Terminated from job can I get unemployment benefits through Washington ESD?

I was let go from my warehouse job last Friday after working there for 8 months. My supervisor said it was due to "performance issues" but I think it was really because I questioned some safety practices. Can I still file for unemployment benefits with Washington ESD? I'm worried they'll deny my claim since I was terminated instead of laid off. Has anyone been approved for UI after being fired? What should I expect during the application process?

Yes, you can definitely apply for unemployment even after being terminated. Washington ESD will investigate the circumstances of your termination during the adjudication process. If you were fired for misconduct, that's different than being fired for performance issues or inability to do the job. File your claim immediately - you have nothing to lose by applying.

Thank you! Should I mention the safety concerns I raised when I file my claim? I documented some of the issues I brought up to management.

0 coins

Absolutely include that information. If you were terminated for raising legitimate safety concerns, that could actually work in your favor. Keep all your documentation handy.

I got fired from my last job too and still got approved for benefits. The key is being honest about what happened. Washington ESD will contact your employer to get their side of the story. As long as you weren't stealing or doing something really bad, you should be fine.

0 coins

That's reassuring to hear. How long did the whole process take for you?

0 coins

About 3 weeks from when I filed until I got my first payment. There was some back and forth during adjudication but it worked out.

The main thing Washington ESD looks for is "willful misconduct." Being fired for performance issues usually doesn't qualify as misconduct. However, if you're having trouble reaching someone at Washington ESD to discuss your specific situation, I found this service called Claimyr (claimyr.com) that actually gets you through to a real person. They have a demo video at https://youtu.be/7DieNd3C7zQ showing how it works. Saved me hours of trying to call.

0 coins

Interesting, never heard of that service before. Does it actually work or is it just another scam?

0 coins

It's legitimate. I was skeptical too but it actually connected me to a Washington ESD agent within 10 minutes. Way better than sitting on hold for hours.

0 coins

whatever you do dont lie on your application!! they WILL find out and then you'll be disqualified and have to pay everything back. just be honest about being terminated and let them investigate

0 coins

Definitely planning to be completely honest. Better to potentially get denied than to get in trouble for lying.

0 coins

This is so important. I know someone who lied about their termination and got caught. Had to pay back thousands.

0 coins

File online through SecureAccess Washington right away. Don't wait. Even if your claim gets denied initially, you can appeal the decision. I've seen plenty of people win their appeals after being terminated.

0 coins

Already started the online application. It's asking for a lot of details about my employment history.

0 coins

Yeah it's pretty thorough. Make sure you have your pay stubs and employment dates ready. You'll need all that info.

0 coins

The whole system is rigged against workers anyway. They'll find any excuse to deny your claim. I was denied twice before finally getting approved and that was for a layoff, not even being fired.

0 coins

That's not really helpful. While the system can be frustrating, most legitimate claims do get approved eventually.

0 coins

Easy for you to say. Some of us have been through the wringer with Washington ESD multiple times.

0 coins

What kind of performance issues did they claim? If it was something like not meeting quotas that were unrealistic, that might not count as misconduct. The devil is in the details with these cases.

0 coins

They said I was too slow picking orders and made too many mistakes. But I think it was really about me questioning why we weren't following proper lifting procedures.

0 coins

That sounds like retaliation for raising safety concerns. Definitely mention that in your claim. Washington ESD takes workplace safety seriously.

0 coins

I'm going through something similar right now. Got terminated 2 weeks ago and my claim is still in adjudication. It's nerve-wracking waiting to hear back from them.

0 coins

How long have you been waiting? I'm worried about how long this whole process might take.

0 coins

Filed 2 weeks ago and still nothing. I've been trying to call Washington ESD but can never get through to anyone.

0 coins

That's exactly why I mentioned Claimyr earlier. They can get you connected to speak with someone about your adjudication status instead of waiting indefinitely.

0 coins

Make sure you keep filing your weekly claims even while your initial claim is being reviewed. If you get approved, you'll get backpay for those weeks. If you don't file weekly, you lose those weeks permanently.

