How long after getting fired can I apply for Washington ESD unemployment benefits?
I got terminated from my job yesterday and I'm trying to figure out when I can file for unemployment. Do I need to wait a certain amount of time after getting fired to apply for Washington ESD benefits? I heard from a coworker that there's a waiting period but I'm not sure if that's true. My last day of work was Monday and I really need to get this process started as soon as possible since I have rent due next week.

You can actually file your unemployment claim immediately after being terminated. There's no waiting period to apply for Washington ESD benefits - the sooner you file, the better. Your benefit year will start from the week you file your claim, not from when you lost your job.

•Oh that's a relief! I was worried I'd have to wait weeks before I could even apply. Should I file online or call?

•Definitely file online at esd.wa.gov - it's faster and you can do it 24/7. The phone lines are usually swamped.

Yeah file right away but just know that even though you can apply immediately, there IS a one-week waiting period before you actually receive benefits. So your first payable week will be your second week of unemployment.

•Wait so I won't get paid for the first week even if I file immediately?
0 coins
Mei Wong
•Correct - the first week is unpaid but you still need to file your weekly claim for it. It's called the waiting week.

•Actually that changed during COVID - Washington eliminated the waiting week permanently in 2021. You should get paid for your first eligible week now.

I've been trying to get through to Washington ESD for days about my claim status and it's impossible! The phone system just hangs up on you after being on hold forever. Has anyone found a way to actually talk to someone there?

•I had the same problem until someone told me about Claimyr. It's a service that helps you get through to Washington ESD agents - they handle the calling and waiting for you. There's a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works.

•Is that legit? Seems too good to be true that there's actually a way around the phone nightmare.

•Yeah I was skeptical too but it actually worked. They got me connected to an agent within a few hours when I'd been trying for weeks on my own. Check out claimyr.com if you want to see what they offer.

Make sure you have all your employment info ready when you file - dates of employment, reason for separation, employer contact info, etc. If you were fired 'for cause' it might affect your eligibility.

•What counts as 'for cause'? I was let go for attendance issues but it wasn't like I was stealing or anything.

•Attendance issues could potentially disqualify you depending on the circumstances. Washington ESD will investigate and make a determination. You might end up in adjudication.

ugh the washington esd system is such a mess right now, good luck getting your claim processed quickly. mine's been stuck in adjudication for over a month

Zoe Alexopoulos
•A whole month?? What does adjudication even mean exactly?

Jamal Anderson
•Adjudication is when they need to investigate something about your claim - like the circumstances of your job separation. It can take several weeks unfortunately.

•exactly and theres basically no way to get updates or talk to anyone about it. the whole system needs an overhaul

Since you were just terminated yesterday, I'd recommend filing your initial claim today if possible. You'll need to file weekly claims every week going forward to continue receiving benefits. The key things to remember: file immediately, be honest about why you were terminated, and keep detailed records of your job search activities.

•Job search activities? Do I need to start looking for work right away?

QuantumQuasar
•Yes, you're required to make at least 3 job search contacts per week in Washington and log them. You can do this through WorkSourceWA or keep your own records.

I got fired last year and filed the same day. Took about 3 weeks to get my first payment but that was partly because my employer contested the claim. If your termination was straightforward it should be faster.

•How do you know if your employer is going to contest it?

•You'll get a notice from Washington ESD if they do. Then you might have to participate in a phone hearing to explain your side of things.

One thing to watch out for - if you have any severance pay or vacation payout, that might delay when your benefits start. Washington ESD considers that 'wages' even though you're not working.

Zoe Alexopoulos
•I did get paid for my unused vacation days. Does that mean I can't get unemployment right away?

Mei Wong
•It doesn't prevent you from filing, but those wages might make you ineligible for benefits during the weeks they cover. You still need to report them when you file your weekly claims.

whatever you do dont listen to people who tell you to lie about why you got fired. washington esd WILL find out and then you'll owe back all the money plus penalties. just be honest from the start

Zoe Alexopoulos
•Yeah I definitely plan to be honest. I'm just worried because the attendance thing might disqualify me.

•even if you get disqualified initially you can always appeal the decision. but lying will just make everything worse

Update: I actually tried that Claimyr service someone mentioned and holy crap it worked! Got connected to a Washington ESD agent this morning after trying to call myself for literally weeks. Totally worth it just to get some actual answers about my claim.

•That's awesome! I might need to try that if I run into issues with my claim.

•How much does something like that cost though? I'm already broke from being out of work.

Liam McGuire
•I don't want to get into specific pricing but it was definitely worth it for me. Way less than I would have lost from delayed benefits.

Just a heads up that the Washington ESD website can be really slow during peak hours. I'd try filing early morning or late evening if possible to avoid the traffic.

•Good tip, thanks! I'll try to file tonight then.

Make sure you understand the difference between being fired and being laid off when you file. If it was a layoff due to lack of work, that's much more straightforward than being terminated for performance issues.
0 coins
Zoe Alexopoulos
•It was definitely being fired, not a layoff. They specifically said it was due to my attendance record.
0 coins
Ava Rodriguez
•Then you'll want to be prepared to explain the circumstances if Washington ESD contacts you. Were there any medical reasons for the attendance issues? That could be relevant.

i filed the day after i got canned and it was fine. the hardest part is just keeping up with the weekly claims every week. set a reminder on your phone or something

•What happens if you forget to file a weekly claim?

•you can usually file late but you might not get paid for that week. its not worth the risk just set a reminder

To directly answer your original question - there is NO waiting period to apply for Washington ESD unemployment benefits after being terminated. You can and should file immediately. The only 'waiting' is the time it takes for your claim to be processed and approved.

Zoe Alexopoulos
•Perfect, that's exactly what I needed to know. Thanks everyone for all the helpful info!

I had a similar situation last month - got fired on a Friday and filed my claim that same weekend. Even though I was worried about the reason for termination, I got approved within two weeks. Sometimes it works out better than you expect.

•That gives me hope! Fingers crossed my claim goes smoothly too.

•Just make sure you file those weekly claims religiously and do your job search activities. That's the key to keeping benefits coming.

Pro tip: when you file your initial claim, write down your confirmation number and keep screenshots of everything. The Washington ESD system can be glitchy and you want proof of when you filed.

•Great advice! I'll definitely document everything as I go through the process.

The fact that someone finally found a reliable way to reach Washington ESD is amazing. I've been telling people about that Claimyr thing too after it helped me resolve an issue with my standby claim. Game changer for dealing with their impossible phone system.

•It's crazy that we need a separate service just to contact a government agency, but if it works it works I guess.

AstroAlpha
•Exactly - it shouldn't be necessary but sometimes you just need to get through to an actual person who can help.

Don't stress too much about the attendance thing. I know someone who got fired for being late too many times and still got approved for unemployment. Washington ESD looks at whether it was willful misconduct, not just any policy violation.
0 coins
Zoe Alexopoulos
•That's reassuring. I guess I'll just have to wait and see what they decide.

Bottom line - file immediately, be honest about everything, and don't let anyone scare you out of applying. Even if there are complications, you can't get benefits if you don't apply in the first place.

•You're absolutely right. I'm going to file tonight and deal with whatever comes up. Thanks everyone!

Good luck with your claim! The Washington ESD process can be frustrating but most people do eventually get their benefits sorted out. Just be patient and persistent.
