wait does calfresh replace stolen money now? when my balance got stolen last year they told me it was just gone forever like a debit card
Yes, this changed with Assembly Bill 1958 which went into effect January 1, 2023. California now replaces stolen CalFresh benefits if you report the theft within 10 days of discovering it. This applies to electronic theft (skimming, phishing, etc.). You need to complete form EBT-2259 and submit it to your county office. The state can replace up to two months' worth of benefits that were stolen.
UPDATE: Just wanted to let everyone know what happened in case it helps someone else. I followed the advice here and: 1. Called EBT customer service to report theft and freeze my account 2. Filed a police report online (took screenshots) 3. Went to my county office with the EBT-2259 form, police report, and transaction history 4. Explained I had no food for my kids They processed an emergency allotment right there! Got $313 loaded today to help until the full replacement goes through. The worker said they're seeing tons of these cases and recommended ALWAYS freezing the card when not actively shopping. Also said to never use the card at ATMs in gas stations or convenience stores as they're the most commonly compromised. Thanks everyone for your help during this nightmare!
just want to add that freee tax prep can get really busy right before the filing deadline so try to go in february if u can... i waited until april last year and had to wait 3 hours even WITH an appointment cause they were so backed up
To address your original question more specifically - the tax refund itself won't affect your CalFresh benefits the month you receive it. Tax refunds are considered non-recurring lump-sum payments, which means they don't count as income for CalFresh. However, if you keep the money and it puts you over the resource limit ($4,250 for most households with someone who is elderly or disabled, $2,750 for others), it could potentially affect your eligibility in future months. Most people spend their refunds relatively quickly on necessities though, so this rarely becomes an issue. Just make sure you're tracking and reporting any actual earned income properly on your SAR7 forms throughout the year.
Just checking back - were you able to get through to your county office? Make sure to ask specifically for the "expedited replacement" process. Under California regulations, if you report theft within 4 calendar days, the county must make a determination within 10 days, not 30. Having a police report significantly improves your chances. You can also contact your nearest CalFresh outreach partner (like a community action agency) as they sometimes have emergency food resources while you wait. If you have school-age children, talk to their school about emergency meal programs as well.
I finally got through! Used that Claimyr service someone mentioned and it actually worked - got a call back from a worker in about 45 minutes. They're sending me the theft form by email and I filed a police report online. The worker said I should get emergency replacement benefits in 3-5 days since I reported it right away. Thank you all for your help - this community is amazing!!
dont forget 2 also check ur bank accounts if u have any!! these skimmer things can steal regular debit cards 2. my cousins entire checking account got emptied after using a gas station ATM
One more important tip: Make sure to change your PIN as soon as you report the theft, even before you get a new card. Sometimes thieves can access your account multiple times if the PIN remains the same. Also, avoid using easily guessed PINs like birthdays or address numbers. And never respond to text messages about your EBT benefits - the county never sends texts asking for your card info or PIN.

i thought calfresh was switching to that new system where u get a text code before the transaction goes thru?? my worker told me that was happening in 2025 to stop these scams. has anyone gotten that feature yet? seems like it would prevent this whole mess

•The two-factor authentication system for EBT is being piloted in a few counties but isn't fully implemented statewide yet. It's scheduled for complete rollout by July 2025. In the meantime, encourage your girlfriend to check her EBT balance frequently and change her PIN regularly.

UPDATE: You guys are amazing! She went to the office in person today with all the documentation mentioned here, specifically asked for the EBT-2259 form, and mentioned the 10-day policy requirement. The worker admitted they'd been using the wrong form! They reprocessed everything and said she should have the benefits back within 5 business days - AND they gave her a $75 emergency food voucher to use immediately. Thank you all so much for your help!
