Need to cancel ESD unemployment claims after PFMLA appeal approval - avoid double payment!
Just found out my Paid Family Medical Leave appeal was approved (after 6 weeks of waiting!), and now I can start claiming PFMLA benefits. Problem is, I've got several unemployment claims still sitting in adjudication that haven't paid out yet. From what I understand, PFMLA pays better for my situation, so I want to go that route instead. Does anyone know the proper way to cancel pending unemployment claims? I don't want to accidentally get paid from both programs and end up with an overpayment situation. The ESD website isn't clear about this at all. Do I just stop filing weekly claims or is there a formal cancellation process I need to follow? I've tried calling but keep getting disconnected after 45+ minutes on hold.

You absolutely need to stop filing weekly claims immediately. That's the most important first step. If you continue filing weeklies while collecting PFMLA, that's a guaranteed overpayment situation. To formally cancel your UI claim, you should: 1. Stop filing weekly claims right away 2. Send a secure message through your eServices account specifically requesting claim cancellation 3. Document everything with screenshots and confirmation numbers I went through something similar when I got recalled to work while my claim was still in adjudication. The adjudicator eventually called me about 3 weeks after I stopped filing, and I explained I was back at work. They formally closed my claim at that point.

•Thank you! I'll stop filing today and send that secure message. Do you remember what category you selected when sending the message? There are like 12 different options and none seem to match my situation exactly.

OMG be sooo careful with this!!!! my frend got aproved for both and didnt cancel unemployment fast enough and now shes dealing with a $5700 overpayment!!! ESD is super srict about this and they WILL make you pay it all back with penaltys. defintely stop filing weekly claims RIGHT NOW

•That's exactly what I'm worried about! Did your friend have to pay penalties on top of the overpayment amount? I'm definitely stopping my weekly claims today.

To provide some clarity here: Unemployment Insurance (UI) and Paid Family Medical Leave (PFMLA) are two separate benefit programs administered by ESD, and you cannot legally collect both for the same time period. Here's the proper procedure: 1. Stop filing weekly UI claims immediately 2. Send a message through your eServices account explaining your situation (use "Claim Questions" or "Other" category) 3. For extra protection, call ESD at 833-572-8400 to verbally confirm the claim withdrawal Since your UI claims are still in adjudication and haven't paid out, you should be fine as long as you take these steps promptly. The system should prevent any payments from being issued if you stop claiming. If for some reason you do receive UI payments after starting PFMLA, report this immediately to both programs to minimize complications.

•This is so helpful, thank you! I'll use the "Claim Questions" category. I've been trying to call the 833 number for days but can't get through - just endless hold times and then disconnects.

I'm struggling to reach anyone at ESD too about my standby status questions. After trying for over a week with no luck, I found a service called Claimyr (claimyr.com) that actually got me through to an ESD agent in about 20 minutes. They have a video showing how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 It was worth it for me because I needed to speak with someone directly to fix my claim issue. Might be worth considering since you need to confirm your claim is properly cancelled.

•It worked for me! The rep I spoke with was super helpful and fixed my issue right away. Beats spending days trying to get through on your own.

My sister works for the state (not ESD) and she says that technically you should be ok if you just stop filing weeklies, but its always better to formally withdraw your claim. The problem is that if you dont formally withdraw, and your claim gets approved retroactively, you could still get an overpayement notice months later when you already started PFMLA. The systems dont always talk to eachother perfectly.

I had a similar situation where I was on UI and then qualified for L&I time-loss. When I called about this, the agent told me I needed to send a secure message requesting to withdraw my claim AND I had to specifically mention the PFMLA approval with the approval date. They said it's important to create a clear record showing when one benefit ends and another begins. Makes sense since ESD handles both programs but they're processed by different departments. One other tip - take screenshots of everything you submit. The ESD message system sometimes doesn't save copies of what you send.

•Great tip about the screenshots! I've noticed messages disappearing from my inbox before. Did you have to do anything special with your L&I claim, or just inform ESD about it?

•For L&I I didn't have to do anything special since it's a totally different department. But since PFMLA is also within ESD, you definitely need to be extra clear with them. Good luck!

THE ESD SYSTEM IS RIDICULOUS!!! i had something similar happen and even though i notified them IMMEDIATELY about starting a new job, they still paid me unemployment for 2 weeks and then sent me a overpayment notice 3 MONTHS LATER claiming i committed fraud!!! i've been fighting it for 4 months now. document EVERYTHING and send it through multiple channels - secure message, regular mail, AND try to call. don't trust their system to work correctly!!!

I see a lot of panic in this thread, but I want to reassure you that your situation is actually pretty straightforward. Since you haven't been paid any UI benefits yet (they're still in adjudication), you're in a good position. The main risk comes when you've actually received payments from both programs. To summarize what you should do: 1. Stop filing weekly UI claims immediately 2. Send a secure message requesting withdrawal (use exact language: "I request to withdraw my unemployment claim effective [date] due to approval of my PFMLA claim") 3. Print or screenshot the message for your records 4. Try calling, but don't stress if you can't get through 5. Proceed with your PFMLA claim as directed Keep in mind that PFMLA has different weekly certification requirements than UI, so be sure to follow those carefully.

•This is really reassuring, thank you. I'm going to use that exact language in my message. You're right that I should be in a better position since I haven't actually received any UI payments yet. Hoping this all goes smoothly!
