Laid off after just 3 days - can I continue ESD benefits without getting denied?
I'm super stressed about my unemployment situation right now. I was receiving regular UI benefits ($444/week) and then found what I thought was a good job opportunity. Well, I started the job last week, worked for exactly 3 days, and then they let me go saying I wasn't a good 'culture fit' (whatever that means!). When I filed my weekly claim, I honestly reported those 3 days of work, and my benefit dropped to only $68 for the week. My question is what do I do now? Do I just continue filing my weekly claims like normal? Do I need to upload the termination letter that mentions the 'culture difference' reason? I'm worried because ESD will see that I started working but then stopped. I don't want them thinking I quit and then denying my future benefits. I didn't quit - they let me go! Is there any special process I need to follow to make sure my benefits continue without interruption? I really need that full $444 payment to cover my bills next week.

You definitely need to keep filing your weekly claims without interruption. Since you were let go and didn't quit, you should still qualify for your regular benefits. When you file your next weekly claim, report zero earnings and answer 'no' to the question about whether you're still working for that employer. In the section where it asks if you lost work, select 'yes' and choose the option that best describes your situation (probably 'discharged' or 'laid off'). It would be helpful to upload the termination letter through your ESD portal as documentation. The system might flag your claim for review when they see the sudden job start and stop, which could put you into adjudication. Having that documentation ready will speed things up.

•Thank you so much! I'll definitely keep filing weekly. So when it asks why I'm no longer working there, should I select 'fired' or 'laid off'? The letter doesn't specifically say either - it just mentions the culture fit issue. I'm worried about selecting the wrong option and getting denied.

same thing happpened to me last winter!! they will probably put your claim in adjudication for a few weeks while they figure it out. make sure u keep claiming every week even if ur not getting paid right away. they'll backpay u once they approve it

•Oh no, I can't wait weeks for adjudication! Did they eventually give you all your back benefits? Did you have to do anything special to speed up the process?

Select 'discharged' not 'fired' on your weekly claim form. There's a legal difference. 'Fired' implies misconduct which can disqualify you, but 'discharged' for not being a good culture fit is actually a qualifying separation reason. You didn't do anything wrong, they just decided it wasn't a match. Also, make sure you upload that termination letter ASAP through your eServices account. Go to your dashboard, select 'Upload a Document,' and choose 'Separation Information' as the document type. This creates a paper trail showing you didn't voluntarily quit. ESD will likely put your claim into adjudication to review the circumstances, but having documentation ready helps tremendously. Keep filing weekly claims during this period - if approved, you'll get all back payments owed.

•This is super helpful! I just checked and my termination letter specifically uses the phrase "not aligned with company culture" as the reason. I'll upload it right away and select 'discharged' as you suggested. I'm still nervous about the adjudication process though - is there any way to check the status?

After reading ur post, i wanna share that i went thru almost the exact situation last month! I worked 4 days at a new job before getting let go for "not being the right fit." ESD did put my claim into adjudication but it was only for about 10 days (not weeks like some people experience). The key thing that helped me was uploading the termination notice right away. One tip - after uploading docs, I also called ESD directly to explain the situation. It took FOREVER to get through to them though!! I finally found this service called Claimyr (claimyr.com) that got me through to an actual ESD agent in under 25 minutes when I'd been trying for days on my own. They have a video showing how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 Talking to an agent directly helped me verify everything was in order and they actually removed the hold on my account while I was on the phone. Worth considering if your claim gets stuck!

DONT SELECT FIRED!!!! If u pick fired they automaticlly think misconduct and will deny ur benefits. This system is designed to trick people. U were 'laid off due to not being a good fit' NOT fired. Big difference in how ESD proccesses it. Upload the letter and keep claiming weekly!!! Also be careful cuz they might make you PAY BACK that $68 they already gave u if they decide to deny everything. I went thru this EXACT thing and had to appeal. Total nightmare.

•Omg that's terrifying! Why would they make me pay back the $68? That doesn't make sense since I accurately reported my work days. Now I'm even more stressed about this whole situation. Did your appeal work out?

Just to clarify some confusion in this thread: The most accurate selection for your situation would be 'discharged' not 'laid off.' Laid off typically refers to position elimination or reduction in force, while discharged means the employer terminated you for reasons other than misconduct (like not being a culture fit). And regarding the concern about paying back the $68 - you won't have to pay that back since you properly reported your earnings for those days. The previous commenter's situation was likely different. As long as you continue to file accurately, you should be fine. Your claim will almost certainly go into adjudication, but with proper documentation and honest reporting, you should maintain eligibility. The culture fit issue is generally considered an employer decision rather than employee misconduct.

•Thank you for clearing that up! I feel better about selecting 'discharged' now. I just submitted my weekly claim and uploaded the termination letter. Fingers crossed it doesn't take too long in adjudication.

This happened to me with a different twist - I worked a week at a new job before quitting because it wasn't as advertised. I was honest with ESD, and yes, my claim went into adjudication. I kept filing weekly as everyone suggests, and after about 3 weeks, they approved my continued benefits retroactively. I think your situation is actually stronger than mine since you didn't quit - they let you go. Just be 100% honest in your reporting, upload that letter, and be patient with the process. The most important thing is to keep filing those weekly claims even if you don't see payments coming through right away.

•3 weeks in adjudication sounds rough, but I'm glad it worked out for you! I'll definitely keep filing weekly. Really hope mine gets resolved faster since I didn't quit.

btw did anyone tell u that u need to keep doing ur job search activities even during adjudication?? u still gotta do the 3 job search things each week or they can deny u for that reason even if the discharge issue gets approved

•Thanks for the reminder! Yes, I've been keeping up with my 3 job search activities each week. Actually applying to even more places now after this bad experience.

Just wanted to follow up on this thread. Based on your situation, here's what you should expect: 1. Your claim will likely enter adjudication for 2-4 weeks 2. An ESD adjudicator may call you to get your side of the story 3. They'll also contact your employer for their version 4. Since 'not a culture fit' is generally considered a non-disqualifying reason, you should be approved 5. Once approved, you'll receive all back payments for the weeks you claimed If for some reason your claim stays in adjudication for more than 4 weeks, that's when you should consider more aggressive follow-up. The documentation you've uploaded should be sufficient, but the ESD backlog can sometimes cause delays.

•This timeline really helps set my expectations, thank you! I'll try to be patient during the adjudication period. I really hope the employer confirms the same reason they gave me in the letter.
