Subsequent claim filing after benefit year ended - Another waiting week?

So I just hit a situation I wasn't prepared for. I was laid off from my construction job about 3 weeks before my benefit year officially ended (which was today). When I logged in to file my weekly claim, the system made me do something called "subsequent claim filing" instead of my regular weekly claim. Has anyone gone through this process before? I'm really stressing about whether there's going to be another waiting week like when I first applied last year. Back in October 2024, it took almost 4 weeks before I saw my first payment after filing. I've got rent due in 10 days and can't afford another long delay. I've searched the ESD website and can't find anything specific about subsequent claim filing vs. new claims. Will all my information carry over? Will I need to do job search activities during this transition? Anyone know if I'm in for another long wait?

Yes, I went through this exact thing in January. The "subsequent claim filing" happens when you're still unemployed as your benefit year ends. It's basically a streamlined new claim since they already have most of your info. The good news is that you *shouldn't* have another waiting week because it's considered a continuation of your unemployment situation. However, ESD will still review your application to make sure you qualify for a new benefit year. They'll check if you've worked enough hours during your previous benefit year to establish a new claim. If you haven't worked enough quarters, they might deny the new claim. Keep filing your weekly claims as normal while this processes. In my case, it took about 10 days before payments resumed.

Thank you so much for this info! That's a huge relief about not having another waiting week. I did work for about 7 months before this recent layoff, so hopefully that's enough for them to establish a new claim. Did your benefit amount change at all when they processed your subsequent claim?

Oh man, that's exactly what I'm afraid of. 5 weeks would destroy me financially right now. Did they eventually backpay you for all those weeks?

I've helped several people through subsequent claim filing. Here's what you need to know: 1. Technically, there is no waiting week for a subsequent claim IF you file it within 4 weeks of your benefit year ending AND you've been continuously claiming. Since you mentioned being laid off 3 weeks before year-end and filing today, you should be good. 2. They will review your work history during your previous benefit year to determine if you qualify for a new claim. You need to have worked and earned wages in at least 680 hours during your base year. 3. Your weekly benefit amount might change based on your earnings during the new base period. 4. The system will continue processing your weekly claims, but payments might be held until the subsequent claim review is complete. 5. Yes, you must continue doing your 3 job search activities each week without interruption. Based on recent cases I've seen, the processing time for subsequent claims is running about 10-14 days right now, but it can vary.

This is incredibly helpful information, thank you! I definitely meet the 680 hours requirement since I worked from March through October before this layoff. So it sounds like I should just keep filing weekly claims as normal and hopefully the payments will start again within a couple weeks?

Went thru this exact thing in November. My payments stopped for 3 weeks while they processed my subsequent claim. What worked for me was using Claimyr (claimyr.com) to get through to an actual ESD agent who could check on the status. Normally I'd waste hours trying to get through on the phone, but this service connected me to an agent in under 15 minutes. They have a video showing how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 The agent saw that my claim was just sitting there waiting to be reviewed and was able to escalate it. Got paid two days later for all the missed weeks. Definitely worth it when you're facing rent coming due.

is this a legit service? seems sketchy to me that you have to pay to talk to ESD when its a government office...

It's definitely legit. They don't replace ESD - they just get you connected to the actual ESD phone lines when everyone else is getting busy signals. ESD is severely understaffed and their phone system is from the stone age. After trying for 4 days straight to get through, this was the only thing that worked for me.

i did a subsquent claim last year and didnt get a waiting week but my benefits were different amount. they look at different quarters for ur wages i think? anyone know how they calculate this?

Yes, for a subsequent claim, they shift the base year forward. Your new base year becomes the first 4 of the last 5 completed calendar quarters before you file the subsequent claim. So if you earned more during these newer quarters than during your original base year, your weekly benefit amount could increase. If you earned less, it could decrease. The maximum weekly benefit amount for 2025 is now $1,050, and the calculation is still roughly 63% of your average weekly wage up to that maximum.

THIS IS WHY THE SYSTEM IS BROKEN!!! Every time there's a transition they make us wait with ZERO money coming in. I had the EXACT same thing happen and ended up waiting 6 WEEKS with no income while they "processed" my claim. Called over 30 times and either couldn't get through or talked to people who couldn't help at all. I ended up having to take out a payday loan just to avoid eviction. Then they finally approved everything and paid me retroactively but the damage was already done. The interest on that loan was insane. The whole system is designed to make people give up. They hope you'll just find some minimum wage job out of desperation instead of getting the benefits you EARNED and DESERVE. It's absolutely criminal how they treat people.

That's terrifying. I'm really sorry you had to go through that. I absolutely cannot afford to wait 6 weeks - I've got about 2 weeks of savings left and that's it. Did you ever figure out what caused the delay in your case? Was there something I should avoid doing?

They claimed they needed to "verify my identity" even though I'd been claiming for 11 months already with no issues. It was completely random and they never contacted me to tell me there was a problem. I only found out when I finally got through to someone. Make sure you check your ESD account messages daily and respond to anything immediately!

Just to follow up on my earlier comment - I should clarify that while technically there's no waiting week for subsequent claims, the reality is that there can still be processing delays. The system doesn't automatically approve subsequent claims. Based on my experience helping people with ESD claims, I recommend: 1. Check your ESD account messages daily 2. Continue filing weekly claims without interruption 3. Keep detailed records of all your job search activities 4. If you don't see payment after 10 days, start calling ESD Also, regarding your rent situation - if payments are delayed, contact your landlord immediately and explain the situation. Some landlords are willing to work with you if they know unemployment benefits are coming but delayed. Getting ahead of the situation is always better than waiting until rent is already late.

Thanks for the follow-up advice. I really appreciate that point about contacting my landlord proactively. I've been a good tenant for years so hopefully they'll be understanding if I need a few extra days. I'll definitely start calling ESD if I don't see movement by next week.

One other thing I forgot to mention - when I went through this, my benefit amount actually increased by about $75/week because I had worked at a higher-paying job during my benefit year. So that was a nice surprise after all the hassle of waiting.

Thanks for sharing a positive experience! That's reassuring to hear. Can I ask if you did anything special or just filed normally and waited?

Update: It's been 9 days since I filed my subsequent claim and I just got a notification that my new benefit year was approved! The weekly amount is actually $42 higher than before, which is a nice surprise. Looks like I'll get paid for these two weeks tomorrow. Thanks everyone for your help and advice. For anyone finding this thread later - there was no waiting week, but it did take about 9 days for the system to process my subsequent claim. Make sure you keep filing your weekly claims during this time!

That's great news! Thanks for coming back to update us. It's always helpful to see how these situations resolve for others going through the same thing. Glad to hear it worked out relatively quickly for you!
