ESD confusing paycheck reporting - report sick pay received after layoff?

I'm totally confused about income reporting on my weekly claim. I was laid off January 22nd and I'm now submitting my first weekly claim for the week of Jan 26-Feb 1. My final paycheck landed in my account on January 28th, which included some regular pay for my last few days plus all my unused sick time they paid out (about $1,850 total). Do I need to report this income on my weekly claim even though I didn't actually work during the claim week? The paycheck was technically received during my claim week but was for work done before I was laid off plus the sick pay. The ESD handbook doesn't seem clear about this specific situation and I'm panicking about filling this out wrong. Has anyone dealt with this before?

You only report income for hours worked during that specific week you're claiming. Since you didn't actually work any hours during Jan 26-Feb 1, you wouldn't report those earnings. The sick pay payout is considered earnings from before your layoff, even though you received the payment during your claim week. What matters is when you EARNED the money, not when you received it.

i had this EXACT problem last yr!!! the lady on the phone told me u only report work u did DURING the week ur claiming not when u got paid... so ur sick pay was for work b4 u got laid off so dont report it

I think you DO need to report it. My cousin got in trouble for this exact thing. When they paid out your sick time, that counts as income for the week you received it. ESD considers that income in the week received, even if you didn't work. Better safe than sorry!

I'm going through this too actually! I got laid off and had final pay + vacation payout. You definitely do NOT report the sick pay for the week you received it if you didn't actually work. If you want to be 100% sure, you'll need to talk to an ESD representative. Like I mentioned above, I had success using Claimyr to get through to them quickly. Better to get it right the first time than have to deal with overpayment notices later.
