny your benifits.

•That's correct - as long as you cooperate with DCSS by providing all the information you have, your CalWORKs benefits cannot be reduced or stopped, even if they never locate the other parent. The requirement is about your cooperation, not their success in establishing support.

I went through this exact situation last year! The child support office found my ex within 3 weeks because he was in the court system for a criminal case (not DUI but similar situation). Here's what happened for me: 1. They located him through court records 2. Sent him papers about the child support case 3. He didn't respond so they set a default order 4. Started garnishing his wages about 2 months later 5. I got a letter each time something happened, but not detailed info Just make sure you keep your address confidential if you're worried. •They pretty much handled everything after I gave the initial info. I did have to fill out one more form about my expenses for the child when they were setting the order amount. Just FYI - if he contests anything, you might have to attend a court hearing, but most cases don't go that far.

•The child support office doesn't specifically tell him you're on CalWORKs. They just inform him that they're establishing a child support order. However, if it goes to court, the documents might mention that the case was referred by the public assistance office. If you have concerns about him knowing your business, mention this to your child support worker.

One thing nobody mentioned - with CalWORKs, most of the child support collected goes to the county to "pay back" your Cash Aid. You only get the first $100 (for one child) or $200 (for two or more children) of what they collect each month. The rest goes to reimburse the government for your benefits. This is called the "disregard amount" - you get to keep that much, and the rest offsets your aid. So don't expect to get both the full child support and your full CalWORKs amount. Once you're off CalWORKs, then you'll get the full support payment.

•That's exactly right. It's called "recoupment" - the state recoups the cost of your Cash Aid from the child support. But remember, that disregard amount ($100 for one child) is in ADDITION to your regular CalWORKs benefit, so you do come out ahead.

One question - if they do establish a support order but he just doesn't pay, does that affect my CalWORKs benefits at all? •Welcome to the system! Your CalWORKs benefits won't be affected if he doesn't pay once the order is established. The requirement is just that YOU cooperate with child support - providing information, attending hearings if needed, etc. If he chooses not to pay, that's on him and DCSS will use enforcement tools like wage garnishment, asset seizure, license suspension, etc. As long as you're doing your part, your benefits are safe. It's actually pretty common for non-custodial parents to be uncooperative initially, but DCSS has a lot of ways to collect once they establish the order.
