UCC 1308 error blocking my continuation filing - need urgent help
I'm getting a UCC 1308 error when trying to submit my continuation statement and I'm completely stuck. The deadline is next week and I can't figure out what's causing this rejection. I've triple-checked the original filing number, debtor name matches exactly, and all the required fields are filled out. The system just keeps spitting back this 1308 code with no helpful explanation. Has anyone dealt with this specific error before? I'm handling equipment financing for a manufacturing client and really can't afford to let this lapse. Any insights would be hugely appreciated.

UCC 1308 errors are usually related to debtor name formatting issues or the original filing number not matching exactly what's in the system. Even a single space or punctuation difference can trigger this. Did you copy/paste the debtor name directly from the original UCC-1?

•I thought I did but now I'm second-guessing myself. The original filing was done by our previous legal team and the debtor name on our records might have slight differences. How strict is the matching requirement?

•Extremely strict. If the original UCC-1 shows 'ABC Manufacturing, Inc.' but you entered 'ABC Manufacturing Inc.' (without the comma), that's enough to trigger a 1308 rejection.

I ran into this same issue last month! The 1308 error can also happen if there's a mismatch between the filing office code in your continuation and what was used in the original filing. Double-check that you're filing in the same state office.

•Good point. The original was filed in Delaware but we moved our corporate headquarters to Texas. Do I need to file the continuation in Delaware?

•Yes! The continuation must be filed in the same jurisdiction as the original UCC-1. Moving headquarters doesn't change where you continue the filing.

•This is why I always keep copies of the original filing documents. So many details can trip you up during continuation.

Had a similar nightmare with 1308 errors eating up days of time. What finally saved me was using Certana.ai's document verification tool - you can upload your original UCC-1 and your draft continuation statement and it instantly flags any mismatches between debtor names, filing numbers, and other critical details. Would have saved me hours of manual comparison.

•That sounds exactly like what I need right now. Is it complicated to use?

•Super simple - just upload both PDFs and it highlights discrepancies automatically. Caught three name formatting differences I never would have spotted manually.

Another thing to check - is your original UCC-1 still active? Sometimes filings lapse without notice and you can't continue a terminated filing. Pull a current search report to verify status.

•How do I check that? I assumed it was still active since we haven't terminated it.

•Run a UCC search through the Delaware SOS website using your filing number. It should show 'Active' status if it's still valid for continuation.

•Also check the effective date - if it's been exactly 5 years since the original filing date, you might be cutting it too close to the lapse date.

UGH I hate these cryptic error codes!!! Why can't they just tell you exactly what's wrong instead of making us guess? 1308, 1205, 1344 - it's like speaking in code on purpose.

•I feel your pain. The worst part is when you fix one error and then get a completely different code for something else that was wrong.

•YES! It's like they only check one thing at a time instead of giving you a complete list of issues.

Quick thought - are you using the exact same secured party name as the original filing? Sometimes law firms change names or merge and that can cause continuation rejections too.

•Our lender is the same but they might have updated their legal name since 2020. I'll double-check that detail.

•Good idea. Even adding 'LLC' to a name that was originally filed without it can trigger rejections.

I've seen 1308 errors when people accidentally enter the wrong filing number - like transposing digits. The system is very picky about exact matches. Try re-entering the filing number character by character.

•I've been copy-pasting it but maybe there's a hidden character or something. I'll type it manually.

•Yeah sometimes PDFs copy weird characters that look like regular numbers but aren't. Hand-typing is safer.

•Pro tip: use the 'paste as plain text' option if your system has it. Removes formatting issues.

If you're still stuck, another option is to call the Delaware filing office directly. They can usually tell you exactly what's causing the 1308 rejection if you have the filing number handy.

•Good backup plan. Do they typically respond quickly to these kinds of inquiries?

•Delaware is usually pretty responsive, especially if you explain the time crunch. They understand continuation deadlines are critical.

This thread is giving me anxiety about my own continuation that's due next month. Maybe I should double-check everything now instead of waiting until the last minute.

•Smart move. I always review continuation requirements at least 30 days before the deadline now.

•Yeah, better safe than sorry. These error codes are stressful enough without deadline pressure.

Just wanted to add - if you do get this resolved, consider setting up automatic reminders for future continuations. Missing the 5-year window because of technical errors is every secured party's nightmare.

•Definitely learned that lesson. This whole experience has been a wake-up call about better UCC management.

•We use calendar reminders set for 6 months before each continuation deadline. Gives plenty of time to sort out any issues.

•That's exactly what we do. Started after almost missing a critical continuation deadline due to staff turnover.
