OAH hearing decision timeframe - still waiting after 2 weeks
I had my Office of Administrative Hearings (OAH) phone hearing with a judge on May 13th about my denied standby status, and I'm still waiting for a decision letter. It's been 2 weeks now and I'm getting anxious because my savings are running really low. The judge said something about decisions typically being mailed within 7-10 business days but it's been longer than that now. Does anyone know how long it typically takes to get the decision after an OAH hearing? Is there any way to check the status? I've tried calling the OAH office but just get voicemail. My rent is due next week and I'm starting to panic about what happens if they deny my appeal.

I received my decision 12 business days after my hearing last month (so just over 2 weeks). The judge told me 7-10 business days too, but it definitely took longer. They're probably backed up with lots of cases. You should be able to check your hearing status on the OAH portal online - did you set up an account when you requested the hearing?

•Thanks for the response. Yes, I have an OAH portal account, but when I log in it just shows "Decision Pending" with no other details. I'm worried they might have sent it but it got lost in the mail or something.

The timeframe can vary quite a bit based on the complexity of your case and their current workload. In my experience helping people with appeals, I've seen decisions take anywhere from 10 business days to almost 4 weeks in some cases. If your portal shows "Decision Pending" that means they haven't issued the final order yet - so nothing is lost in the mail. One important thing to remember: even if you're still waiting for the decision, make sure you're continuing to file your weekly claims! If you win your appeal but haven't been filing weekly, you won't receive payments for those missed weeks.

mine took 3 WEEKS!!! and then when i finally got it they still ruled against me even tho my boss literally admitted in the hearing he fired me for taking approved sick leave!!! the whole system is rigged against workers 😡

•That sounds really frustrating. Did you file another appeal to the Commissioner's Review Office? You have 30 days after receiving the ALJ's decision to appeal to the next level. If your employer admitted to firing you for taking approved leave, that should be pretty clear misconduct on their part, not yours.

Have you tried calling your assigned judge's assistant? Their contact info should be on any paperwork you received about your hearing. They can sometimes give you a status update if you're polite. My hearing was about standby status too (I work in construction with seasonal layoffs) and I got my decision in about 2 weeks, but this was back in February when they might've been less busy.

•I didn't think of calling the judge's assistant directly! Looking back at my hearing notice now and I do see a direct number. I'll try calling first thing tomorrow morning. My standby was denied because they said my employer didn't give a definite return date, even though they clearly stated on the form I'd be back by July 15. Hoping the judge saw it my way.

If you're really getting anxious about it, you might want to try Claimyr to get through to an ESD agent who might be able to see notes on your case. I was in a similar situation last month with a pending decision, and after waiting 3 weeks I used their service to get through to ESD instead of waiting on hold forever. The agent was able to see that my decision had actually been made but was delayed in processing. Yeah, it worked for me. They basically hold your place in line and call you when they get an agent. Saved me from having to sit by my phone for hours. Just be ready with your claim ID and all that when they connect you.

my brother had hearing in march it took 18 days to get decision but he won and got all backpay so maybe longer wait means there checking things more carefully?? just a thought

Quick update on timeframes - I just helped someone last week who received their decision on day 17 after their hearing. The judge actually apologized during the hearing and mentioned they're experiencing staffing shortages at OAH right now, which is causing some delays in processing decisions. So the longer timeline seems to be affecting many people currently.

One thing to keep in mind: OAH decisions are dated when the judge signs them, but it can take 2-3 additional business days for them to be mailed out. And then another 2-4 days for USPS delivery. So the actual time from hearing to having the decision in your hands can be considerably longer than the official decision timeframe. If it's been more than 20 business days (about a month total), you can request an update directly from OAH through their online portal by submitting a message through your case. They're generally good about responding to these inquiries within 48 hours.
