How long does determination status take for Washington ESD unemployment claim?
Filed my UI claim about 6 weeks ago and it's been stuck on 'determination in progress' status this whole time. I know they have to investigate some stuff about my separation but this seems excessive? Anyone know how long Washington ESD typically takes for determinations? Getting really stressed about rent and bills piling up.

determination can take anywhere from 4-12 weeks depending on complexity, mine took 8 weeks last year

•8 weeks?? That's insane. Did you get backpay for all those weeks you were waiting?

•yeah got backpay for everything once approved but the waiting was brutal

The determination process involves Washington ESD reviewing all documentation from both you and your employer. They have to verify the reason for separation, wages, and eligibility. Complex cases involving misconduct allegations or quit vs discharge disputes take longer. Average timeframe is 6-10 weeks currently.

•Is there any way to speed this up? I've already submitted all the paperwork they asked for.

•Unfortunately no way to expedite unless it's a hardship case. Just make sure you keep filing weekly claims during the determination period.

I was in the same boat last month - couldn't get through to anyone at Washington ESD to check on my determination status. Found this service called Claimyr (claimyr.com) that actually got me connected to an agent. They have a video demo at https://youtu.be/7DieNd3C7zQ showing how it works. Agent was able to tell me exactly where my case stood in the determination process.

•Really? How does that work exactly? I've been trying to call for weeks.

•They basically handle the calling and waiting for you, then connect you when an agent picks up. Saved me hours of redialing.

•sounds too good to be true but if it works...

DETERMINATION STATUS IS THE WORST PART OF THIS WHOLE SYSTEM! Been waiting 9 weeks now and Washington ESD just keeps saying "under review". Meanwhile my savings are gone and I can't even get a straight answer about timeline.

•I feel you, the whole system is broken. Have you tried contacting your state representative?

•didn't think of that, might be worth a shot at this point

What was the reason for separation on your claim? That makes a huge difference in determination timeline. Layoffs are usually faster than quit/discharge cases.

•It was technically a discharge but I think it was really retaliation for filing a complaint. That's probably why it's taking so long.

•Yeah, those retaliation cases are complex. Washington ESD has to investigate thoroughly. Document everything you have about the complaint and retaliation.

•Did you do anything specific to get it resolved or just wait it out?

•just waited, kept filing weekly claims like they said

Important reminder: even during determination status, you MUST continue filing your weekly claims. If you don't file weekly claims during this period, you'll lose those weeks even if determination comes back favorable.

•Yes I've been doing that! Just frustrating to keep certifying when nothing is happening.

•wait you can file weekly claims even during determination? I thought you had to wait

•@profile10 No, you absolutely must keep filing weekly claims during determination or you'll lose those benefit weeks permanently.

Try calling right at 8am when the phone lines open. Sometimes you can get through faster in the morning before everyone else starts calling.

•I've tried that so many times, either busy signal or get disconnected after waiting forever.

If you're really desperate you could try that Claimyr thing someone mentioned earlier. I used it last week and actually got through to Washington ESD. Cost some money but I was able to find out my determination was almost complete.

Oliver Weber
•How much does it cost? At this point I'm willing to pay something reasonable to get answers.

Diego Flores
•It wasn't too expensive, especially compared to the stress of not knowing what's happening with my claim.

The determination process is supposed to be completed within a "reasonable time" according to Washington ESD but they don't define what reasonable means. In practice it's 6-14 weeks depending on case complexity and current workload.

•14 weeks is ridiculous for people who need money to survive

•I agree it's too long, but that's the reality of the current system capacity

Have you checked if there are any outstanding fact-finding questionnaires or documents Washington ESD is waiting for? Sometimes claims get delayed because they're waiting for additional info.

Oliver Weber
•How do I check that? My online account doesn't show anything pending.

•Check under the correspondence section and also the fact-finding tab. Sometimes things don't show up on the main dashboard.

My brother went through this exact situation. Determination took 10 weeks but he got backpay for everything once it was approved. Just hang in there and keep filing weekly claims.

•Thanks, that gives me some hope. Did he do anything specific to help his case?

Zara Malik
•He made sure to respond quickly to any requests from Washington ESD and kept detailed records of everything.

One thing that helped me was getting my former employer to respond quickly to Washington ESD's requests. The longer they take to respond, the longer your determination takes. You might want to call your old HR department and ask them to prioritize any Washington ESD correspondence.

•That's a good idea, though I'm not sure they'll cooperate since they're the ones who fired me.

•Worth a try, sometimes they just want to get it over with too

The waiting is the hardest part. I know everyone says keep filing weekly claims but it feels pointless when you're not getting paid. At least if determination goes in your favor you'll get all that backpay in one lump sum.

Oliver Weber
•Yeah that backpay would definitely help at this point. Just hope it comes through soon.

•Hang in there, most determinations eventually get approved unless there was clear misconduct

If you do end up trying Claimyr like others mentioned, make sure you have your Social Security number and PIN ready since the agent will need to verify your identity when you get connected.

•Good tip, I'll keep that in mind. At this point I'm willing to try anything to get some answers about my determination.
