How does severance pay affect Washington ESD unemployment benefits - confused about timing
I just got laid off from my job after 8 years and they're giving me a severance package worth about $12,000 spread over 3 months. I'm planning to file for unemployment benefits but I'm really confused about how this severance affects my Washington ESD claim. Do I have to wait until the severance runs out to start collecting? Or can I file right away? The HR person wasn't very clear and I don't want to mess up my claim by doing something wrong. Has anyone dealt with this situation before?

You can actually file your unemployment claim right away, even while receiving severance pay. Washington ESD doesn't consider severance as wages for unemployment purposes, so it won't delay your benefits. The key thing is that severance is a one-time payment for past work, not ongoing wages. Just make sure to report it accurately when you file your weekly claims.

•That's a relief! So I should report the severance on my weekly claims but it won't reduce my benefits?

NebulaNomad
•Exactly. Report it but it shouldn't affect your benefit amount. Washington ESD treats severance differently than regular wages.

Wait, I thought any money you receive affects your unemployment? I've been putting off filing because I got a small severance too.

•That's a common misconception. Severance pay is specifically excluded from affecting Washington ESD benefits as long as it's truly severance and not payment in lieu of notice or continuation of salary.

•Good to know! I should probably file my claim then instead of waiting.

I had this exact situation last year. Got severance for 2 months and was worried about filing. Turns out I wasted 3 weeks being nervous when I could have been getting benefits the whole time. The Washington ESD adjudicator I finally spoke to explained that severance doesn't count against you.

•How did you manage to actually talk to someone at Washington ESD? I've been trying to call for days and keep getting disconnected.

•Oh man, that was a nightmare. I probably called 100 times before getting through. There's actually this service called Claimyr that helped me get connected faster - you can check it out at claimyr.com. They have a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works.

•Never heard of that service but anything that helps with Washington ESD phone system sounds useful. Those wait times are brutal.

MAKE SURE YOU UNDERSTAND THE DIFFERENCE between severance and payment in lieu of notice though! If your employer is paying you for a notice period you didn't work, that's different and WILL affect your benefits. True severance = no impact. Payment instead of working notice period = delayed benefits.

•How do I know which one mine is? The paperwork just says 'severance package' but doesn't specify.

•Check if it mentions anything about 'payment in lieu of notice' or if it's tied to a specific notice period. If it's just a lump sum based on years of service or company policy, it's likely true severance.

•Good point. Also look at how it's being paid out - if it matches your regular pay schedule, it might be payment in lieu of notice.

ugh the washington esd system is so confusing about this stuff. why cant they just make it clear on their website?

•The information is actually on their website under the 'Deductible Income' section, but it's buried pretty deep and written in bureaucratic language that's hard to understand.

•yeah exactly... who has time to dig through all that legal jargon when you just lost your job

Update: I went ahead and filed my claim online yesterday. The system asked about severance pay and I reported it. Got an email today saying my claim is being processed and should hear back within a week. Fingers crossed!

•Good for you! I'm going to file mine today too after reading all this.

•Smart move. The sooner you file, the sooner your benefit year starts, even if there are any delays in processing.

Just wanted to add that if your severance includes health insurance continuation or other benefits, make sure to report those separately. Sometimes companies bundle everything together and call it 'severance' but Washington ESD wants to know about each component.

•Mine includes COBRA coverage for 3 months. Do I need to report that as income?
0 coins
Yuki Sato
•COBRA coverage itself isn't income, but if your employer is paying for it as part of your severance package, that payment might need to be reported. I'd call Washington ESD to clarify.

•Yeah, calling can be tough though. That Claimyr service I mentioned earlier really helped me get through when I had questions like this.

I made the mistake of waiting 2 months to file because I thought my severance would disqualify me. Lost out on about $3,000 in benefits because I misunderstood the rules. Don't make my mistake!

Zara Shah
•Ouch, that's expensive! Were you able to get any of those benefits back?

Carmen Ruiz
•Nope, you can't backdate unemployment claims in Washington. Once you miss that window, it's gone. That's why I always tell people to file immediately now.

The timing thing is so important. Even if you're not sure about something, file the claim and ask questions later. You can always correct information but you can't go back in time.

Nia Wilson
•Exactly right. Washington ESD allows you to correct mistakes or provide additional information, but they won't backdate benefits to before your filing date.

quick question - does it matter if the severance is paid as a lump sum vs spread out over time?
0 coins
NebulaNomad
•For unemployment purposes, no. What matters is that it's truly severance pay rather than wages. The payment schedule doesn't change how Washington ESD treats it.

•thanks! mine is being spread over 4 months so was worried about that

Been there! Got severance when my company downsized last spring. Filed for unemployment the same week and had no issues. The key is being honest and accurate in your reporting. Washington ESD can figure out the rest.

•How long did it take for your claim to get approved?

Zoe Alexopoulos
•About 10 days from filing to first payment. Pretty standard processing time for a straightforward claim.

One thing nobody mentioned - make sure your employer coded the severance correctly on your final pay stub. Sometimes they mess that up and it can cause confusion with Washington ESD.

Zara Shah
•What should I look for on my pay stub?
0 coins
Jamal Anderson
•It should be clearly marked as severance pay, not regular wages. If it's coded wrong, contact your HR department to get it corrected before you file your unemployment claim.

this is all good info but man i hate dealing with government systems. everything is so complicated for no reason

•I hear you, but once you understand the basics it's not too bad. The severance rule is actually pretty straightforward - it just doesn't get explained well.

•i suppose... still wish it was simpler though

Another vote for filing right away! I was in a similar situation 6 months ago - got laid off with 10 weeks severance. Filed my unemployment claim the next day and got approved without any issues. The severance didn't affect my benefits at all.

Just remember that even though severance doesn't affect your unemployment benefits, you still need to report it honestly on your weekly claims. Washington ESD audits these things and you don't want to get in trouble for unreported income.

•Good point. I'll make sure to report everything accurately.

•Yes, always report but don't stress about it affecting your benefits if it's true severance pay.

The real trick is actually getting through to Washington ESD to ask questions when you're uncertain. I must have tried calling 50 times before I got through to someone who could clarify the severance rules for me.

•Yeah, that's where Claimyr really came in handy for me. Saved me hours of redialing and actually got me connected to someone who could answer my questions.

•I'll have to check that out if I ever need to call them again. The phone system is definitely their weak point.

Quick tip: when you report your severance on your weekly claim, make sure you report it in the week you actually received it, not spread out over multiple weeks (unless that's actually how you received it). The timing of when you report it matters for their records.
0 coins
Zara Shah
•Mine is being paid out monthly, so I should report each payment in the week I receive it?
0 coins
Fatima Al-Farsi
•Exactly! Report each payment when you actually receive it, not when it was originally allocated or anything like that.

Bottom line from someone who's been through this twice - file your unemployment claim as soon as you're laid off, regardless of severance. Report the severance honestly but don't let it stop you from filing. Better to ask forgiveness than permission with Washington ESD timing rules.