0 coins

Good point! I wasn't sure if I should file weekly claims before getting approved. Thanks for clarifying that.

0 coins

Yeah this is crucial. I learned this the hard way and lost 3 weeks of benefits because I didn't file weekly claims right away.

0 coins

Document everything you can remember about your termination. Dates, conversations, any witnesses. If it goes to a hearing, you'll want all that information organized and ready to present.

0 coins

I've been writing down everything I can remember. Should I reach out to any of my former coworkers who witnessed the safety issues I raised?

0 coins

If they're willing to provide statements or testimony, that could be very helpful. Just be careful about putting them in an awkward position with their current employer.

0 coins

washington esd is so backed up right now. my friend applied 6 weeks ago and still hasnt heard anything about her claim status. the whole system is broken

0 coins

6 weeks seems excessive even for Washington ESD. Has your friend tried calling to check on the status?

0 coins

shes tried calling like 50 times and either gets busy signal or gets disconnected after waiting on hold forever

0 coins

I work in HR and I can tell you that most termination cases aren't actually misconduct in the legal sense. Performance issues, attendance problems, not being a good fit - these usually don't disqualify you from unemployment benefits. Misconduct has to be willful and substantial.

0 coins

That's really helpful to know from someone in HR. It makes me feel more optimistic about my chances.

0 coins

What about if someone gets fired for violating company policy? Does that automatically count as misconduct?

0 coins

Not automatically. It depends on the policy and whether the violation was intentional and work-related. Each case is evaluated individually.

0 coins

Just went through this exact situation 3 months ago. Filed immediately after being terminated, claim went to adjudication, and I was approved after about 4 weeks. The waiting is stressful but hang in there.

0 coins

4 weeks feels like forever when you have bills to pay, but I'm glad it worked out for you. Did Washington ESD contact your employer during the investigation?

0 coins

Yes, they did a fact-finding interview with both me and my former employer. Just be honest and provide any documentation you have.

0 coins

Has anyone here actually used that Claimyr service mentioned earlier? I'm getting desperate trying to reach Washington ESD about my pending claim.

0 coins

I used it last month when I couldn't get through their regular phone lines. It actually worked - got connected to an agent in about 15 minutes. Worth trying if you're stuck.

0 coins

How much does it cost? I'm already stressed about money and don't want to pay for something that might not work.

0 coins

I'd rather not discuss specific costs in the forum, but it was reasonable considering how much time it saved me. Check their website for current pricing.

0 coins

The fact that you documented safety concerns and were terminated shortly after raising them could actually strengthen your case. Washington state has strong whistleblower protections for workplace safety issues.

0 coins

I hadn't thought about whistleblower protections. Should I mention that specifically when talking to Washington ESD?

0 coins

Definitely. If you were retaliated against for raising legitimate safety concerns, that's not misconduct on your part - it's misconduct by your employer.

0 coins

just file and see what happens. worst case they say no and you appeal. best case you get approved right away. you literally have nothing to lose by applying

0 coins

You're absolutely right. I've already started the application process and I'm feeling more confident after reading everyone's responses.

0 coins

Exactly! And even if you get denied initially, the appeals process gives you another chance to present your case.

0 coins

Make sure you understand the job search requirements once you start receiving benefits. You'll need to log your job search activities and be able and available for work each week.

0 coins

Good reminder. I've been applying to jobs already but I should start keeping better records of my job search activities.

0 coins

WorkSourceWA is helpful for tracking your job search activities. You can log everything there and it integrates with your weekly claims.

0 coins

UPDATE: I just got approved! Filed my claim 5 weeks ago after being terminated and finally got the good news today. Don't give up hope everyone!

0 coins

That's amazing news! Congratulations! This gives me hope for my own situation.

0 coins

Were you terminated for performance issues too? What made the difference in your case?

0 coins

Similar situation - performance related termination. I think what helped was being completely honest and providing detailed documentation about what happened.
