ESD denied benefits after wrongful termination - need advice for filing appeal without lawyer

I just got fired for 'performance issues' but it was really because I reported safety violations. My employer contested my unemployment claim saying I was fired for misconduct, and ESD denied my benefits! I think this is totally illegal and I want to sue my former employer for wrongful termination while also appealing the ESD decision. Problem is, I can't afford an attorney right now and need to file something ASAP before deadlines pass. I know I probably need to file in superior court for the wrongful termination, but have no idea what forms to use or how to connect this to my unemployment appeal. Has anyone gone through this process without a lawyer? Any advice on what forms I need or where to start? I've got bills piling up and really needed that unemployment while fighting this.

Hold on, you've got two separate issues here. For the ESD denial, you don't go to superior court - you need to file an appeal with OAH (Office of Administrative Hearings) first. There should be appeal instructions on your determination letter. You have 30 days from the date on that letter to appeal the ESD decision. The wrongful termination lawsuit is completely separate and much more complicated.

I went through something similar last year. Listen carefully: DO NOT miss the 30-day deadline to appeal your ESD denial! That's your immediate priority. For the wrongful termination, most employment attorneys will give you a free consultation and many take cases on contingency (you pay nothing upfront). But for the ESD appeal, the form is actually pretty simple - it should have been included with your determination letter. You just fill it out explaining why you think the decision was wrong and submit it to OAH.

I couldn't get thru to anyone at ESD when I was trying to appeal my denial. Waited on hold for HOURS and then got disconnected. I ended up using Claimyr (claimyr.com) and they got me connected to an ESD agent in about 15 minutes. Seriously saved me so much frustration. be careful what u say in your appeal!!! my coworker said the wrong thing and it made everything worse. stick to the facts and dont get emotional. the wrongful termination thing is WAY different, dont mix them up in your appeal

For your ESD appeal, focus ONLY on why you should qualify for unemployment - not the whole wrongful termination issue. The OAH judge only cares if you were fired for misconduct that would disqualify you from benefits. For the separate wrongful termination lawsuit, try contacting your county's volunteer legal services - many offer free help with employment issues. The WA Bar Association also has a moderate means program for people who don't qualify for free legal aid but can't afford full-price attorneys.

That makes sense. So for the ESD appeal, I should just focus on proving I wasn't fired for misconduct that would disqualify me from benefits, and leave out the safety violation reporting stuff? And I'll definitely check out those legal resources for the wrongful termination part.

The ESD system is RIGGED against workers!!!! I got fired for total BS reasons too and they sided with my employer even though I had proof they were lying. The whole appeal process is just theater to make you think you have rights. Good luck but don't get your hopes up!!!

That hasn't been my experience at all. I won my appeal with OAH when my employer claimed misconduct. The judges are actually pretty fair if you present your case well and stick to the facts.

When I had my ESD appeal hearing last fall, I wish someone had told me to prepare better! Make sure you have EVERYTHING documented - attendance records, performance reviews, any warnings, emails about the safety issues you reported, everything! The hearing goes so fast and if you forget to mention something important, you might not get another chance.

One more thing - for your actual appeal hearing, you need to understand what legally constitutes "misconduct" under Washington unemployment law. It's much narrower than what most people think. Simple poor performance is NOT misconduct. For ESD purposes, misconduct generally requires willful or wanton disregard of the employer's interest. If you genuinely were trying to do your job but weren't meeting expectations, that's not misconduct under ESD rules.

After your ESD appeal is resolved (hopefully in your favor), if you still want to pursue the wrongful termination lawsuit, you should know that Washington is an employment-at-will state, which means employers can fire you for almost any reason EXCEPT for legally protected activities like whistleblowing about safety violations. Your case might fall under the public policy exception to at-will employment.
