ESD reopened claim - do I need to serve another waiting week?

I lost my construction job back in November and filed for unemployment right away. I collected benefits for about 6 weeks, then got some temporary work that lasted until recently. It's been about 5 weeks since I last filed a weekly claim, so when I logged in yesterday, the system made me reopen my claim. My question is: since I already served a waiting week when I first opened this claim in November, do I have to do ANOTHER waiting week now that I've reopened? The ESD website isn't clear about this. I'm trying to budget for rent and really need to know if I'll be missing a week of benefits. Has anyone been through this situation recently?

The good news is you DON'T have to serve another waiting week! I went through this exact thing in January. As long as it's still the same benefit year (which should be Nov 2025 to Nov 2026 if you filed in Nov), you only serve ONE waiting week per benefit year no matter how many times you reopen your claim. You should get paid for your first week after reopening.

Oh that's a huge relief! Thanks so much for confirming. My benefit year does run until November, so hopefully I'm good. I was stressing about covering bills.

just to add to what the other person said - make sure when u reopen your claim, you answer everything exactly like before. if u put different info sometimes ESD flags it & puts u in adjudication hell. happened to me when i reopened and said i could work 30 hrs instead of 40 like on my first application

Crap, I think I might have changed a couple answers about availability hours. Hopefully it doesn't cause problems.

While @profile5 is technically right, I've seen ESD mess this up constantly. If they DO accidentally make you serve a waiting week again (which happens all the time), you'll need to contact them to get it fixed. Good luck getting through on the phone though - I spent 3 days trying before I found Claimyr (claimyr.com). They got me connected to an ESD agent in about 20 minutes. There's a demo video if you want to see how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 - I was skeptical but it actually worked. Worth it when you're trying to get this kind of issue fixed quickly.

Thanks, I've never heard of that service before. I'll keep it in mind if I see they try to make me serve another waiting week. Hoping it goes smoothly though!

The ESD system is such garbage. I was in your EXACT situation and they DID make me serve another waiting week even though they weren't supposed to!!! When I finally got through to someone after WEEKS of calling, they said it was "an error in the system" but they couldn't retroactively pay me for that week. So I just lost that money. The whole system is designed to make us give up.

That's weird, they absolutely can and should backpay for waiting weeks that were incorrectly applied. You should file an appeal on that decision. You have rights even when dealing with ESD!

Quick tip - after you reopen, check your account after they process it (usually takes 2-3 days). Go to the "weekly summary" section and look at your first week after reopening. If it says "waiting week" then you need to contact them ASAP. If it says "processing" or "paid" then you're good! It's way easier to fix these things early before they finalize.

Thank you, this is really helpful! I'll definitely check this in a couple days once they process everything.

This is actually a great question and I'm going to piggyback if you don't mind! If a claim is reopened how long does it usually take to start getting payments again? My husband just reopened his and we're not sure what to expect timeline-wise

For me it took about 5-7 days from reopening to getting the first payment. Much faster than the initial claim which took like 3 weeks! As long as there are no issues flagged, reopened claims typically process pretty quickly.

I think it depends what industry ur in. Some industries get flagged for fraud more often. Im in restaurant industry and mine took 3 days to reopen no problem. My roomie is in tech and hers got flagged for identity verification that took 3 weeks to clear. So hard to predict honestly

I'm in construction so hopefully that won't raise any fraud flags. Money's tight right now so I really need this to go smoothly.

Update us with what happens! always good to know actual real experiences with ESD since their rules vs what actually happens seems to be two different things lol

Will do! I should know in a few days if they process everything correctly.

One more important detail - make sure you're filing your weekly claims while waiting for the reopened claim to process. Many people make the mistake of waiting until their claim is approved before filing their weeklies, but you should file every week even while it's processing. ESD won't backdate weekly claims if you miss them, even if your claim was in the reopening stage.

That's a great point, thank you! I wasn't sure if I should wait or not but I'll make sure to file this Sunday.
