Washington ESD - Can you get unemployment if fired for looking for another job?
My supervisor found out I was interviewing at other places and fired me last Friday. They said it showed 'disloyalty' and that I wasn't committed to the company. I wasn't stealing time or using company resources - just had a couple phone interviews during my lunch breaks. Now I'm wondering if Washington ESD will deny my unemployment claim because technically I was fired for misconduct? Has anyone dealt with this situation before?

That's not misconduct in Washington. Job searching while employed is actually encouraged by most employment lawyers. As long as you weren't doing interviews on company time or using their equipment, you should be fine for UI benefits.

•That's a relief. I was really worried they'd consider it misconduct. Should I mention the interviews were during lunch when I file?

•Definitely mention that detail. It shows you were being professional about the job search.

I got fired for the same thing 2 years ago and Washington ESD approved my claim. The adjudicator said looking for work isn't grounds for disqualification unless you're violating company policy in a serious way.

•How long did your adjudication take? I'm nervous about the waiting period.

•About 3 weeks back then. But I've heard it's faster now if your case is straightforward.

You'll probably need to explain the circumstances clearly when you file. Washington ESD will look at whether your actions were reasonable and if the firing was really justified. Job searching isn't misconduct under RCW 50.20.066.

•Should I gather any evidence about the interviews being during lunch? I have some calendar entries showing the times.

•Yes, keep those records. Also any emails or documentation about the firing reason. It'll help if there's an appeal.

Ugh this happened to my friend too. She couldn't get through to Washington ESD for weeks to explain her situation. The phone lines are impossible! She ended up using some service called Claimyr that helped her get through to an actual person. Might be worth checking out at claimyr.com if you can't reach them.

•Never heard of that service. Did it actually work for her?

•Yeah she said it was a lifesaver. Got connected to an adjudicator within a day. There's a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works.

•Hmm sounds too good to be true. How much does something like that cost?

File your claim immediately and be completely honest about the circumstances. Washington ESD sees cases like this regularly. They understand that job searching is a normal part of career management.

•I'll file tonight. Should I wait for any paperwork from my employer first or just go ahead?

•File now. You can always add information later if needed. Don't delay filing because of missing paperwork.

This is exactly why I hate at-will employment. Companies can fire you for literally anything and then you have to fight for benefits. It's ridiculous.

•True, but unemployment insurance exists specifically to protect workers in situations like this. The system does work when used properly.

•I guess. Still frustrating that people have to go through this stress.

Make sure you document everything about your job search activities. Times, dates, methods used. It shows you were being professional about it.

•Good point. I have screenshots of the interview confirmations with timestamps.

Wait can they really fire you just for looking? That seems illegal somehow.

Olivia Martinez
•Unfortunately yes, in at-will states they can fire you for almost any non-protected reason. But that doesn't mean you lose unemployment benefits.

•That's messed up. At least unemployment is there as a safety net.

The key legal standard is whether your conduct was so egregious that it constitutes willful misconduct. Job searching during personal time doesn't meet that threshold in Washington.

•That makes sense. I wasn't doing anything dishonest or harmful to the company.

•Exactly. You have every right to look for better opportunities.

I tried calling Washington ESD about a similar issue last month and could never get through. Super frustrating when you need answers about your benefits.

•That's exactly why my friend used Claimyr. She was on hold for hours before finding that service.

•I might have to look into that if I have issues again.

Your employer sounds petty tbh. Most reasonable managers understand people want career growth.

•Yeah it was pretty shocking. I thought we had a good working relationship.

Just to be clear - were you using company email or phone for the interviews? That could potentially complicate things.

Lucas Kowalski
•No, everything was on my personal phone during lunch breaks. I was careful about that.

•Perfect. That strengthens your case significantly.

File ASAP. The sooner you get your claim in, the sooner you can start the process. Don't let their bogus firing intimidate you.

•You're right. I'm filing tonight for sure.

This thread is giving me hope. I'm in a similar situation and was worried about being denied benefits.

•Each case is different but job searching during personal time is generally protected. File your claim and explain the circumstances.

Remember to keep detailed records of your job search activities going forward. Washington ESD requires documentation for ongoing eligibility.

Your situation is exactly why Washington ESD exists. Don't let sketchy employers scare you away from filing.

•You're absolutely right. I'm not going to let them intimidate me.

Final thought - if Washington ESD does flag your case for adjudication, be patient but persistent. These cases usually resolve in the worker's favor when the facts are clear.

Lucas Kowalski
•That's reassuring. I'll be ready to provide all the details if needed.

I went through something similar in Washington about 18 months ago. Got fired for "attitude issues" after my manager found out I was networking at industry events. Filed my UI claim the same day and was approved within 2 weeks. The adjudicator told me that professional networking and job searching are completely normal activities that don't constitute misconduct. Your situation sounds even more clear-cut since you were doing interviews during your own lunch time. Don't stress too much about it - Washington ESD is pretty fair about these cases.
