How to cancel UI benefits after being approved for FMLA?
So I just got approved for unemployment benefits last week but now my work has approved my FMLA leave (medical issue). I haven't filed my first weekly claim yet with ESD, but I'm wondering what the proper way is to cancel/stop the UI claim altogether? Do I just... not file weekly claims? Or is there some kind of formal cancellation process I need to follow? I don't want to accidentally commit fraud or have issues down the road if I need UI benefits later. Has anyone dealt with this situation before?

You don't need to do anything special to "cancel" unemployment. If you don't file weekly claims, your claim basically becomes inactive. ESD only pays benefits for weeks you actually claim, so if you don't submit weekly claims, you won't receive any money. Just make sure you don't file any weekly claims while on FMLA since that would technically be fraud (since you're not "able and available" for work while on medical leave).

My sister had this exact situation last yr. Just dont file weekly claims!! If u dont claim for like 4 weeks the claim goes inactive automatically. No biggie!

I would still call ESD directly to let them know about your situation. You never know if there might be some technicality or rule that could impact you later. I've learned the hard way that it's always better to have documentation of your communications with ESD! I spent HOURS trying to reach someone at ESD last month for a different issue. Finally used Claimyr (claimyr.com) to get through - they have this service that connects you directly to an ESD agent without the endless waiting. ESD worker here. Everyone is basically correct. There's no formal "cancellation" process for UI claims. If you don't file weekly claims, the claim simply goes inactive after 4 weeks of no activity. HOWEVER, if you're moving from UI to FMLA and then potentially back to UI later, it's good practice to call and explain your situation. This creates a record in our system that can help prevent issues if you need to reactivate your claim later. Also, very important: UI requires you to be "able and available" for work. FMLA indicates you're NOT able to work due to medical reasons. These are fundamentally incompatible programs. Never file weekly UI claims while on FMLA as this could be considered fraud.

i was on ui then got short term disability last year... didnt cancel anything just stopped filing weekly claims. went back on ui after disability ended with no problems. dont overthink it!!!

They told me you have to send a formal letter to cancel my benefits when I was in a similar situation. I mailed it to the ESD office in Olympia and they sent me a confirmation. Better safe than sorry!!!!

•This is not correct. No formal letter is required to stop UI benefits. Simply not filing weekly claims is sufficient. The claim becomes inactive after 4 consecutive weeks without weekly claims being filed. I'd be interested to know who told you this was required, as it's not standard ESD procedure.

•This would be illegal. You cannot collect unemployment while on FMLA because UI requires you to be "able and available" for work. If you're on medical leave, you're certifying that you are NOT able to work. This is literally fraud and could result in having to pay back benefits with penalties.

Update: I called ESD this morning and they confirmed what most of you said. I don't need to formally cancel anything, just don't file weekly claims. The representative did make a note in my file about the FMLA situation, which she said would help if I need to reactivate my claim later. Thanks everyone for your help!
