ESD took huge chunk for overpayment without explanation - COVID related?
I started collecting partial unemployment last month when my landscaping job cut my hours by 50% for the winter season. Just received my first payment yesterday and was shocked to see they withheld almost $300 for some kind of overpayment! There was no explanation, no breakdown, no letter - nothing explaining what this is for or how much I supposedly owe in total. I'm pretty sure this must be related to COVID benefits from 2020-2021, but I reported everything correctly back then! Has ESD started doing this to anyone else? Just taking money without telling you why or how much you actually owe? I'm worried they'll keep taking huge chunks from every payment and I won't be able to make rent.

same thing happned to me last month!! they took $257 from my benefits without ANY notice. i called like 45 times and finally got through to someone who said it was from an overpayment from 2021. apparntly they sent me a letter last June that I never got. check ur eServices notices tab, there might be something there that explains it.

This is actually quite common with ESD. They're required by law to collect overpayments, even from years ago, and they can withhold up to 50% of your current benefits to recover those funds. You should have received a formal overpayment notice before they started collections though. I recommend checking both your physical mail from the past few months AND your eServices account under "Notices" - sometimes the letters don't arrive but the electronic notice is there. If you can't find any notice, you need to contact ESD directly to request a detailed breakdown of what you owe and why. They'll be able to tell you if it's from the COVID period and provide the total amount outstanding.

OMG the EXACT same thing just happened to my brother! They took like $400 and he had NO IDEA he owed anything from before. He's still trying to get through to someone to find out what's going on.

I experienced this last year - ESD withheld funds without proper notification. After weeks of frustration trying to reach them through their regular phone lines, I finally used Claimyr (claimyr.com) to get through to an actual agent. They have a service that basically puts you at the front of the call queue. I was skeptical but desperate, and it worked - got connected to ESD in about 20 minutes. The agent explained my overpayment in detail and even helped me set up a more reasonable payment plan instead of taking huge chunks from each payment. •In my case, they had sent the notices to my old address even though I had updated my contact info. The ESD agent was able to resend all the documentation and explain exactly why they determined there was an overpayment. For me it was because my employer reported different hours than what I had claimed for two weeks during COVID.

they ALWAYS do this!!! the esd system is BROKEN! they wait YEARS to come after you for supposed "overpayments" and then just start taking your money without warning!!! happened to me, happened to my sister, happened to everyone i know who got covid unemployment!!! their own rules were so confusing during covid that nobody knew if they were filing correctly and now we're all paying for THEIR MISTAKES!!!!

•took me THREE MONTHS of calling to find out! turns out i supposedly owe $4,300!!! for what?? they say i "didn't qualify" for benefits i got during covid even though THEY APPROVED ME! now they're taking 30% of every payment until it's all paid back which will take FOREVER!

To address the question about the total amount owed - ESD is required to provide you with that information. If you can't find it in your notices, you can request an official Statement of Overpayment by calling the Collections unit directly at 1-866-697-4831. They're slightly easier to reach than the main ESD line. Regarding COVID-era overpayments specifically, there was a lot of confusion during that time. Many people were approved initially but later found to be ineligible after additional reviews. The most common reasons were: 1. Job separation issues that weren't initially verified 2. Unreported earnings during claim weeks 3. Availability for work issues (especially for PUA claims) 4. Incorrect reporting of self-employment income If you believe the overpayment is incorrect, you have the right to appeal, but there are strict deadlines for this process.

my cousin works at esd (not in claims dept) but she says they're doing a big audit of all pandemic claims right now because of some federal requirement. lot of people getting hit with overpayments all at once.

•i applied for a waiver in December. they sent me a huge packet to fill out asking for all my finacial info, bank statements, bills, etc. still waiting to hear back. process takes FOREVER.

Update: I FINALLY got through to ESD this morning after trying for 4 days straight! Turns out I do have an overpayment from 2021. They said I reported my hours incorrectly for 8 weeks during the pandemic (although I'm positive I entered everything correctly). Total overpayment is $2,450 and they're taking 30% of each payment until it's paid off. They're supposed to be sending me the full documentation in the mail. At least now I know what I'm dealing with, though I'm definitely going to appeal this since I don't think I made any mistakes on my claims.

•Glad you got answers! Important note about appeals - you normally have only 30 days from the date of the original overpayment notice to file an appeal. Since you never received that notice, you should request that they reset the appeal timeline based on the date you were actually notified (today). Make this request in writing ASAP and keep documentation of it. When you receive the paperwork, check carefully for any calculations about your reported hours vs. what your employer reported - that's often where the discrepancies occur.
